3. Project Description:
The 37-acre project area is located at the southwest terminus of Andrews Chapel
Road approximately 0.3 mile north of the intersection of US-70 and TW Alexander
Drive in Durham, North Carolina. The project area straddles Durham and Wake
Counties and consists of two parcels (Durham County PIN: 0769-21-31-9064.DUR;
Wake County PIN: 0769213367). Little Brier Creek runs from north to south through
the western portion of the project area, and a perennial tributary to Little Brier
Creek forms the northern project area boundary. The southwest corner of the
project area includes an overhead utility easement and a sanitary sewer pump
station that serves the Del Web Carolina Arbors community to the north in Durham
County. The remainder of the site was cleared and graded in 2016, at which time
two stormwater ponds were installed. The site has not been developed since it was
cleared and graded; herbaceous vegetation now covers the graded portion of the
site. Land use in the vicinity includes residential and commercial developments and
forested areas. Please refer to the attached USGS Location Map (Figure 1), Buffer
Subjectivity Soil Survey (Figure 2) and Aerial Map (Figure 3) for more information
on the project setting.

Comme nts:
The purpose of the proposed project is to provide residential housing near Brier
Creek in Durham. The proposed project consists of a high-density, multi-family
residential development including roads, sanitary sewer, stormwater infrastructure
and amenities. The proposed project includes two stormwater management ponds
that will outlet through Neuse buffers. The attached Overall Impact Map (Figure 4)
depicts the overall project plan view, and Insets 1 and 2 show the details of the
proposed impact areas. Heavy equipment typical for road construction, utility
installation and grading will be used to construct the proposed project such as track
hoes, bulldozers, dump trucks and graders.

A Neuse buffer determination was issued by NCDWR on September 6, 2007 (exp.
September 6, 2016) and an Approved Jurisdictional Determination was issued by
the USACE on November, 29, 2012 (exp. November 29, 2017). The site was cleared
and graded in 2016 before the determinations expired.

The Neuse Buffer Authorization issued on August 5, 2015 (DWR # 15-0739)
approved 220 sf of Zone 1 Neuse buffer impacts and 422 sf of Zone 2 impacts for
Phase I of the Corners at Brier Creek project (see attached approval letter).
Construction of Phase I was completed in 2017. The current application is for
proposed buffer impacts related to Phase II of Corners at Brier Creek.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
The buffer impacts are necessary for the installation of two stormwater outfalls from
two wet detention ponds that are needed to detain and treat the additional
stormwater flows that will be generated once the project is contructed. Impacts to
Neuse Buffers associated with the proposed stormwater outfalls have been
minimized by designing the outfalls perpendicular to Neuse Buffers. The outfall from
SWMF E (Inset 2) extends to the bank of the Little Brier Creek Tributary, and thus is
designed with a slight downstream angle to minimize erosive flows entering the
stream channel. The outfall from SWMF D (Inset 1) terminates at an ephemeral
drainage feature that will direct flow into Little Brier Creek.
Tree protection fencing will be used to prevent grading and construction equipment
from impacting more riparian buffer area than necessary for the work. Silt fence will
be installed along the downslope side of the grading and around the limits of
disturbance to protect water quality during construction. A Sediment and Erosion
Control Plan will be developed and approved by the NC Division of Land Quality
and/or City of Durham Stormwater Services, and the project will comply with the
supplementary NPDES Construction Stormwater Permit (NCG010000).
E. Diffu se Flow Pl an
All buffer impacts & high ground impacts require diffuse flow or other form of stormwater treatment. If the project is subject to a state implemented
riparian buffer program, upload a plan that fully documents how diffuse flow will be maintained. All stormwater control measures (SCMs) must be
designed in accordance with the NC Stormwater Design Manual. Associated supplement forms and other documentation must be provided.
