So NWP 14 is appropriate. Also, we consider mechanized land clearing a permanent impact. Currently, they are proposing 0.34 acre of hand clearing, so that would push them over the NWP threshold of 0.5 acre if all of the area labeled as HC was then changed to MC. I would have to do an individual permit ... so, maybe not? Can you tell what the width of the fill is on the plans? If they can get the MC to under 0.5 acre we could still process as a NWP 14, but they will have to revise the mitigation request for 0.5 acres instead of 0.21. They usually show a 5' Mechanized clearing zone for fill less than 10' and a 10' MC area for fill greater than 10'. So do we need to do that here.
