These bridges were constructed under the approval authority of Duke Power Company last winter during periods of low water to minimize impacts. This letter is to advise you that during construction, field adjustments were made regarding the positions, length and heights of these structures, based upon practical site and aesthetic considerations. These adjustments have created opportunities for the creation of several aquatic "preserves" where habitat for fish, aquatic organisms, and waterfowl can be considerably improved. We are requesting your assistance and advice in developing mitigation and enhancement measures to this end. Field Adjustments The adjustments to the originally proposed locations and heights of the bridges were made to reduce the scale and to lessen the visual impact of the structures upon views from the lake and the surrounding shoreline. This was accomplished by lowering bridge "A," by moving bridges "B and C" as close to the rear of their respective coves as was practicable, and by winding them through the trees to hide them (please see attached "proposed" bridge locations and field- surveyed "as-built" locations). This created longer, more costly structures, but it had the effect of blending the water crossings into the landscape where they were screened or hidden entirely by vegetation and the slope of the land. What were originally proposed as visually prominent "bridges" became low impact "catwalks." (Please see attached photos). Oldham Planning & Design Associates, Inc. This has the effect of restricting navigation in the small areas at the extreme rear of the these coves, but the restriction is minimal at best, as the areas in question are so confined and shallow as to render navigation implausible in any case. Duke Power lake Management in its review has determined that the bridges "have been pushed far enough toward the heads of the small coves so that navigation is not impacted." In addition, the location of the lowered crossings has the effect of protecting these shallow areas from wave action, watercraft propeller damage, and craft landing/ launching. (Please see attached surveys delineating areas behind bridges). Impacts on Existing Aquatic/Shoreline Vegetation With reference to the Sev mkr 1998 Duke Pow Shoreline Managawz" Plan, the field adjustments to the golf cart crossings have had the following effects: • "Bridge A": No "Environmental Area" designations are shown for this cove. No impact to "Environmental Areas" has occurred or will occur because of this bridge. "Bridge B": An identified "Environmental Area" at the extreme rear tip of the south-western cove is crossed by the raised structure at a height of approximately five feet. The total surface area of the catwalk deck over the Environmental Area is approximately 230 sq.ft. The area of actual permanent disturbance where supporting poles penetrate the ground is less than four sq.ft. Any areas of temporary disturbance caused by construction will be replaced and enhanced for purposes of re-establishing improved habitat. (Please see attached proposed plant list). "Bridge B" also crosses a designated wetland area behind the rear tip of the northwestern cove at a height of six feet. The surface area of the catwalk over this wetland is approximately five hundred sq.ft. The area of actual permanent disturbance where supporting poles penetrate the ground is approximately nine sq.ft. Any temporary disturbance to the wetland area that occurred during construction will be replaced with suitable native wetland plants. (Please see attached plant list). The surface area of the catwalk over this "Environmental Area" is approximately four hundred fifty sq.ft. The actual area of permanent disturbance caused by supporting poles is approximately thirty sq.ft. Any temporary disturbance to this "Environmental Area" that occurred during construction will be replaced and enhanced with suitable native plant materials. (Please see attached plant list). Proposed Actions: Creation of Enhanced Habitat "Preserves" As noted earlier, the lowering of the cart path crossings and their repositioning to the rear of their respective coves creates "fenced-off" areas where water movement and fluctuations continue unabated but where wave action is reduced and disturbance or damage by motorized watercraft is eliminated. The Point development proposes to enhance the areas behind the structures (i.e. between the back of the three crossings and the 760' contour) with appropriate additional emergent and aquatic plant materials to create prime habitat for fish, aquatic organisms, waterfowl and wildlife as well as to offer a pleasing visual experience for cart path and lake users. The Point will (with appropriate Agency's advice and approvals) install the plant materials and maintain them as preserves in perpetuity. The areas proposed for enhancement of habitat and the creation of preserves are: "Bridge A" - 1 area of 3118 sq.ft. "Bridge B" - 2 areas totaling 2679 sq.ft. "Bridge C" - 1 area of 85 sq.ft. (Please see attached surveys) Identified wetland areas which are immediately upland of the proposed preserves will also be enhanced with native obligate wetland plant materials to improve their quality. A suggested aquatic plant list has been compiled for the creation and enhancement of habitats. We would be delighted to have any suggestions that you might provide as to additional plant materials and to practices and management/ maintenance measures concerning the preserve areas. DATE: Action ID 980056, WQC Project 970610 "The Pointe" (previously called "Queensland"), Iredell County SUBJECT: Review of an application by Crescent Resources, Inc, to impact 0.6848 acres of wetlands during construction of the "The Pointe", Iredell County. Mr. Arthur H. Oldham, Oldham Planning and Design Associates, Inc., on behalf of their client, Crescent Resources, Inc., is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality. The NCWRC has reviewed information provided by the applicant, and I discussed this project with Mr. Steve Chapin of the US Army Corps of Engineers (COE) on February 9, 1998. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Crescent Resources, Inc. proposes to develop 1162 acres as "The Pointe" adjacent to Lake Norman in southern Iredell County. Initial plans in the letter dated January 9, 1998 to your office noted that 0.6848 acres of wetlands will be impacted by filling (0.5728 a) and three minor road crossings (0.112 a) during construction of the 18-hole golf course and 924 residential lots. Since the January 9, 1998 letter, Mr. Chapin (COE) has met on site with project sponsors and plans have been revised to reduce wetland impacts to less than 0.3 acre (phone conversation on 2/9/98). Plans also call for a buffer between the lake and the golf course. Based on discussion of revised plans as directed by Mr. Chapin (COE), we have no objection to the project impacting less than 0.3 acres of wetlands provided the following recommendations are implemented: 1. The impacts to wetlands do not require the filling or dredging of any coves or wetlands associated with coves. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3105. This certification allows you to use Nationwide Permit Number 16 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your new application except as modified below. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. In addition to the conditions outlined in Mr. Oldham's letter of June 1, 1998, silt curtains shall be used during all dredging operations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. In reference to concerns expressed regarding the potential impacts on aquatic resources and shoreline habitat associated with pier construction and proposed dredging activities, we offer the following responses: GENERAL RESPONSES: • Sounding/bottom data: Prior to the initiation of site planning for The Point, a boundary survey was undertaken by ESP Associates, the project's engineers. This field survey accurately established the location of the 760' contour for the entire property. At the same time, utilizing waterborne GPS sounding equipment accurate to one-tenth (1/10) of a foot, the surveyors provided a topographic map of the lake bottom contours for a distance of approximately one hundred-twenty (120) feet from the 760' contour, for all eighteen (18) miles of shoreline. These mapped bottom contours were used in combination with Lake Norman Dredging Company's further site specific investigation to accurately determine the amount of dredging required to achieve a ten (10) foot water depth at the Community piers. • Environmental Areas: The Environmental Areas delineated on the Lake Facilities Plan are those identified in the approved Duke Power Shoreline Management Plan. The applicant understands that there are other areas along the shoreline Oldham Planning & Design Associates, Inc. The Western Piedmont Region Coordinator for The North Carolina Wildlife Resources Commission has provided the applicant with a field map from the joint agency site visit which identifies these additional areas. This map has been used in the current relocation and reconfiguration of piers in order to avoid dredging impacts to these potential habitat areas. Therefore, all areas identified as "Environmental," whether by official designation in the Shoreline Management Plan or by field identification during the joint agency site visit, have been taken into account and protected, in the current Lake Facilities Plan, dated June 3, 1998. • Notification to Prospective Buyers/Lot Owners: All waterfront lot purchasers at The Point will be clearly notified in their deeds and in separate documentation, that their property is adjacent to a Duke Power reservoir to which they have no guarantee of access nor right of ownership. Buyers of lots adjacent to currently designated Environmental Areas will also be notified of the limited uses which are permitted on their property; no disturbance of vegetation below the 760' contour and no piers or docks in, or crossing, the Environmental Area. For waterfront lots which are adjacent to other areas that maybe suitable for classification as "Environmental" because of the presence of buttonbush, sandy bottom, or gravel, the applicant will provide, through the project's Covenants and Restrictions, protection of these areas from handclearing of vegetation or dredging. The Restriction will also indicate the acceptable location for a private pier on each waterfront lot, and the requirement that it be permitted through Duke Power's review and approval process. Duke Power maintains the authority to approve or disapprove private piers on all waterfront lots. If dredging is necessary to achieve an acceptable water depth for navigation, it will not be allowed to occur within the area potentially classifiable as "Environmental." All owners of waterfront lots will also be notified in their deed of the thirty (30) foot watershed buffer which extends upland from the 760' contour across the lakeside of their lot. • Dredging Procedures: In an effort to reduce potential impacts associated with dredging the applicant is adopting an improved procedure for all Community Pier and Marina dredging at The Point. Rather than employing hydraulic dredging methods which require considerable land disturbance for piping and dewatering operations, the dredging will be conducted using a Track Hoe mounted on a floating barge. Material will be excavated and placed in a watertight holding barge for transport to an approved spoil site. Since the Track Hoe bucket dewaters as it Oldham Planning & Design Associates, Inc. Where necessary or appropriate, turbidity curtains will be used to isolate the dredging operation. Dredging will be limited to the minimum amount necessary to achieve pier installation and safe navigation. Dredging will be conducted "in the dry" if possible, when the lake level is low. No dredging will occur in March, April, May and June because of potential impacts to fish spawning sites. • Community Pier Configurations: The comments provided from the reviewing agencies have indicated a preference for piers that are perpendicular rather than parallel to the shoreline, to reduce impacts to shallow water habitat. In almost all cases, the Community Piers cannot be made to be perpendicular, as they will be too long for the coves in which they are located. They cannot be longer than one-third of the width of the cove nor over 120 feet. Building multiple, shorter, perpendicular piers to provide the same number of slips as a parallel pier, would create greater impacts to the shoreline as there would be more ramp locations and hence, more disturbance. To respond to the need to preserve shallow water habitat, submerged vegetation, and desirable bottom conditions, the applicant proposes to relocate the parallel piers further out in the lake so that the identified habitat areas are on the landward side, behind the piers. Only one access ramp will occur with each pier so disturbance will be minimized. No dredging will occur in the habitat areas, nor will there be any clearing of submerged or emergent vegetation. (Duke Power Lake Management staff has indicated that the occurrence of buttonbush is primarily within the lake normal operating level which is between the 757' and 760' contours). In addition, the parallel pier configurations will "fence off" the shoreline habitat areas, protecting them from boat traffic, boat beaching, etc. The specific treatment proposed for each of the Community piers and the Marina is explained in detail below. Community Piers A&B: These piers cannot be redesigned to be perpendicular to the shoreline rather than parallel as they will exceed the Duke Power regulation requiring that piers be no longer than one-third the cove width in which they are placed. Piers may also not be longer than 120 feet in length. In order to accommodate the concerns expressed by the reviewing agencies, the piers will be moved away from the shore approximately twenty (20) additional feet to preserve from disturbance any shallow water habitat behind the piers. Dredging will not occur between the 755' and the 760' contours as a consequence of this adjustment to piers A&B. In addition, the shallow water habitat Oldham Planning & Design Associates, Inc. Pier Q This pier cannot be made perpendicular to the shore rather than parallel for the same reasons that apply to A and B. The pier has been adjusted, however, so that the from shallow water habitat from the 755' bottom contour to the 760' shoreline contour will remain undisturbed by dredging activities. 3. Pier E: Duke Power's restrictions requiring pier length not to exceed one-third of the width of the cove prevent this pier from being perpendicular to the shoreline rather than parallel. This pier can, however, be positioned so that its backside is at the 754' contour. The shallow water habitat between the 755' and 760' contours will not be disturbed by dredging activities. In addition, the shallow area at the narrow back of the cove behind the pier (shown on the field map as potentially being an environmental area) will remain undisturbed. 4. Pier F: This pier, if relocated to another position in the cove as suggested and reconfigured to a perpendicular alignment with the shoreline, would exceed the one-third of the cove rule. In order to avoid impacting the emergent vegetation growing in the shallow areas near the shoreline, the pier has been moved forward so that no dredging will occur between the 755' and 760' contour. This repositioning will leave the area of emergent vegetation and shallow habitat undisturbed. 5. Piers G and H: In order to minimize disturbance the length of riprap on the outside of the outermost piers has been reduced to a maximum of 50' in these locations. 6. Pier I: The designated Duke Power Environmental Area in the same cove with this pier will not be disturbed or otherwise impacted. 7. Pier J: Relocating this pair of perpendicular piers to the north, farther into the cove, would place them in a position that violates the one-third of the cove rule. The cove becomes narrow quickly so an alignment which is parallel to the shoreline would place the pier close to the 760' contour. We propose instead to remove two sets of slips from the shoreline side of each pier. This moves the start of dredging to a distance of thirty (30) feet from the 760' contour at the back of the piers and preserves the buttonbush in the shallow areas. The number of slips at Pier J is therefore reduced from 24 to 20 slips. 8. Pier N: This pier cannot be reconfigured to be perpendicular to the shoreline as it would violate the maximum one-third of the cove width for length. In order to avoid impacting the shallow water habitat of buttonbush and sandy bottom, the pier has been moved out to its maximum allowable position from the 760' contour and four (4) slips have been removed from the configuration, reducing the total from 20 to 16. In this location, no dredging for the pier will occur between the 755' and 760' contours. 11. Pier O: The designated Duke Power Environmental Area in the same cove with pier O will not be impacted or otherwise disturbed by the dredging activities. 12. Pier P: This cove is too narrow to accommodate a pier perpendicular to the shoreline. It also cannot be moved forward as a parallel pier without exceeding the maximum allowable length of 120 feet. It has therefore been deleted from the plans. 13. Pier Q: To minimize shoreline disturbance the riprap on both sides of this pier will be limited to a maximum length of fifty (50) feet. 14. Pier R: To minimize shoreline disturbance the riprap on both sides of this pier will be limited to a maximum length of fifty (50) feet. 15. Pier S: This pier cannot be reconfigured to be perpendicular to the shoreline without violating the one-third of the cove rule for maximum length. In order to avoid impacting the shallow water habitat near the shoreline, this pier has been moved forward so that no dredging will occur between the 755' and 760' contours. In its revised location, the back of the pier is thirty-five feet from the 760' contour at its closest point. 16. Pier T: The shallow water habitat in the form of buttonbush, sandy bottom and gravel at the back of the cove which contains pier T will not be impacted by dredging or otherwise disturbed. The land area adjacent to this shallow habitat is planned as protected Open Space in the master Site Plan. 17. Pier U: This pier cannot be reconfigured to be perpendicular to the shoreline as the cove is too narrow and the one-third for cove of maximum length rule would be violated. The back of the pier is thirty-five (35) from the 760' contour at its closest point. 18. Pier V: The width of the cove in which pier V is located does not permit a perpendicular configuration of this pier without violating the one-third of the cove width rule for maximum pier length. The pier has been moved approximately twenty (20) feet farther out from the 760' contour at the back of the cove. The dredging has also been reconfigured so that it begins farther from the shoreline so that no dredging will occur between the 755' and 760' contours. The back of the pier is thirty (30) feet from the 760' contour at its closest point. It is fifty (50) feet from the 760' contour along the entire back portion of the cove where the field map from the site visit indicated the existence of buttonbush and sandy bottom habitat. 19. Pier W: Pier W cannot be reconfigured to be perpendicular to the shoreline because of the narrowness of the cove in which it is located. A perpendicular pier would violate the one-third cove width for maximum pier length. In order to avoid impact from pier dredging to the buttonbush and sandy bottom habitat, the entire pier has been moved approximately thirty-five (35) feet farther away from the 760' contour at the back of the cove. At the rear of the cove, where the field map from the site visit indicated the largest area of desirable habitat, no dredging will occur within fifty (50) feet of the 760' contour. 20. Pier X: The cove in which pier X is located is too narrow to permit a reconfiguration of this pier to one which is perpendicular to the shoreline. As in the previous cases, a perpendicular configuration would violate the one-third of cove rule for maximum pier length. To avoid impacting the buttonbush and sandy bottom habitat, pier X has been moved away from the shoreline so that no dredging will occur between the 755' and 760' contours. At the back of the cove, where the site map from the field visit indicated an area of "excellent habitat," no dredging will occur within forty (40) feet of the 760 contour. 21. Community Marina: The marina area is governed by the same Duke Power regulations as the community slips but has some additional requirements. A maximum pier length of one hundred twenty (120) feet cannot be exceeded and the distance between piers cannot be less than two (2) times the length of the largest slip to allow sufficient room for boats to exit without colliding. Since the Community Marina will provide slips for the largest boats (sixteen-foot wide slips, forty feet long) the distance between the piers will also be the greatest (eighty feet). This accounts for the spacing of the piers along the shoreline and is the reason for the one-sided piers. The wider slips can easily be at reach Oldham Planning & Design Associates, Inc. Reconfiguring the piers to make fewer longer piers is therefore not practical. To avoid impacting stands of buttonbush along the shoreline, the piers have been extended to their maximum, practical, allowable length. This leaves a wider band of undisturbed area along the shoreline below the 760' contour. The minimum distance from the 760' contour to the area of the first slips where dredging will occur is twenty-six (26) feet. The majority of the piers will have distances of thirty-two (32) to forty-one (41) feet between the 760' contour and the start of dredging. Shoreline stabilization at the Marina, if required, will be done with riprap rather than bulkheading to provide a greater opportunity for aquatic habitat. OTHER CONCERNS: • Shoreline Stabilization: Wherever riprap is used for shoreline stabilization at a Community Pier or at the Marina, it will not extend more than fifty (50) feet from each side of the pier. • Upland Disposal: Any upland disposal sites proposed for disposal of dredge spoil will request prior approval from NCDWQ's Mooresville Regional Office. As required by the project's current 401 permit, a minimum thirty (30) foot buffer will be left adjacent to all perennial waters. This requirement will be incorporated into a conservation easement for any additional 401 permits requested for dredging. If required, any upland, diked disposal basins will be designed using the example found in the General Certification for NW16. Observed Site Disturbance: The site disturbances noted on March 26, 1998 have been addressed with the appropriate contractors and have been corrected. The Army Corps of Engineers has been contacted and they have provided the Nationwide Permits necessary to perform work in wetlands areas for which they have regulatory responsibility. The shallow water habitat observed along the north side of golf hole # 18 will not be disturbed below the 760' elevation. In a phone conversation with Art Oldham (4/28/98), he noted that due to FERC/Duke Power Regulations the Piers in some of the more narrow coves must be placed parallel to the shore rather than perpendicular for safety and navigational purposes. As a potential compromise, Mr. Oldham has agreed to place these piers parallel of the shore BUT they will be placed offshore of the buttonbush/shallow water gravel/sand habitats. These piers will be placed approximately 20' offshore to preserve these environmental zones. The applicant must demonstrate which parallel piers cannot be redesigned due to the FERC rule and specify (in writing) how far the buttonbush extend from the shore at these sites and how far the piers will be extended to avoid them. 4) To further reduce impacts to shoreline/nearshore vegetation and sand/gravel bottom, the piers at the community marina area should be increased in length (from the shore) to reduce the number of individual piers located in shallow bottom nears hore/shoreline habitat. As designed, these piers are only a maximum of 7 slips long, while some are 3-5 slips long, while one has 4 slips on one side only. It seems that impacts could be reduced xtending these piers to incorporate 10-15 slips and making the "one-sided" 4 slip pier double sided. Based on information obtained during the site visit, the proposed dredging activity should be able to conform to the terms and conditions as established in the General Certification. However, as pointed out in the attached response from Mr. Mickey to the applicant, there are significant concerns regarding the protection of fisheries habitat that may be effected by the dredging activity. Based on size alone, this dredging project is possibly the largest that this Office has ever been asked to permit on Lake Norman. Although from a WQ standpoint impacts to Lake Norman from the dredging activity are expected to be short term, the overall effects of the dredging, especially to fish and their nursery areas may be more profound. Although many of the coves to be dredged have little or no flowing water coming into them, the emergent vegetation observed in the back of these coves help serve as a filter for any run off entering the cove. Pollutant removal will become more critical once development of the site has commenced and the land is disturbed during site preparation. Hopefully, the comments provided by Mr. Mickey will encourage Crescent Resources to reconsider the placement of some of their community piers to locations that will minimize impacts to aquatic vegetation. It is our understanding that the dredging contractor is considering a single site for the location of the upland t diked disposal basins rather that several sites. The North Carolina Wildlife Resources Commission (NCWRC) is authorized to comment and make recommendations which relate to the impacts of this project on fish and wildlife through the Federal License of Water Resource Project Act (Federal Power Act-16 U.S.C. 791a et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Crescent Resources, Inc. proposes to construct "The Point" development on approximately 1160 acres impacting 18 miles of shorelinle. Project facilities consist of 391 Community Boat Slips in 24 separate locations and 178 Marina Slip in one central location,, three bridges crossing narrow coves for use by golf vehicles, one causeway crossing for the same purpose, and a water intake line. We conducted a site visit on March 26, 1998 with Mr. John Ellis, US Fish and Wildlife Service (USFWS) and Mr. Mike Parker, NC Division of Water Quality (DWQ). In general we `a have no concern with the water intake structure, three bridges over narrow coves and one lake ZS- causeway crossing. However, we are concerned with potential impacts on aquatic resources and shoreline habitat associated with pier construction and proposed dredging activities at numerous locations. I have addressed each of the 25 sites with recommendations as follows: Community pier Sites A, B, C, D, E, G, H, I, K, L, M, O, Q, R, and U - we have no concerns with these sites as proposed, however, our preference would be that perpendicular piers instead of parallel piers be used at Sites A, B, C, E, M, and U. This will reduce shoreline impacts. Also, care should be taken not to disturb shallow water habitat in the back of the cove containing sites A/B and the desiunated environmental areas should not be impacted at site I and O. 2. Community pier Site F - change design of this site to a perpendicular pier and move it to avoid impacting buttonbush growing along the shoreline in this area. This could be accomplished by placing the pier on the small left point joining the first lot (moving ,,vest). 3. Community pier Site J - move this site to avoid impacting buttonbush along the shoreline. 4. Community pier Site N - redesign this pier to a perpendicular pier coming off the dam at the small pond. This parallel shoreline pier as proposed will impact good shallow water habitat in the form of buttonbush and sandy bottom. 5. Community Marina - no concern with this site provided that any shoreline stabilization done in this location is with riprap instead of a bulkhead structure. Riprap provides more aquatic habitat that bulkheads. Some of the perpendicular pier locations have buttonbush growing along the shoreline, we recommend that these stands of buttonbush not be disturbed if at all possible. 6. Community pier Site P - this site needs to be moved or redesigned as a perpendicular pier to reduce impacts. There is good habitat in the form of buttonbush and sandy bottom at this location. Perhaps these slips could be combined with sites R and Q. 7. Community pier Site S - to avoid impacting buttonbush and the sand and gravel bottom at this location, the pier should be redesigned to be a perpendicular pier instead of a parallel shoreline pier. 8. Community pier Site T - there is excellent habitat in the form of buttonbush, sandy bottom and gravel at this location. Care must be taken to avoid impacting these areas near the pier site. 9. Community pier Sites V, W, and X - these sites contain excellent habitat in the form of buttonbush and sandy bottom. Piers should be designed to be perpendicular instead of parallel to the shoreline in order to reduce impacts to shallow water habitat. In general, to minimize impacts from proposed dredging activities, we recommend that no dredging occur during the months of March, April, May and June because of potential impacts to fish spawning sites. Dredging should be done in the dry if possible when the lake level is low, this will minimize sedimentation into the lake. We also recommend that no dredging be permitted from the 755 to 760 foot elevation that contain submerged or emergent vegetation and a sand or gravel bottom. During the site visit we also observed several items of concern associated with golf course construction. Most notable were the lack of silt fences and ground cover at disturbed sites. Some areas had silt fences, but they were located 10-20 feet above the waters edge, allowing some sedimentation to reach the lake (especially at holes # 9, 17, 18). At hole # 9, there was considerable fill in a small creek or ditch channel that led to the lake which should be removed and erosion controls installed. We are also concerned about the amount of shoreline clearing that has occurred or will occur at several locations (holes # 17, 18, 20). There appears ? r to be Rood shallow water habitat along the north side of hole # IS leading to the club house and in the area of the practice facility. This shallow water habitat should not be disturbed below the 760 foot elevation. Durinz the site visit we observed may shoreline areas on the project that contained extensive areas of buttonbush associated \vith a sand and/or gravel bottom. We are concerned that these areas were not designated as environmental areas on the Duke Power shoreline management maps. Because good, natural, shallow water habitat is disappearing on Lake Norman at a rapid rate, we believe that many of these areas will be impacted by future homeowners, either through hand clearing or private pier construction. In order to protect these sensitive areas, we recommend that a minimum 25 foot buffer zone be maintained along the shoreline, possibly through lot deed restrictions. Since lots in these areas were not numbered on the map, describing their exact location is difficult. We realize that Duke Power is in the process of revising and ground truthing their shoreline maps for Lake Norman. However, we are concerned that the areas we perceived as being environmental might be impacted before the revised shoreline mapping is completed. We recommend that a site visit be scheduled in the near future with personnel from your office, the NCWRC, USFWS, DWQ, Duke Power Company and Crescent Resources to identify and classify possible new environmental/natural sites that might exist on "The Point" before they are disturbed. As background, on November 30, 1995 Steve Chapin of the Army Corps of Engineers inspected the wetland/upland boundaries established with flagging by our wetland/ecological consultant, Dr. Joe Edmisten. His inspection revealed that the flagging accurately reflected the wetland/upland boundaries and we subsequently received a letter from Robert W. Johnson of the Asheville Regulatory Field Office indicating so. All flagged areas were then surveyed and platted on a property map by ESP Associates according to Mr. Chapin's instructions. Studies to determine the presence of endangered species and historic properties or archeological sites were also conducted at this time. These studies and responses from the appropriate State and Federal agencies concluded that no endangered, threatened or "of concern" plants or animals were found or were likely to be on the subject property. Subsequent land planning of the property was carried out with the intent of impacting the existing wetlands as little as possible in the layout of a proposed 18-hole golf course and 924 residential lots. The total proposed disturbance of wetlands, where it was unavoidable, amounts to 0.6848 acres, comprised of .112 acres for three minor road crossings and 0.5728 acres of filling for the golf course. The proposed disturbance is confined primarily to the upper ends of narrow drainage channels. In all other areas the wetlands and an existing pond have been left undisturbed within the golf course or the project's open space areas. In addition to your Department, we have contacted the US Fish and Wildlife Service, the State Historic Preservation Office, and the North Carolina Wildlife Resources Commission. Their response letters are attached. The Army Corps of Engineers has been sent copies of this application also. The map of surveyed, platted wetlands is attached along with a Master Plan at the same scale. Areas of proposed disturbance of wetlands are shown on both maps.
