Pulp and Paper Division PO Box 787 Plymouth NC 27962 Dear Sirs: You have our approval, in accordance with the attached conditions, to place fill material in 0.39 acres of wetlands or waters for the purpose of stabilizing a shoreline, as you described in your application dated February 17, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to construct a bulkhead ±857.25' long, and riprap an additional ±3,039' of shoreline on the Roanoke River. Weyerhaeuser Company Martin County Page Two Anticipated impacts The project as proposed will result in filling of f 16,501.25 ft2 of river bottom as a result of the placement of the riprap and the construction of the bulkhead. Approximately 588 ft2 of 404 wetlands will be filled as a result of the installation of the bulkhead. Approximately 2,980 ft2 of uplands will be disturbed with the installation of the riprap landward of the 404 wetlands. The project will result in localized turbidity as a result of the filling and construction activities. David W. Moye - 15 January 1998 on the existing plan, has eroded at an accelerated rate. Only a very small portion of this eroding shoreline will be reclaimed (see attached plan at aforementioned stations). The remaining approximate 3,039 feet of eroding shoreline is to be stabilized with rock riprap material. Within the areas to be stabilized with rock riprap, the proposed alignment varies due to the presence of freshwater wetlands and existing non-conforming alignments and materials. In areas which contain no freshwater wetlands, the alignment of the rock riprap material will be located immediately adjacent the normal water elevation contour. This will involve approximately 3,039 linear feet of the proposed project area. There will not be any backfilling activity associated with this section. Within the areas of the project site which contain freshwater wetlands, the proposed alignment was planned after carefully reviewing existing alignments and the topography of the available high ground being protected by the proposed riprap: (I) Rock riprap material will be placed landward of freshwater wetlands for a distance of approximately 596 linear feet. There will be no filling activity associated with this section. (2) Rock riprap material will be placed waterward of freshwater wetlands for a distance of approximately 94 linear feet. In this section, landward placement of riprap would accelerate erosion of the wetland area adjacent to the existing bulkhead. The rock riprap material will be placed at the elevation of the freshwater wetland and will not disrupt the exchange (flow and circulation) of waters of the Roanoke River and the freshwater wetland. There will be no wetland filling activity associated with this section. This section will be enhanced through allowing the regeneration of native hydrophytic vegetation with no mowing activity. Additionally, placement of the riprap material will deter human encroachment into this area. The proposed riprap alignments are depicted on the project plans and provide a specific location of the freshwater wetland areas. An existing 4.5' chainlinlc fence adjacent the existing bridge, as indicated on the plat, will not be altered. In addition, the discharge pipes leading from the existing project site into the river will be eliminated and the discharge permanently rerouted to previously approved internal treatment facilities. The plans also detail areas within the project boundaries which include non- conforming materials and alignments. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, in most cases, 60 days after receipt of a request for certification is a reasonable time for State action.
