Dear Mr. Baker:
You have our approval, in accordance with the attached conditions, to place fill material in various lengths of
stream channels acres of wetlands or waters for the purpose of repairing and stabilizing the streambanks, as you described
in your application dated January 21, 1998 for project sites on Martin, Whiteoak, Roaring, and Jerry Creeks: MC-2. MC-
3, WO-1, RC-1, RC-2, RC-3, RC-4, JC-1, JC-3 and JC-2. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 3115. This Certification allows you to use Nationwide Permit
Number 37 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If total wetland fills for this project
(now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification. DWQ recommends
that existing root wads and tree cribs be used whenever possible.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Avery County, North Carolina. This work is necessary to cover damage from the floods
that occurred on January 7 and 8, 1998. Attached are areas that were examined by local,

This site is at a point where the natural channel of the creek has been altered.
There is a house adjacent to the site that has not been flooded in the past. The
house will have to be elevated or rebuilt to prevent future problems, This will
involve other emergency programs.
This site is approximately 2$00' up stream on Roaring Creek from 19B. There is a
400' stretch of creek using the house as the center point which needs to be corrected,
We will measure drainage area, determine approximate width and depth of the stream
and proceed working to these measurements.
There are root wads available downstream that need to be removed from the flood plain.
We can dispose of the root wad$o at this site, stablize the banks and restore the
stream to pre-storm conditions with stable banks and fish habitat.
