Dear Mr. Moore:
You have our approval, in accordance with the attached conditions, to place fill material in 335 linear feet of
streams for the purpose of stabilizing the streambank of this intermittent stream, as you described in your application
dated January 7, 1998. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3102. This Certification allows you to use Nationwide Permit Number 13 when the
Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and
Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property
is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you
must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms
to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a bearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

Re: Supplement/Revision to PCN for 10803 Chestnut Hills Drive Storm Drainage Project
Dear Mr. Lund:
Per your discussion with Ms. Julie Stahl of Charlotte Storm Water Services on Friday, January
16, 1998 and our subsequent telephone conversation on Tuesday, January 20, 1998, I have
enclosed a revised typical cross-section for the realigned channel. Please disregard the cross-
section depicted on Figure 3, Page 1 of 4 of the January 07, 1998 original submittal of the Pre-
Construction Notification for the above-referenced project. In addition, please replace Figure 2
of the original submittal with the revised Figure 2 (enclosed). Figure 2 was revised to reflect the
filling of the existing channel bed. We hope these revisions address your concerns regarding the
project design.
We appreciate your cooperation in expediting the review of this project in order for the
necessary inormation to be incorporated into the Charlotte-Mecklenburg Utility Department's
design of a new project that will coincide with the construction of this project. If you have any

Dear Mr. Lund:
The purpose of this submittal is to request the U.S. Army Corps of Engineer's (COE)
concurrence to use Nationwide Permit 26, for impacts to an unnamed tributary to Sixmile Creek
located along the side property boundary of 10803 Chestnut Hills Drive in the Chestnut Hills
Subdivision. The proposed activity is located within Mecklenburg County and is proposed by
the City of Charlotte Storm Water Services. In accordance with our on-site discussion with you
on December 11, 1997 we have adjusted our original design to incorporate meanders into the
stream realignment.
Enclosed for your review is one copy of the completed Pre-Construction Notification (PCN)
form and relevant attachments including a narrative for PCN Items 12, 13 and 14, color
photographs, USGS topographic quadrangle map (Figure 1), and two drawings that detail the
existing and proposed conditions (Figures 2 and 3). As required for the PCN, 7 additional
copies of this package are being provided to the North Carolina Department of Environment and
Natural Resources, Division of Water Quality for their concurrence to use the general water

Storm Water Maintenance Project
Item 12: Description of proposed work including discussion of type of mechanical equipment to be
used (attach plans: 8'Y2"x11" drawings only):
The proposed channel improvement/relocation design by NCDOT (and modified by CSWS)
consists of a trapezoidal channel with a 6-foot wide bottom and 4:1 side slopes stabilized with
turf matting (see Figure 3, 1 of 4). The new channel will utilize portions of the existing channel
but will eliminate the existing switch-back meanders which in several areas comes into close
proximity to the property owner's driveway/parking area. The gentle meanders, in place of the
sharp bends, will more sufficiently convey the additional storm water run-off created by the
construction of I-485. The realignment will reduce the length of channel from 335 feet to 295
feet. The course of the realigned channel will traverse the central portion of the existing wetland
and will minimize impact to existing trees. Disturbance due to construction access will be
minimized and will be returned to pre-existing conditions to the extent possible, upon completion
of the project. Timber matting or equivalent will be used to minimize long term damage to the
wetland area. A small trackhoe will be utilized to complete the project. Photographs of the
existing channel, taken in May 1997, are enclosed for reference.
Item 13: Purpose of proposed work:
The proposed work will expedite conveyance of storm water from a proposed 48" RCP that will
be constructed under Chestnut Hills Drive to supplement an existing 54" CMP at this location.
This supplemental 48" RCP is necessary due to the additional storm water discharge from the
recently completed phase of I-485. The additional storm water backwater from Chestnut Hills
Drive threatens possible foundation and mechanical equipment damage at the Jenkins' residence
(see Figure 3, 2 of 4).
Item 14: State reasons why it is believed that this activity must be carried out in wetlands. (Include
any measures taken to minimize wetland impacts):
The proposed channel work must be carried out at this location in waters of the U.S., including
wetlands, since it is through this area that storm water is conveyed and is expected to increase as
a result of the recently constructed phase of I-485. Alternatives to constructing the project as
planned were evaluated internally by Charlotte Storm Water staff, with the property owners, and
with Mr. Steve Lund of the U.S. Army Corps of Engineers, Asheville Regional Office. The
alternatives evaluation process has taken the project from a deepened, widened, straightened, and
turf-reinforced matted channel to a widened, gently meandering, turf-reinforced matted and
vegetated channel. The results of a no-construction alternative would be an increased water
elevation through the channel, wetland area, and possibly the adjacent upland property. The
project as planned is designed to offset the increased flow through this area. As described in
Number 12 above, impacts to the wetland and channel will be minimized to the extent
practicable. Functions of the channel and wetlands is not expected to change as a result of the
proposed work.
