Mary Smith 626 Island Road Harker's Island NC 28531 Dear Mr. and Ms. Smith: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.10 acres of wetlands and 0.43 acres of waters for the purpose of filing in a ponded area at 1122 Island Road, as you described in your application dated January 9, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Only clean fill shall be used to fill this area. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: Applicant proposes to fill a ponded area within his property which was excavated prior to the CAMA for use as a boat basin. The mouth historically shoals, and has effectively removed the basin from interaction with Back Sound except during extreme tides. , 9 FIELD INVESTIGATION REPORT: Ronald And Mary 5nmlth PAGE #2 9. NARRATIVE DESCRIPTION: The project site is a 1.1 acre residential tract located on the south side of Harker's Island, adjacent to Back Sound. The street address is 1122 Island Rd. in Carteret County. The property averages +1' to +6 above mean high water in elevation, and is vegetated predominantly with typical landscape grasses. There is a residence existing on the property which is serviced by a septic tank and community water. The Carteret County Land Use Plan classifies this area as Limited Transition, with all CAMA Areas of Environmental Concern classified as Conservation. The waters of Back Sound are classified SA-ORW by the Division of Water Quality. The area is open to the taking of shellfish for consumption, and is not designated Primary Nursery by the Division of Marine Fisheries. While there is no evidence of seagrass within the basin, Back Sound is scattered with seagrass beds. There is no evidence of shellfish within the basin. There is a ±250' x 75' basin on the south side of the property which was excavated prior to the CAMA. State Permit #70-79 was issued to John S. Blanton, Jr. on 6104/79 for maintenance excavation of the southernmost portion of the basin, installing a bulkhead 50' from the landward end, and filling behind the bulkhead. Because of the objections and permit denials from other agencies, Mr. Blanton had the permit modified on 9/26/79 to eliminate the bulkhead and all fill below mean high water. On 12/04/87, Mr. Blanton was again issued a permit, #234-87 for the maintenance excavation of the basin. The landward or north end of the basin is vegetated with Iva frutescens and S artina patens (1800 sf), transitioning to S artina altemiflora with Juncus roemerianus (±600 sf) as one moves southward into the pond. There is a ±3' fringe of Spartina alterniflora around the majority of the perimeter of the basin (±1200 sf), with three larger populations (±160 sf, 360 sf, 400 sf) within the basin. On the west side of the basin there is a 4' fringe of mixed Borrichia frutescens and Sparing patens landward of the S artina alterniflora (±800 sf). On the east side, the S artina a e ora terminates at the escarpment, and the area is vegetated with S artina patens Mvrica cerifera and Smilax spQ, dropping to a healthy expanse of high and low marsh on the adjacent property. This higher area of wetland species on the east side was probably formed with the spoils of the original basin excavation. There is a 1150 sf area of mixed S artina atens and Borrichia frutescens near the mouth of the basin. The average current depth in the basin is -1' to -1.5' at mean low water. The basin stays filled at all tides due to a blockage at the mouth. The applicant states that there is approximately 1' in tidal flux in the basin, due apparently to a subsurface "pushing" effect of the +2.5' tidal flux within Back Sound. There is no interaction between Back Sound and the basin except during extreme tides. The substrate is very silty, with a sandy berm at the mouth. It is apparent through photography observation that the dynamics of Back Sound in this area are conducive to the filling of this basin. The mouth shoals regularly and rapidly, and there is no indication that an access channel has ever been excavated into Back Sound. Back Sound in this area is scattered with beds of seagrass, and would probably not lend itself to regulatory approval for excavation. Therefore, conditions causing the shoaling will probably remain unchanged. There is no indication of public use of this basin. Because of the uselessness of the basin, and the danger it represents for the children of the applicant, the applicant wishes to fill the basin. The proposal is to close the mouth of the basin through the placement of riprap. The structure will be approximately 75' in length, 8' -10' in width, and 4' in elevation. The proposal is then to place approximately 2000 cubic yards of fill material landward of the riprap to fill the basin to existing ground elevation. 10. ANTICIPATED IMPC_T_S: Filling of this basin would cause the loss of approximately 2120 square feet of S artina to or 800 square feet of Spartina atens mixed with Iva frutescens 600 square feet of S arti a alterniflora mixed with Juncus roemerianus, and 950 square feet of Spartina ate s mixed with Bo 'c is frutescens. Additionally, 18,750 square feet of shallow bottom area within ponded estuarine waters would become high ground. Any productivity of the system through irregular interaction with Back Sound would be lost. The higher wetland species occurring on the escarpment to the east of the basin should not be impacted by the proposal, as the request is to fill to adjacent existing ground elevations. Filling of the basin would eliminate a safety risk, and the health and vector concerns associated with a stagnant body of water. Public Trust rights would not be effected by the proposal. Part d. 1122 Island Road Harkers Island The purpose of this request is to fill in a man-made boat basin. Due to lack of maintenance, adjacent high ground erosion has filled the basin to an average depth of -1.5 feet below MLW of the basin. The mouth of the basin is completely filled with sand. If the mouth were open the basin would completely drain at low tide because most of the bottom of basin is above the MLW of the Back Sound. Storm tides continue to cause erosion around the interior perimeter of the basin. The method of construction will be to form a rock bulkhead across the mouth of the basin (length 75 feet) and fill the basin to the surrounding ground level (2 to 3 feet above MHW of Back Sound). NARRATIVE DESCRIPTION: The project site is a 1.1 acre residential tract located on the south side of Harker's Island, adjacent to Back Sound. The street address is 1122 Island Rd. in Carteret County. The property averages +1' to +6' above mean high water in elevation, and is vegetated predominantly with typical landscape grasses. There is a residence existing on the property which is serviced by a septic tank and community water. The Carteret County Land Use Plan classifies this area as Limited Transition, with all CAMA Areas of Environmental Concern classified as Conservation. The waters of Back Sound are classified SA-ORW by the Division of Water Quality. The area is open to the taking of shellfish for consumption, and is not designated Primary Nursery by the Division of Marine Fisheries. While there is no evidence of seagrass within the basin, Back Sound is scattered with seagrass beds. There is no evidence of shellfish within the basin. There is a ±250' x 75' basin on the south side of the property which was excavated prior to the LAMA. State Permit #70-79 was issued to John S. Blanton, Jr. on 6/04/79 for maintenance excavation of the southernmost portion of the basin, installing a bulkhead 50' from the landward end, and filling behind the bulkhead. Because of the objections and permit denials from other agencies, Mr. Blanton had the permit modified on 9/26/79 to eliminate the bulkhead and all fill below mean high water. On 12/04/87, Mr. Blanton was again issued a permit, #234-87 for the maintenance excavation of the basin. The landward or north end of the basin is vegetated with Iva frutescens and S artina patens (±800 sf), transitioning to Spartina alterniflora with Juncus roemerianus (±600 sf) as one moves southward into the pond. There is a ±3' fringe of S artina alterniflora around the majority of the perimeter of the basin (±1200 sf), with three larger populations (±160 sf, 360 sf, 400 sf) within the basin. On the west side of the basin there is a 4' fringe of mixed Borrichia frutescens and Spartina patens landward of the Spartina alterniflora (±800 sf). On the east side, the Spartina alterniflora terminates at the escarpment, and the area is vegetated with S artina patens, Myrica cerifera and Smilax sue., dropping to a healthy expanse of high and low marsh on the adjacent property. This higher area of wetland species on the east side was probably formed with the spoils of the original basin excavation. There is a ±150 sf area of mixed SSpartina patens and Borrichia frutescens near the mouth of the basin. The average current depth in the basin is -1' to -15 at mean low water. The basin stays filled at all tides due to a blockage at the mouth. The applicant states that there is approximately F in tidal flux in the basin, due apparently to a subsurface "pushing" effect of the ±25 tidal flux within Back Sound. There is no interaction between Back Sound and the basin except during extreme tides. The substrate is very silty, with a sandy berm at the mouth. It is apparent through photography observation that the dynamics of Back Sound in this area are conducive to the filling of this basin. The mouth shoals regularly and rapidly, and there is no indication that an access channel has ever been excavated into Back Sound. Back Sound in this area is scattered with beds of seagrass, and would probably not lend itself to regulatory approval for excavation. Therefore, conditions causing the shoaling will probably remain unchanged. There is no indication of public use of this basin. Because of the uselessness of the basin, and the danger it represents for the children of the applicant, the applicant wishes to fill the basin. The proposal is to close the mouth of the basin through the placement of riprap. The structure will be approximately 75' in length, 8' -10' in width, and 4' in elevation. The proposal is then to place approximately 2000 cubic yards of fill material landward of the riprap to fill the basin to existing ground elevation. 10. ANTICIPATED IMPACTS: Filling of this basin would cause the loss of approximately 2120 square feet of Spartina alterniflora, 800 square feet of Spartina patens mixed with Iva frutescens, 600 square feet of S artina alterniflora mixed with Juncus roemerianus, and 950 square feet of Spartina patens mixed with Borrichia frutescens. Additionally, 18,750 square feet of shallow bottom area within ponded estuarine waters would become high ground. Any productivity of the system through irregular interaction with Back Sound would be lost. The higher wetland species occurring on the escarpment to the east of the basin should not be impacted by the proposal, as the request is to fill to adjacent existing ground elevations. Filling of the basin would eliminate a safety risk, and the health and vector concerns associated with a stagnant body of water. Public Trust rights would not be effected by the proposal. The mouth of the basin is completely filled with sand. If the mouth were open the basin would completely drain at low tide because most of the bottom of basin is above the MLW of the Back Sound. Storm tides continue to cause erosion around the interior perimeter of the basin. The method of construction will be to form a rock bulkhead across the mouth of the basin (length 75 feet) and fill the basin to the surrounding ground level (2 to 3 feet above MHW of Back Sound).
