Mandolin Place PO Box 3122 Wilmington NC 28406 Dear Mr. Blanton: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in an additional 0.62 acres of wetlands (total of 1.24 acres of fill) for the purpose of developing a residential subdivision in New Hanover County, as you described in your application dated March 3, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this G,ilification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. The applicant shall contact Ms. Linda Lewis of the DWQ Wilmington Regional Office for stormwater requirements. An innovative stormwater design shall be considered whereby the natural wetlands could be used for stormwater management in lieu of a pond. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0500, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). According to 15A NCAC 2H .0506(h), 155 feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DENR - Wetland Restoration Program), wetland or stream fill shall not occur. Mr. Ron Ferrell should be contacted at 919-733-5083 ext. 358 if you have any questions concerning the Wetland Restoration Program. You have one month from the date of this Certification to make this payment. For accounting purposes, this Certification authorizes the additional fill of 0.62 acres of non-riparian wetlands in 030617 river and subbasin and 0.62 acres of non-riparian restoration are required. Since our meeting, I have received approval from the Corps of Engineers of our map of the remaining wetlands and I am in the process of removing the fill material that had been placed in wetlands when the New Hanover County sewer system was extended to my project. This area is 3013 Sq. Ft. and when added to the 8618 Sq. Ft. that had been left undisturbed, there will be a total of 11,631 Sq. Ft. of wetlands preserved on my project. This results in a total area of wetlands disturbed of 54,144 Sq. Ft. or 1.24 Acres. In accordance with our discussion on February 26th, I am enclosing an application for the approval of a total of 1.24 Acres of wetland disturbance for this project. This disturbance was made necessary because of unforeseen changes in my project such as the requirement from New Hanover County that I provide a connector street through my project to the development to the south. I understand that mitigation for the additional wetland disturbance beyond the approved in my Permit in 1996 will be required and that I will be able to pay into the Wetland Restoration Program at an amount of $12,000 per acre to satisfy that requirement. Since the original area was 0.62 acres and final area is 1.24 acres, I am prepared to transmit my check in the amount of $7,444 (1.24 - 0.62 = 0.62; 0.62 x $12,000 = $7,440). The conditions of this permit required that you fill only the 0.62 acres and that you use an innovative stormwater design whereby stormwater would be routed to wetland areas. On January 14, 1997 Mr. Pete Colwell form the North Carolina Division of Water Quality's (NCDWQ) Central office and Ms. JoAnne Steenhuis fmm NCDWQ's Wilmington Regional Office conducted a compliance evaluation inspection at this project. Accompanying NCDWQ staff on site was Mr. Keith Genens. As a result of this inspection, Mr. Genens noted that the 0.74 acres of wetlands that were supposed to be preserved at the end of the cul- de-sac were now being filled for a clubhouse and pool. This fact was evidenced by the presence of large piles of fill in these wetlands. It also appears that the 0.15 acre of wetlands to be preserved on the north side of the property may have also been filled. Your April 2, 1996 401 Water Quality Certification does not give you authorization to impact this additional 0.74 acres. You are hereby requested to CEASE AND DESIST any further work in this area. Failure to do so r,:ay result in an enforcement action being pursued against you by one or more of the following agencies: U.S. Army Corps of Engineers (USACOE), NCDWQ, and the U.S. EPA. In addition, it was noted that the project plan might have been altered from the original plan submitted to NCDWQ on March 28, 1996. As is required by your 401 Water Quality Certification: "If you change your project, you must notify us and you may be required to send us a new application". Please respond to this letter within 14 days upon your receipt.
