Director Division of Water Quality January 27, 2006 DWQ# 06-0043 Randolph County CERTIFIED MAIL: 7003 3110 0003 6489 8254 RETURN RECEIPT REQUESTED Mr. Wyatt Brown North Carolina Ecosystem Enhancement Program 1652 Mail Service Center Raleigh NC, 27699-1652 Requirement for Written Authorization for 401 Water Quality Certification Dear Mr. Brown: On January 5, 2006, the North Carolina Division of Water Quality (DWQ) received the North Carolina Ecosystem Enhancement Program's (NC EEP) application for a Section 401 General Water Quality Certification to impact 2,628 linear feet of two unnamed perennial tributaries to Jackson Creek located on an 87-acre parcel of land (Briles Site) located southeast of the intersection of Ross Wood Road and Pleasant Grove Road in Trinity, Randolph County. This impact will be required in order to construct a comprehensive restoration of the two streams and their associated woody corridors. Since the proposed activity is subject to Section 404 of the Clean Water Act (33 U.S.C. 1344), NC EEP must also receive a Section 401 Water Quality Certification from the N. C. Division of Water Quality before beginning any work. For the impacts proposed in your application, the appropriate Section, 401 Water Quality Certification is General Certification WQC #3495. Per the requirements of WQC #3495 (Item 1 in Conditions of Certification), DWQ has reviewed your application and determined that written authorization to use this Certification for the proposed project will be required. Pursuant to issuing written authorization, Mr. Daryl Lamb of the Winston-Salem Regional Office of DWQ will contact you shortly to schedule a date and time for a site visit to the project location. The purpose of this visit will be to conduct a field review of the proposed impacts to ensure compliance with the requirements of WQC #3495.
