The site is approximately 140 acres in size and is located on the north side of SR 1152 (Holly Springs
Road), approximately 3000 feet east of the intersection of SR 1 152 and SR 1393 (Bass Lake Road) in
Holly Springs, Wake County, North Carolina. The site is adjacent to an unnamed tributary of Middle
Creek, above headwaters, in the Ncuse River Basin.
Description of Activity: This permit authorizes mechanized landclearing, excavation, the installation of
pipes, and the placement of fill associated with the construction of Sunset Ridge North subdivision.
Impacts to wetlands and waters authorized by this permit include 0.01 acre for one utility line crossing
under NWP 12 (AID 199820980), 0.033 acre and 5 feet of channel (bank-to-bank width) for one road
crossing under NWP 14 (AID 199821 347), and 0.045 acre of wetland and channel impacts for lot till
under N W t 26 (i'UD 19982 i 348). impacts to wetlands and waters total 0.088 acre. With previously
permitted impacts (All) 199700252), subdivision impacts (toward NWP 26 maximum) total 0.238 acre.

You have our approval to place fill material in 0.15 acres of wetlands or waters for the purpose of
constructing road crossings and fill for one lot at Sunset Ridge North subdivision, as you described in your
application dated 23 December 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 211 .0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification. In addition, you should get any other federal, state
or local permits before you go ahead with your project. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General. Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The purpose of this letter is to request a permit revision to include ad&ffltt?! for
Sunset Ridge (Action ID # 199101711, DEM Projects 95087 and 95039). Additional impacts
for additional land purchased (Sunset Ridge North) will need to be covered by
Nationwide Permit 26 and a revised Section 401 Water Quality Certification. The original
permits were for a golf course and two different developments (each owned by a different
entity), but for regulatory purposes they were considered one project. The project is
located near Holly Springs, NC (Wake County) and is bordered by SR 1152 and Holly
Springs Road (as shown on the enclosed plans) and Apex, NC USGS Topo Quad vicinity
map.
Our firm has performed the detailed wetland delineation shown on the attached impact
map. The delineation has been approved by Mr. Eric Alsmever of the US Army Corps of
Engineers.
Impacts to wetlands will be required to construct three additional road crossings under
Nationwide 26. This new construction will impact 0.15 acres of additional wetlands.
Previously, a total of 2.99 acres was authorized, under Nationwide 26, for the entire
development (including residential and golf course areas). If approved, total impacts
under Nationwide 26 for the project will amount to 3.14 acres.

permits were for a golf course and two different developments (each owned by a different
entity), but for regulatory purposes they were considered one project. The project is
located near Holly Springs, NC (Wake County) and is bordered by SR 1152 and Holly
Springs Road (as shown on the enclosed plans) and Apex, NC USGS Topo Quad vicinity
map.
Our firm has performed the detailed wetland delineation shown on the attached impact
map. The delineation has been approved by Mr. Eric Alsmeyer of the US Army Corps of
Engineers.
Impacts to wetlands will be required to construct three additional road crossings under
Nationwide 26. This new construction will impact 0.15 acres of additional wetlands.
Previously, a total of 2.99 acres was authorized, under Nationwide 26, for the entire
development (including residential and golf course areas). If approved, total impacts
under Nationwide 26 for the project will amount to 3.14 acres.

The purpose of this memo is to comply with the conditions of our 401
(copy attached) requiring us to notify you of plan changes and to advise
you of our clients' intention to revise the previously approved impact by
crossing in a somewhat more perpendicular fashion. Previously the
impact was to 148 linear feet of stream (0.17 acres), the current plan
impacts 142 linear feet of stream (0.016 acres). (See attached "previous"
vs. "current" plan.) In addition a separate utility line was permitted
which now falls within the road crossing foot print further reducing
impacts to streams and buffers.
Based on a meeting with the Corps, it is my understanding that this
change is allowed without requiring another PCN or mandatory
processing period. Therefore unless we are advised to the contrary our
client plans to move forward with the revised construction plan.

The placement of the Road crossing is an issue with the RRO. If the road crossing is shifted to

the right (see attached map) the impacts to the stream can be reduced. This should be required as
the primary approach and then mitigation be required.
Recommendation:
If they demonstrated the Road must be at proposed location or after reducing impacts they
continue to exceed 150' stream impacts mitigation should be required.

Stream observations - The stream is incised 5- 8 feet and is 3- 6 feet in width. It has a closed
overstory canopy of trees, and as shown on the map the sinuosity is moderately high. The
stream is characterized by discrete riffle and pool habitats. Further, the habitat observed in the
floor of the stream channel included abundant rocks (2-10"), sandy bottoms in pools, and leafbei
accumulations. The fauna observed during quick inspection efforts included the following: fish
( creek cubs, notropis like fish - couldn't catch (saw 50 - 100 fish along the proposed road
crossing), crayfish, damselfly larva, two-lined salamander.

The Division of Water Quality has reviewed your plans for the discharge of fill material into an additional 0.09
acres of wetlands and 287 feet of streams located at Sunset Ridge North subdivision in Wake County for road and utility
construction. Based on this review, we have identified significant uses, which would be removed or degraded by this
project. These uses are aquatic life uses in the stream shift. Furthermore, insufficient evidence is present in our files to
conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506.
Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of
your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we
receive this additional information once we receive this information, our processing time will start. Until we receive
additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineer:; place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be constructed as
planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you
construct your road crossing at the north end of the property to reduce stream and buffer impact? Any documentation
such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our
review of your 401 Certification. Also this project will require compensatory mitigation for the impact to 287 feet of
perennial channel as described in 15A NCAC 2H .0506(h). Your mitigation proposal is insufficient because none was
proposed.
Please respond within three weeks of the date of this letter by sending a copy of this information to me and one
copy to Mr. Danny Smith Raleigh Regional Office at 3800 Barrett Drive Raleigh NC 27609. If we do not hear from
you in two weeks, we will assume that you no longer want to pursue this project and we will consider the project as

Due to comments listed within the N.C. Division of Water Quality response letter dated 10/26/98, the
responsible parties of the Sunset Ridge North Subdivision have revised their original site plan in an effort
to reduce the amount of degradation to the aquatic functions of the proposed impacted creek. Please
notice that the total linear feet of impact caused by the road crossing was reduced from the original
proposed 287 feet to only 148 feet. This was accomplished by shifting the road crossing to the north to a
location of the creek that contains less meanders. Please ponsider this PCN a revision to the original PCN
dated 9/16/98. Due to the time constraints brought upon my clients, we would appreciate a speedy review

The purpose of this letter is to request a permit revision to include additional impacts for Sunset Ridge
North Subdivision (DWQ ID # 961175, Corps Action ID # 199700252). Previously permitted impacts
total 0.15 acres of wetlands under Nationwide Permit 26. Additional proposed impacts, totaling 0.075
acres and 148 linear feet of wetlands and waters, will need to be covered under Nationwide Permits 12, 14
and 26. The project is located on the north side of SR 1152 approximately 0.8 miles east of its
intersection with SR 1393 near the Town of Holly Springs, Wake County, North Carolina (see vicinity
map). The proposed activity will comply with all the general conditions stated within Nationwide Permits
12, 14 & 26. The project will comply (with proposed exemptions) to all the regulations imposed under the
Neuse River Buffer rules (15A NCAC 2B .0233).

The Division of Water Quality has reviewed your plans for the discharge of till material into an additional 0.09
acres of wetlands and 287 feet of streams located at Sunset Ridge North subdivision in Wake County for road and utility
construction. Based on this review, we have identified significant uses, which would be removed or degraded by this
project. These uses are aquatic life uses in the stream shift. Furthermore, insufficient evidence is present in our riles to
conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 211 .0506.
Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of
your 401 Certification as required by 15A NCAC 211 .0507(e) and will place this project on hold as incomplete until we
receive this additional information once we receive this information, our processing time will start. Until we receive
additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Eingineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be constructed as
planned and that you have no practicable alternative to placing till in these waters and/or wetlands. Specifically can you
construct your road crossing at the north end of the property to reduce stream and buffer impact? Any documentation
such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our
review of your 401 Certification. Also this project will require compensatory mitigation for the impact to 287 feet of
perennial channel as described in 15A NCAC 211 0506(h). Your mitigation proposal is insufficient because none was
proposed.
Please respond within three weeks of the date of this letter by sending a copy of this information to me and one

You have our approval to place fill material in 0.15 acres of wetlands or waters for the purpose of
constructing road crossings and fill for one lot at Sunset Ridge North subdivision, as you described in your
application dated 23 December 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 211 .0506 (h) (6) and (7). For this approval to he valid, you must
follow the conditions listed in the attached certification. In addition, you should get any other federal, state
or local permits before you go ahead with your project. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification-
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory

The purpose of this letter is to request a permit revision to include additional impacts for Sunset
Ridge North Subdivision (DWQ ID # 961175, Corps Action ID # 199700252). Previously permitted
impacts total 0.15 acres of wetlands under Nationwide Permit 26. Additional proposed impacts,
totaling 0.088 acres and 287 linear feet of wetlands and waters, will need to be covered under
Nationwide Permits 12, 14 and 26. The project is located on the north side of SR 1152
approximately 0.8 miles east of its intersection with SR 1393 near the Town of Holly Springs,
Wake County, North Carolina (see vicinity map). The proposed activity will comply with all the
general conditions stated within Nationwide Permits 12, 14 & 26. The project will comply (with
proposed exemptions) to all the regulations imposed under the Neuse River Buffer rules (15A
NCAC 2B.0233).
Our firm has performed the detailed wetland delineation shown on the attached map. The
delineation was approved by Mr. Eric Alsmeyer of the US Army Corps of Engineers.
Included are the completed PCN form, agent authorization form, site vicinity map, construction
plan, justification letter from the Town of Holly Springs, previously approved 401 and 404 permits
and wetland delineation forms.

The proposed work includes impacts to wetlands and waters for the purpose of
constructing a residential subdivision and recreational area. Nationwide Permit 12
will be used for the installation of a sanitary sewer line (Area "A" on the attached
site plan), Nationwide Permit 14 will be used for the installation of a required access
road (Area "B"; includes the road bed and fill from side slopes), and Nationwide
Permit 26 will be used for lot fill required for the construction of the recreational
area, home lot and the sewer line located within the side slope fill area for the road
crossing depicted in Area "B" (Area "C" and Area "B").

(1) Wetland impacts proposed for the recreational site will result from side slopes
resulting from grading activities required for the construction of a necessary
parking area.
(2) Wetland impacts proposed for Lot # 308 are required to create a buildable lot.
(3) Wetland impacts proposed for the sanitary sewer line crossings (Area "A" & "B")
are required for connecting to existing lines. The sewer line crossing depicted in
Area "B" was located within the required side slopes of the road crossing in an
effort to limit impacts to other portions of the channel.
(4) Wetland & channel impacts are necessary for the construction of the road
required by the Town of Holly Springs (see attached letter from the Town
Engineer).

Dear Mr. Martin:
You have our approval to place fill material in 0.15 acres of wetlands or waters for the purpose of
constricting road crossings and fill for one lot at Sunset Ridge North subdivision, as you described in your
application dated 23 December 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification. In addition, you should get any other federal, state
or local permits before you go ahead with your project. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its
conditions are final and binding unless you ask for a hearing.

Due to comments listed within the N.C. Division of Water Quality response letter dated 10/26/98, the
responsible parties of the Sunset Ridge North Subdivision have revised their original site plan in an effort
I to reduce the amount of degradation to the aquatic functions of the proposed impacted creek Please
>.. notice that the total linear feet of impact caused by the road crossing was reduced from the original
proposed 287 feet to only 148 feet. This was accomplished by shifting the road crossing to the north to a
location of the creek that contains less meanders. - Please consider this PCN a revision to the original PCN
dated 9/16/98. Due to the time constraints brought upon my clients, we would appreciate a speedy review
of this revised plan.
The purpose of this letter is to request a permit revision to include additional impacts for Sunset Ridge
North Subdivision (DWQ ID # 961175, Corps Action ID # 199700252). Previously permitted impacts
total 0.15 acres of wetlands under Nationwide Permit 26. Additional proposed impacts, totaling 0.075
acres and 148 linear feet of wetlands and waters, will need to be covered under Nationwide Permits 12, 14
and 26. The project is located on the north side of SR 1152 approximately 0.8 miles east of its
intersection with SR 1393 near the Town of Holly Springs, Wake County, North Carolina (see vicinity
map). The proposed activity will comply with all the general conditions stated within Nationwide Permits
12, 14 & 26. The project will comply (with proposed exemptions) to all the regulations imposed under the
Neuse River Buffer rules (15A NCAC 2B .0233).
Our firm has performed the detailed wetland delineation shown on the attached map. The delineation was
approved by Mr. Eric Alsmeyer of the US Army Corps of Engineers.
Included are the completed PCN form, agent authorization form, site vicinity map, construction plan,
justification letter from the Town of Holly Springs, previously approved 401 and 404 permits, wetland
delineation forms, DWQ letter dated 10/26/98, and 401 Certification dated 10/15/98 (Action ID #
199820980/199821347/199821348).

The Division of Water Quality has reviewed your plans for the discharge of till material into an additional 0.09
acres of wetlands and 287 feet of streams locoed at Sunset Ridge North subdivision in Wake County for road and utility
construction. Based on this review, we have identified significant uses, which would be removed or degraded by this
project. These uses are aquatic life uses in the stream shift. Furthermore, insufficient evidence is present in our files to
conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 211 .0506.
Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of
your 401 Certification as required by 15A NCAC 211 .0507(e) and will place this project on hold as incomplete until we
receive this additional information once we receive this information, our processing time will start. Until we receive
additional information, we are requesting (by copy of this letter) that the U.S. Anny Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be constructed as
planned and that you have no practicable alternative to placing till in these waters and/or wetlands. Specifically can you
construct your road crossing at the north end of the property to reduce stream and butter impact'? Any documentation
such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our
review of your 401 Certification. Also this project will require compensatory mitigation for the impact to 287 feet of
perennial channel as described in 15A NCAC 211 .0506(h). Your mitigation proposal is insufficient because none was
proposed.
Please respond within three weeks of the date of this letter by sending a copy of this information to me and one

covered by General Water Quality Certification Numbers 3101, 3103 and 3108. These certifications allow you to use Nationwide
Permit Numbers 12, 14 and 26 when the Corps of Engineers issues them. This approval is also valid for the Neuse River buffer
rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands
and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for
future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this
letter or the issuance of the 404 Permit (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.

The purpose of this letter is to revise it previously submitted request for Sunset Ridge
(Action ID # 199101711, DEM Projects 95087 and 95039), The Corps, after considering
additional information provided by S&EC, has decided that the Sunset Ridge North
project is separate from Sunset Ridge. Additional impacts for additional land purchased
(Sunset Ridge North) will still need to be covered by Nationwide Permit 26 and a Section
401 Water Quality Certification. The project is located near Holly Springs, NC (Wake
County) and is bordered by SR 1152 and Hoily Springs Road (as shown on the previously
submitted plaits) and Apex, NC USGS Topo Quad vicinity map,
impacts to wetlands wlll be fequired to construct three road crossings and one lot impact
under Nationwide 26. This construction wi11 impact 0.15 acres of jurisdictional waters.
Therefore, due to the size of impacts, notification of our client's proposed impacts is not
required, but we would still appreciate written confirmation from you both.
