Anderson, pie ant Regional Coordinator Habitat Conservation Program DATE: April 9, 1997 SUBJECT': Shannon Lee Lindley Request for 401 Water Quality Certification to fill wetlands in Lake Tillery, Stanly County, North Carolina. DWQ III # 970225. Staff biologists with the North Carolina Wildlife Resources Commission have reviewed the subject application with respect to anticipated project impacm on aquatic habitats. The site was inspected on April 4, 1997. Our comments are provided in accordance with certain provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), and sectiou 401(b) of the Clean Water Act of 1977 (as amendcd), and North Carolina General Statutes (G.S. 113-131 et seq.). According to the application, the reasons that the activity must be carried out in wetlands is to build a wooden "sea wall" on leasable land "for neatness and to tie a boat to sometimes". The proposed work involves excavation and impacts to 0.5 acres of wetlands, according to the application. The applicant offered no mitigation for wetland losses. The project site is located on Cedar Creek at the intersection of Indian Mound Road and Lake Shorc Drive north of Norwood, N. C. The site, which is in the mouth of Cedar Creek, forms as-mall cove of Lake Tillery. '11ie mouth of Cedar Creek is characterized by shallow water mid high quality, forested wetlands with alder, sycamore, willows, sweet gum and other trees. Lake Tillery, a 5,300 acre public roservoit operated by Carolina Power and Light Company under Federal Energy Regulatory Commission License, provides excellent fishing for largemouth bass, crappie, cal5sh, sunfish and other species. Shallow waters are important spawning areas for various fish species, as well as feeding and resting areas for other wildlife. Upon inspection of the site by boat, biological personnel found that an 80-foot wooden wall already had been constructed at the site, The construction appeared to have occurred very recently based on the presence of fresh straw on the backfill behind the wall. The project site is residential with several houses and a grassy area extending to the creek bank. Forested wetlands occur on both sides of Cedar Creek adjacent to the grassed area. Several goats were grazing on the property. One goat was tied and grazing on undergrowth along the creek bank approximately 100 feet downstream from the project site. We probably would have recommended denial of this permit. However, since the work has already been done it was not possible to evaluate the site. We have the following recommendations concerning this project application: 1. DWQ and CP&L personnel should investigate to determine if violations have occurred and take appropriate action. 2. Prohibit the construction of additional wooden walls and other structures in wetlands at this site. We, discourage the use of concrete or wooden "sea walls" because the devices provide poor fish habitat. 3. Retain or reestablish a natural vegetated buffer beside Cedar Creek and Lake Tillery on the project site. Efforts should be made to retain as many trees and other vegetation as possible within this buffer. Natural buffers help protect water quality and replace sonic functions lost from impacted wetland areas. 4. Place deed restrictions on the property to prohibit any future wetland impacts by current or future owners. 5. Prohibit grazing by goats and other livestock within the buffer zone slid prohibit grazing in all wetland areas. 6. Disturbed wetland areas should be allowed to revert to natural wetland vegetation. 7. Require the applicant to place riprap along the front of the wall to help mitigate for lost fish habitat. The riprap should be installed along the toe of the wall. I D EHNR April 10, 1997 Stanly County WQC 401 Project #970225 You have our approval, in accordance with the attached conditions, to place fill material in 0.5 acres of wetlands or waters for the purpose of stabilizing the shoreline at your lot on Cedar Creek, as you described in your application dated 10 March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3102. This Certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
