Dear Mr. Baker:
The Division of Water Quality has reviewed your plans for the discharge of fill material
into 5.0 acres of waters and/or wetlands located at SR 1336 in Perquimans County for
commercial fill. Based on this review, we have identified significant uses which would be
removed by this project. These uses are water storage and wildlife habitat. This project will
require compensatory mitigation as described in 15A NCAC 2H.0506(h). Your mitigation
proposal is insufficient because none is proposed. Therefore, we are moving toward denial of
your 401 Certification as required by 15A NCAC 2H .0507(e). Until we receive additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers
and/or the N.C. Division of Coastal Management place your project on administrative hold.
Please respond within two weeks of the date of this letter by sending a copy of this
information to me and one copy to Ms. Deborah Sawyer at the Washington Regional Office at
1424 Carolina Avenue, Washington, NC 27889. If we do not hear from you in two weeks,
we will assume that you no longer want to pursue this project and we will consider the project

Dear Mr. Baker:
The Division of Water Quality has reviewed your plans for the discharge of fill material
into 5.0 acres of waters and/or wetlands located at SR 1336 in Perquimans County for
commercial fill. Authorization for 2.0 acres was approved on 28 October 1996. The current
application is for an additional 3.0 acres. The map showing the wetland impacts is identical as
the 4 September 1996 approval. We believe this to be an error and will need to be corrected
should you wish to receive approval for the additional 3.0 acres. You met with DWQ staff
members Mr. Eric Galamb, Ms. Deborah Sawyer and Mr. Bill Moore on 13 March 1997. We
have carefully reviewed your application and believe that 3.0 acres of created or restored
wetlands will need to be proposed prior to impacting the additional 3.0 acres. You verbally
stated to Mr. Eric Galamb that you wish to continue to have your project remain on hold while
you explore your mitigation options. Please call Mr. Galamb at 919-733-1786 if you would
like additional information regarding compensatory mitigation. Until we receive additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers
place your project on administrative hold.

Various 401 Certification Projects
In light of the need for SEPA review and documentation for the Buckhead Creek
project in Fayetteville, we have reviewed our existing files for pending Certifications to
locate any projects'which may need SEPA documents before a 401 Certificaiton can be
issued. Please advise whether any of these projects will require SEPA review. If so, I
will write them to place them on hold and to contact you. In the future, we will send any
similar projects to you as soon as possible for a prompt decision for the SEPA process.

There are several soil types on this tract, but they can be grouped into two
categories for land planning. The yellow highlighted area on the attached map
indicates one category. The soils in this category will require both surface and
especially subsurface drainage systems. The ditches in this area are providing
both surface and subsurface drainage at rates for agricultural use. These
ditches can be moved or eliminated to accommodate the site requirements for
development provided that alternative drainage systems are installed that drain
at rates necessary for urban development. The drainage outlets in this section
(#3 & #4) are adequate and should be used as the principle drainage outlets.
The second category (non-highlighted areas) are soil types that will not require
subsurface drainage; however, surface drainage is very important. Drainage
problems can be created in these soils if the development is not properly graded
and shaped to eliminate surface water ponding. The drainage outlets in this
section (#1 & #2) will require some modification to reduce the threat to the
water quality in the Perquimans River, and to prevent severe erosion problems.
Much of the drainage area that is now outletting into drainage outlet #2 should
be diverted to drainage outlet #3. This will reduce the degree of sedimentation
and nutrient load that will impact the Perquimans River.

filter storm water flow and treat water trapped by the sediment basins.
Surface water generated by development should be routed away from drainage
outlet #1. Serious erosion and water quality problems will occur if additional
surface water from development is drained through this area.

A storm water and sedimentation/erosion control plan will be required by
Division of Environmental Management (DEM). It should be noted that a storm
water control plan that meets the NC Sedimentation and Erosion Control
requirements will not meet the drainage requirements for development. A storm
water control plan is designed for maintaining storm water on the property, not
for drainage.

Dear Mr. Baker.

constructmga commercial development at'SR' 1336 near US 17, as you described in your application dated 4
September 1996. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. Stormwater management for this property must be done to satisfy
the requirements of the Coastal Stormwater Program.. Mr. William Moore of our Washington Reginal Office
shall be contacted before land clearing begins. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

It has been the pleasure of the Perquimans Soil & Water
Conservation District & the USDA Natural Resources
Conservation Service to provide Perquimans County and the
Economic Development Commission engineering, soils, and
surveying assistance for the development for the Perquimans
Commerce Centre (Centre). Hopefully, our assistance has
saved Perquimans County a considerable amount of time and
money.
Our goal is to improve the water quality within the
Albemarle Area. Technical assistance was provided to the
County for this project with this goal in mind.
The Perquimans Soil & Water Conservation District would like
to put forth a proposal to the Perquimans County
Commissioners and the Economic Development Commission. We
would like to incorporate an experimental approach for
improving water quality into the overall drainage plan for
this project. The thrust of this proposal will be the
retention and filtration of drainage water leaving the
Centre, utilizing constructed wetlands to polish or filter
the drainage water before it enters the Perquimans River.
To achieve this goal the District staff would design and
supervise the installation of the constructed wetland
filtration systems. These systems would compliment the
total drainage system for this site. The overall drainage
system will have to be designed by a consulting engineering
firm. The District does not have the manpower to design and
supervise the installation of a system of this magnitude,
and continue our program activities within the County. The
District can work in a limited capacity, acting as a
consultant for the County, advising the design engineers and
contractors of the system design needed for ground water and
surface water removal.

given to this endeavor. This project can serve as a
demonstration of the County's commitment to economic
development and environmental concerns.

The wetland determination requested for the Perquimans
County Commerce Centre has been completed. The review
conducted by Henry Wicker, representative for the US Army
Corps of Engineers (COE), on January 14 serves as an
official endorsement of the wetland delineation for this
tract. I am forwarding a copy of this letter along with the
wetland delineation maps, drainage calculations, and
hydraulic conductivity measurements to Mr. Wicker. When I
receive an official written concurrence from Mr Wicker the
wetland delineation maps will be recognized as an official
document for meeting the provisions of the Clean Water Act
and the USDA-Farm Bill.
To meet the provisions of the 1995 Farm Bill, Perquimans
County must be granted a Converted Wetland Nonagricultural
Use (CWNA) classification for all wetlands within this tract
permitted for development by the US Army Corps of Engineers
(COE). The COE has permitted five acres anywhere within
this tract to be utilized for development; therefore, a CWNA
for five acres will be required.
The USDA policy generally requires the landowner to submit
a written plan stating the intended land use within the area
of the CWNA . The purpose of this plan is to insure that
the landowner does not bring the CWNA land into farm
d3tctten after receiving permission to #.egate ?SDA
farm programs. In this case a writt an will not be
required. Based on our participation in this project, it is
obvious that the intent of the Perquimans County
Commissioners is to develop this land into an industrial
park and there will be no land cleared and used for
additional farmland. As a result, this letter will serve as
notice that this land cannot be converted to farmland once
cleared without jeopardizing the County's privilege for
receiving any future USDA farm program benefits, or Rural
Development funds for sewer, water, and other economic
development.
We are required by USDA policy to send notice of this CWNA
to the US Fish & Wildlife Service for their comment. This
letter will be sent with a copy of the map. We will hold
our official determination pending a 30 day comment period
granted the USFWS.
When I receive comments from the USFWS, and concurrence from
the COE, this determination will be submitted to the
USDA-Farm Services Agency for final processing.
