PROJECT SUMMARY: The applicant is proposing an expansion of the existing public boat ramp access facility, including the construction of a new boat ramp, additional parking and two new docks replacing an existing dock. PROJECT DESCRIPTION: Bald Head Island is part of an island group known as Smith Island, located at the confluence of the Cape Fear River and Atlantic Ocean between Fort Fisher and Oak Island/Caswell Beach. The island is . accessed by private boat or a private ferry service from Southport. The project site is located on three lots on North Bald Head Wynd- Lots 105, 107 and 109. To find the project site from the Bald Head Island Marina, head south and turn onto North Bald Head Wynd. Travel approximately 1/4 mile to the Bald Head Island public access site, located on the left. The project site is adjacent to residential properties and Bald Head Creek. There is a single-family residence located on Lot 105, owned by Doug Oakley, the joint applicant. A shared pier is currently located on the property line between Lots 105 and 107, leading to a 2-slip floating dock measuring approximately 44' in length by 10' in width. There are no other man-made structures currently located on Lot 107. Lots 107 & 109 are owned by the Village of Bald Head Island. There is an existing boat ramp located on Lot 109 along with associated parking, canoe/kayak racks on high ground and a covered gazebo. A pier with three slip floating dock is located on the lot to the east of the boat ramp. The floating dock measures approximately 60' in length by 8' in width. Both piers and the boat ramp were authorized under State Permit 4151-84, which was issued to Bald Head Island Limited on July 3, 1984. State Permit #151-84 first'authorized construction of 17 temporary use slips and a boat ramp. The permit was later modified numerous times to eventually include a total of 60 boat slips along Bald Head Creek, including the two allocated to the shared dock located between Lots 105 and 107. The permit eventually included a condition that capped the maximum allowable number of slips along the creek at 60, but the Division has authorized the reallocation of permitted slips to different docks. High ground vegetation on the tract consists of Yaupon (Ilex vomitoria), Live Oak (Quercus virginiana), Red Cedar (Juniperus virginiana). High ground vegetation transitions waterward to high marsh species, consisting primarily of Salt Meadow Hay (Spartina patens), Sea Oxeye (Borrichia frutescens), Glasswort (Salicornia spp.) and Sea Lavender (Limonium carolinianum). The high marsh vegetation then transitions to low marsh, or Salt Marsh Cordgrass (Spartina alterniora). Current water depths at the edge of the creek range from 0' to approximately 1' at normal low water (NLW) in the location of the existing docks. Water depths in the location of the proposed docks are similar (see sheet labeled CAMA-2). The proposed site for the excavated boat ramp material is located approximately 1 mile from the project site at 406A N. Bald Head Wynd, which is the island's yard waste facility. The Village of Bald Head Island Land Use Plan classifies the creek area as Conservation and the adjacent upland areas of this project as Medium Density Residential 1 (Lot 107) & Recreational (Lot 109). The waters of the project site are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has NOT designated this area of Bald Head Creek as a Primary Nursery Area and the waters are closed to the harvesting of shellfish. Village of Bald Head Island Creek Access, c/o Chris McCall Page Three PROPOSED PROJECT: The applicant is proposing a new boat ramp, measuring 60' in length by 10' in width, to be located west of the existing boat ramp. The boat ramp would be constructed of concrete slabs poured on high ground and pushed into place. Approximately 1.5' of substrate would be excavated from the proposed ramp area during construction. The excavated material would be transported by truck to an off--site location owned by the Bald Head Association. A letter of authorization has been provided for use of the site. The proposed boat ramp would extend approximately 45' waterward of the NHW line. A 58' long retaining wall would be installed adjacent (and parallel) to the western side of the proposed ramp to stabilize the ramp area. It would be constructed at a height of approximately 2' above the NHW line and would terminate approximately 2' short of the end of the proposed ramp. New marl parking and access roadways would be constructed on high ground which would result in approximately 23.8% impervious surface on the entire tract. Approximately 19.2% of the coastal shoreline AEC would be impervious surface, as proposed. According to the applicant, a state stormwater application was submitted to the Division of Water Quality on 5/13/09. Multiple kayak racks and a picnic area are also proposed on high ground. The project would also include removal of the existing two slip docking facility located on the property line between Lots 105 and 107 and the construction of a 6' wide pier located west of the proposed boat ramp on Lot 109. This proposed pier would measure approximately 57' in length. An access ramp at the end of the pier would then lead onto a floating dock, measuring 22' in length by 10' in width, which would be constructed perpendicular to the pier, as an L-head. A second pier, measuring approximately 30' in length by 4' in width, would be constructed in the center of the shoreline to Lot 105. The pier would also lead via an access ramp onto a floating L-head, measuring 22' in length by 10' in width. Each of the proposed docks would accommodate a single vessel. The landward side of both floating docks would be located at the approximate NLW line. Water depths on the waterward side of the proposed floating docks range from approximately 5" to 1'5" at NLW. 10. ANTICIPATED IMPACTS The proposed boat ramp would result in the excavation & subsequent fill of approximately 574 square feet of coastal wetlands, 15 square feet of high ground and approximately 60 square feet of shallow bottom (approximately 19.7 cubic yards of material would be excavated). The two proposed docking facilities would result in the incorporation of approximately 754 square feet of open water; however, approximately 508 square feet of structure currently incorporating public trust area and estuarine waters would be removed. Approximately 410 square feet of coastal wetlands would be shaded as a result of the construction of the two piers. The two docks would not result in any additional boat slips, as the existing shared dock would be removed and the two existing slips would be split and reallocated so each of the two proposed docks would be able to accommodate a single vessel. The dock on Lot 105 would be located outside of the 15' riparian setbacks. The dock on Lot 109 would cross the western riparian corridor shared with Lot 107, however, this lot is also owned by the applicant and is within the project area. Both docks would meet the 1/4 width rule, and do not appear to extend into the channel, as proposed. The highground work on site would result in the disturbance of approximately 0.5 acres and approximately 0.25 acres of high ground would be filled off site as the result of spoil disposal. Submitted by: Heather Coats Date: October 5, 2009 Office: Wilmington Project Description In accordance with the approved Village of Bald Head Island CAMA Land Use Plan, the Village is working to increase access to its public waters. The existing Creek Access Site is at maximum capacity and does not adequately fulfill the needs of residents or public visitors. Therefore, we are proposing an expansion to the existing Creek Access Site. Due to a proposed boat ramp that will impact coastal wetlands, a CAMA Major permit is required. Currently, the site contains a marl and asphalt roadway and parking area, a single boat ramp, a floating dock, a covered shelter, one kayak rack surrounded by a permanent deck, and several additional kayak racks on approximately 0.6 acres. The proposed expansion will bring the Creek Access Site up to a total of 1.1 acres (approximately 0.5 acres disturbed) and include a second boat ramp, additional floating dock as part of the reallocation of a removed dock, additional marl roadway and parking areas, and additional kayak racks. As part of this submittal, an existing shared dock will be removed and reallocated between the Creek Access Site and Lot 105 as shown on the plan. Stormwater Treatment The impervious areas on the existing site currently sheet flow to surrounding vegetated areas. The soils in this area are extremely sandy and infiltrate stormwater quickly. When originally constructed, there was very little on-site grading in an effort to preserve the root systems for the numerous oak trees. Currently there is not a stormwater collection system. The proposed improvements will mimic the existing conditions. The proposed design required that no trees be removed, so there will be very little grading. Stormwater will not be concentrated or collected and will be dispersed to the surrounding vegetation and sandy soils via sheet flow. A stormwater plan and narrative were submitted to NCDENR's Division of Water Quality on May 13th, 2009 and discussions are on-going. Site Information A wetland delineation performed by Land Management Group, Inc. on March 3, 2009 (attached) reveals no wetlands in the upland areas of the property, only tidal salt marsh along Bald Head Creek. According to the CAMA Land Use Plan, this property lies within a flood hazard zone VE. While there are no documented wildlife species attached to this site and the predominate tree species is Live Oak. The proposed plan has been designed to preserve all existing trees. There are no archeological or historical features on the site and according to the National Register of Historical Places, both the Bald Head Creek Boathouse and the Bald Head Island Lighthouse (each in the v #1tt ' ttheh, q i ,.. ? At the request of the Army Corps of Engineers, additional site information was provided to them on April 7, 2009. Proposed Construction Vehicular traffic on Bald Head Island is limited to electric golf carts. Therefore the proposed marl roadways and parking areas are smaller in size than standard roadways and parking areas. The proposed 10' wide concrete boat ramp will typically handle canoes and kayaks but can accommodate jon boats up to 16' per the Bald Head Island Creek Access Ordinance (attached). The ramp will be constructed and installed utilizing the push-slab method. Any necessary dredging for the boat ramp can be done from the upland areas and the adjacent boat ramp. Dredge material from the boat ramp construction will be placed in dump trucks and transported 1.05 miles to the Timber Creek Mulch Site. The Timber Creek Mulch Site is a permitted yard waste facility and a copy of the permit and lease are attached. The pier and dock that is currently situated between lots 105 and 107 will be disassembled and removed with the allocation of this dock being split equally between the two lots. This results in the removal of a 10'x44' dock and the construction of two 10'x22' docks as shown on the attached plans. Both walkways and docks will be constructed to the same standards as the existing dock. The proposed boat ramp will require the construction of one wooden bulkhead matching the existing wooden bulkhead on the existing boat ramp. The bulkhead is shown on the attached plans and will conform to current standards. Avoidance and Minimization The proposed addition of one boat ramp to Bald Head Creek will remove approximately 0.01 acres (574 sf) of coastal wetlands. In an effort to meet the avoidance and minimization criteria, the entire tract's water frontage was evaluated for the location with the smallest coastal wetland impact. The proposed boat ramp as shown on the attached drawing represents the best placement for the following reasons: 1) Generates the smallest coastal wetland impact. 2) Utilizes the existing boat ramp's bulkhead, resulting in one less bulkhead being constructed. 3) Existing boat ramp provides adjacent access for construction equipment without disturbing additional coastal wetlands. 4) Concentrates growth in one location, leaving remainder of the tract's water frontage undisturbed. 5) Expands the existing boat ramp's access road, preventing the construction of a new access road within the 30' buffer. t°°' Cc. r$ '`: With the proposed plan and placement of the boat ramp, we feel that the coastal wetland impact is minimized to the extent possible while still providing a much needed recreational access. Mitigation On the recommendation of the USACE a mitigation plan has been developed to offset the impact of the proposed boat ramp. The Bald Head Island Conservancy (BHIC) was contacted to assist in the formation of a mitigation plan. The BHIC is a non-profit organization founded in 1983 whose mission is to protect, preserve and promote the natural environment of the Bald Head Island area. As the islands' environmental advocate, they sponsor and facilitate scientific research and provide diverse activities to enrich and enlighten the islands' visitors and residents. With the proposed removal of approximately 0.01 acres (574 sf) of coastal wetlands consisting of tidal salt marsh dominated by smooth cordgrass (Spartina alterniora), restoration was the initial choice for mitigation. In discussing the idea of restoration with the BHIC, they felt that it was a poor choice for mitigation in this environment. The scientists and researchers with the BHIC consider the effort to restore 0.01 acres of coastal wetlands in a pristine 10,000 acre wetland area to be more destructive than the restoration offsets. As the area's environmental steward, they wanted to take this mitigation opportunity to address the environmentally deficient areas. With over 10,000 acres of pristine coastal wetlands and a water classification of SA - HWQ, the biggest shortfall is that the area is closed to shellfishing due to a high fecal coliform presence. BHIC is a partner with the North Carolina Division of Marine Fisheries and participates in the oyster shell recycling program. BHIC recommends utilizing the resources of the Village of Bald Head Island to assist in the placement of recycled oyster shells in Bald Head Creek as the mitigation plan for the proposed boat ramp. They are asking the Village to assist in the following areas: 1) Provide assistance in repairs and maintenance of Conservancy john boat 2) Provide transportation of oyster shells from recycling sites to the Creek Access Facility 3) Provide support in the transferring of oyster shells from land into the boats for placement According to BHIC's Executive Director Dr. Suzanne Dorsey, with the help of the Village, "we will continue to collect shells and annually add the shells to our BHI creeks in areas that either need stabilizing or already contain reefs. The mitigation should far exceed the 574sf damage to spartina from the Village's project. In addition the ongoing nature of our activity will not only address water quality issues in the BHI creek, it will support one of the State's most important salt marsh environments." R :xn SEP 2 4 2009 Dcm NC Conclusion With a management goal of "maximizing public access to the beaches and the public trust waters bordering its primary corporate limits" and an implementing action of "cooperating with state and federal agencies as well as private interest to secure estuarine access areas, including Bald Head Creek, to ensure adequate shoreline access within all areas of the Village" listed under the approve CAMA Land Use Plan, the Village is proposing the expansion of the Creek Access Facility. The site will provide a much needed water oriented park where island residents and visitors can experience the educational and recreational values of a North Carolina Barrier Island. Currently, the Creek Access Site is a launching point for kayak trips exploring the surrounding sound, marshes and backwaters. The site is home to summer camps/programs providing classes on water quality testing, fiddler crab population studies and aquatic species collection and identification. The site is also used as an observatory for native wildlife and seasonal migratory waterfowl. The existing facility is heavily used and too small to accomidate the number of visitors and canoes and kayaks. The roadway and parking areas are to be constructed of mart with a very minimal amount of grading. The boat ramp will be concrete and utilize the push-slab method. The proposed expansion includes a new roadway and parking area, the removal of an existing floating dock from the shared lotline and the redistribution of the two boatslips with two new floating docks, additional boat ramp, and additional kayak and canoe racks. e. Environmenral Consulranrs March 3, 2009 Mr. Chris McCall Village of Bald Head Island Bald Head Island, NC 28461 RE: Wetland delineation on VBHI Public Creek Access tract Dear Mr. McCall: Per your request, I delineated the boundaries of U.S. Army Corps of Engineers (COE) Section 404 jurisdictional wetlands on the VHBI Public Creek Access tract totaling approximately 1.08 acres. The site is located near the intersection of Light House Wynd and North Bald Head Wynd on Bald Head Island in Brunswick County, NC. The site visit included an assessment of the three parameters (soils, vegetation, and hydrology) that determine the presence of jurisdictional wetlands. The location of these wetland areas was marked with pink/black striped flagging. A sketch of the approximate location of these wetland flags is included as an attachment. The wetlands delineated on-site consist of tidal salt marsh dominated by smooth cordgrass (Sparfina altemillora). The remainder of the tract appears to be uplands with well-drained, high chroma, sandy soils. The dominant trees in these upland areas are red cedar (Juniperus virginiana) and live oak (Ouercus virginiana). Common shrubs in these uplands include wax myrtle (Morelia cerifera), yaupon holly (flex vomi ofia), and highbush blueberry (Vaccinium corymbosum). Please note that the attached map depicts the approximate location and extent of wetlands on the property. Therefore, it is highly recommended that the flags be located by a professional licensed surveyor to determine the exact location of these wetland areas.
