After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: As part of a proposed County-wide sewer system, the Bay River Metropolitan Sewer District proposes to directional bore a 6" and 16" PVC force main under the North Prong of Bay River, and a 6" PVC force main under the North and South Prong of Bay River, Alligator Creek, Trent Creek, and Fork Run in Pamlico County. IL FIELD INVESTIGATION REPORT: BAY RIVER METROPOLITAN SEWER DISTRICT/PAMLICO COUNTY PAGE #2 --------------------------- 9. NARRATIVE DESCRIPTION: Project Setting The proposed project is located in Pamlico County adjacent NC Hwy. 55, NC Hwy. 304, SR 1209, SR 1347, and NC Hwy. 306. The Bay River Metropolitan Sewer District (BRMSD) proposes to combine the treated effluent from the existing Town of Oriental Treatment facility with the treated effluent of the BRMSD and apply the effluent by means of spray irrigation on a site located on NC Hwy. 306 across from the Pamlico Community College near Arapahoe. And according to the applicant, an environmental assessment has been successfully submitted and processed through the State Clearinghouse by the Construction Grants and Loan Section for State agencies' comments and public input. Although the proposed lines would be located entirely in the filled road shoulder right-of-way, the proposed sewer lines would cross five DCM jurisdictional creeks. The route from the Bay River Metropolitan Sewer district site off NC Hwy. 304 would cross the North Prong of Bay River in Bayboro, while the route from the Town of Oriental treatment facility would cross Fork Run and Trent Creek near the Community of Merritt, Alligator Creek near the Community of Stonewall, and the South Prong of Bay River in Bayboro. At the North Prong project site in Bayboro, the alignment crosses immediately downstream of the DOT bridge on NC Hwy. 304. The creek is approximately 60' wide and -9' deep at the bridge. Both shorelines are essentially unimproved high ground with no wetlands along the alignment. At the South Prong location on NC Hwy. 55, extensive coastal wetlands vegetated with black needlerush (Juncus roemerianus) and sawgrass (Cladium 'amaicense border the roadway approaches along both shorelines. At the bridge, the creek is approximately 135' wide and -4' deep. At the Alligator Creek site in Stonewall, adjacent NC Hwy. 55, a similar stand of coastal wetlands borders the shoreline. Alligator Creek is approximately 45' wide and -3.5' deep at the project site. Along the alignment on the north shore is a semi-paved/gravel boat ramp while along the south shore is a small access dock. The Trent Creek site along NC Hwy. 55 near the Community of Merritt is similar to the South Prong site. Both systems are characterized by a relatively wide open water area with an extensive needlerush marsh bordering both shorelines. Trent Creek is approximately 110' wide with a water depth of -9' below NWL. At both sites, the marsh essentially begins at the toe of the fill for the roadway shoulders. An access dock exists along the alignment just east of the bridge. The final jurisdictional crossing is Fork Run also along NC Hwy. 55 just south of Merritt. Although Fork Run is limited in navigation (the creek essentially ends at the site), it is characterized by an expansive sawgrass marsh. At the bridge, Fork Run is approximately 40' wide with a water depth of -2' below NWL. All of the creeks are SC Sw NSW waters, none are PNAs nor open to shellfishing. A FIELD INVESTIGATION REPORT: BAY RIVER METROPOLITAN SEWER DISTRICT/PAMLICO COUNTY PAGE #3 --------------------------- Project Description The applicant proposes to install a 16" PVC force main along the filled-right-of- way along NC Hwy. 304 and a 6" PVC force main adjacent NC Hwy. 304 and NC Hwy. 55, adjacent to the North and South Prong of Bay River, Alligator Creek, Trent Creek, and Fork Run in connecting two existing sewer systems to a new spray irrigation site on NC Hwy 306. In addition to locating the proposed alignment within the filled shoulder of the roadway, the applicant has also chosen not to do any trenching within any AECs but to directional bore the lines at the crossings of Estuarine Waters/Public Trust Areas and Coastal Wetlands AECs. According to the applicant's proposal, all boring pits would be located outside the 75' Estuarine Shoreline AEC. The lines would be installed at a minimum of -3' below the bottom contour of the creeks. Erosion control measures such as silt fencing and check dams are proposed. According to the applicant, since the pipes would carry treated sewage as opposed to raw sewage, a casing pipe is not proposed. Anticipated Impacts Since the directional boring methodology is proposed, the project -- installing force main lines under Estuarine Waters/Public Trust Areas, Coastal Wetlands, and Estuarine Shoreline AECs -- should cause negligible impact to the AECs. Calculations of affected AECs is probably meaningless, except if it is used to put the project in perspective. If you assumed a 1'-wide bored hole for the 6" line and a 2'-wide hole for the 16" line, then according to the plans, the directional boring would take place under approximately 900 fe of Estuarine Shoreline, under approximately 450 fe of Estuarine Waters/Public Trust Areas, and under approximately 340 fe of Coastal Wetlands. All spoil material would be removed from the shoulder of the road and trucked off site. There would be no impact to navigation. M. Revised 03/95 PAMLICO COUNTY REGIONAL WASTEWATER TREATMENT FACILITIES PROJECT NARRATIVE COASTAL AREA MANAGEMENT ACT (LAMA) MAJOR DEVELOPMENT PERMIT The project is located in Pamlico County North Carolina along the right of ways of N.C. Hwy. 55, N.C. Hwy. 304, S.R. 1209, S.R. 1347 and N.C. Hwy. 306. The objective is to combine the treated effluent from the existing Town of Oriental treatment facility with the treated effluent of the Bay River Metropolitan Sewer district and land apply the effluent by means of spray irrigation on a site located on N.C. Hwy. 306 across from Pamlico Community College. The current plan calls for pumping a maximum of 320 gpm through a 6" PVC force main to a 23 million gallon equalization basin located at the Bay River facility, where it will be combined with the treated effluent from the Bay River facility, the combined flow shall be pumped via a 16" and a 12" PVC force main at a maximum pumping rate of 1500 gpm to the spray irrigation site. The areas of jurisdiction that have been previously defined by NCDEHNR Division of Coastal Management are mostly along N.C. Hwy. 55 and N.C. Hwy. 304. Although there are several methods for crossing small creeks and rivers the method that would cause the least impact would be hanging the pipe from the bridge structure itself, however it has been determined that this is not feasible since the structures involved will not support the size pipe required or attachment of the pipe to the bridges is prohibited by way of their construction. Therefore, the most feasble method that will impact the environment the least, is the directional drilling method. It is anticipated by using the directional boring method any excavation that is required for the operation will be minimal, and that the excavation shall be outside those limits of environmental concern. Erosion Control methods such as silt fenceing and check dams shall be used to protect the estuarine area. and all spoil material shall be removed from the shoulder of the road and utilized in the equalization area at the Bay River site.
