Box 11759 Charlotte, NC 28220 Re: Compliance Inspection Brownestone Subdivision Dear Mr. Gartland: On May 24, 1995 you were issued General Water Quality Certification No. 2671 authorizing 0.52 acres of wetland impacts for the purpose of developing the Brownestone Subdivision located at the southeast corner of Dearman Road and Browne Road north of Charlotte. Any changes m.your project that would impact additional wetlands requires notification to this office and may involve additional authorization. As part of an ongoing compliance monitoring and enforcement program for 401 Water Quality Certifications, Todd St. John from the Division's Mooresville Regional Office and myself made a compliance inspection of the Brownestone Subdivision on January 31, 1997. From our inspection it appears that your project is in compliance with the conditions of the certification. We found that the filling of the stream channel was, currently underway and that a sediment pond had been constructed a the bottom of the narrow draw being filled. Your cooperation in complying with the conditions of your 401 Water Quality Certification is appreciated. Box 11759 Charlotte, N.C. 28220 Dear Mr. Gartland: [D F= F=1 May 24, 1995 Mecklenburg County DEM Project # 95514 FILE COPY You have our approval to place fill material in 0.52 acres of wetlands or waters for the purpose of constructing a subdivision at Browne and De Arman Roads, as you described in your application dated 17 May 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in-your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The proposed project site is located north of Charlotte just south of the future Charlotte Outer Belt. The site is at the top of a drainage area of a small intermittent tributary of Clarks Creek (Water Classification C), which flows to Mallard Creek of the Yadkin River Basin. The majority of the site is agricultural pasture with patches of woodland in various stages of early succession. Areas of dense overgrowth along the man-made clearings and edges in areas of Hurricane Hugo damage. Hydrophytic vegetation occurs along the slopes of the drainage ways and in the wetland areas. The majority of the site is an upland ridge with moderately steep side slopes to a well defined drainageway. The soils according to SCS Soil Survey on site include Cecil sandy clay loam (CeB2) a typical well drained upland soil. A small area of Helena (HeB) which known to have hydric inclusions identified in a drainage way along DeArmon Road. The total area of potential Jurisdictional Waters, including wetlands on the site is ± 0.52 acres based on my site review and USACOE verification (4/18/95) and subsequent survey. The site was also reviewed by Ms. Cherri Smith of your office on 5/17/95 to evaluate the wetland value and potential loss. Her review indicated that these wetlands were of low value. Also, an approved sedimentation and erosion control plan will be adhered to during construction of the various project components. I have also informed my client that an application to the NCDEM will be required if the development area changes and additional impacts to headwaters are necessary. The majority of the site is agricultural pasture with patches of woodland in various stages of early succession. Areas of dense overgrowth along the man-made clearings and edges in areas of Hurricane Hugo damage. Hydrophytic vegetation occurs along the slopes of the drainage ways and in the wetland areas. The majority of the site is an upland ridge with moderately steep side slopes to a well defined drainageway. The soils according to SCS Soil Survey on site include Cecil sandy clay loam (CeB2) a typical well drained upland soil. A small area of Helena (HeB) which known to have hydric inclusions identified in a drainage way along DeArmon Road. The total area of potential Jurisdictional Waters, including wetlands on the site is + 0.52 acres based on my site review and USACOE verification (4/18/95) and subsequent survey. The site was also reviewed by Ms. Cherri Smith of your office on 5/17/95 to. evaluate the wetland value and potential loss. Her review indicated that these wetlands were of low value. Also, an approved sedimentation and erosion control plan will be adhered to during construction of the various project components. I have also informed my client that an application to the NCDEM will be required if the development area changes and additional impacts to headwaters are necessary.
