activity.
The NCWRP, by acceptance of this payment, acknowledges that the
NCWRP is responsible for the compensatory mitigation requirements
associated with DWQ #001218 and agrees to provide the compensatory
mitigation as specified in the 401 Water Quality Certification. As specified, the
NCWRP will restore 467 linear feet of stream in basin/subbasin 030605.

This office has reviewed the subject Erosion and Sedimentation Control Plan. We find the plan to be
acceptable and hereby issue this letter or approval. If any modifications, performance reservations, or
recommendation are applicable, a flat is enclosed and is incorporated as a part of this letter of approval. If any
modifications are not incorporated into the plan and implemented in the field, the site will be in violation of the
Erosion and Sedimentation Control Ordinance of Wake County. In addition, it should be noted that this plan
approval shall expire two (2) years following the date of approval in accordance with Permits, Section 5(2) of the
Ordinance, if no land-disturbing activity has been undertaken.
Plan Approval is limited to consImctiov, maintenance and stabilization of both temporary and permanent
sedimentation and erosion control devices only. For projects located within the jurisdictional area of Morrisville,
Wake County Erosion, Flood and Stormwatcr Section is not responsible for subject approvals of other Local, State
or Federal Agencies. The subject approvals are (but not limited to) Federal Emergency Management Area Flood
regulations/requirements, Division of Water Quality under stonnwater or other water quality
regulations/rcquiromcnts, U.S. Army Corps of Engineers tinder Article 404 (Wetlands) jarisdiction/requirerncnts,
and/or any Vederal, State, County and Local municipal regulations or permit requirements. The approval. Issued in
this letter cannot supersede any other required permit or approval.

Since this project disturbs five or more acres, one such approval relates to the Stornnvater that will
discharge $om your project. This runoff is permitted pursuant to the National Pollutant Discharge Elimination
System (NPDES) administered in North Carolina by the Division of Water Quality (DWQ). Attached is the General
Stormwater NPDES Permit, N0301000, as revised July 1, 1995, covering your activity. You are responsible for
complying with the General Permit requirements and are subject to en£orcc[ncnt by DWQ for any violations of the
General Permit.
Wake County's sedimentation pollution control program is performance oriented, requiring protection of
the natural. resources and aQjoiniag properties. If at any time during this project it is determined that the Erosion and
Sedimentation Control Plan is inadequate to meet the requirements of the Erosion and Sedimentation Control
Ordinance of Wake County , this office may require revisions in the plan and its implementation to ensure
compliance with the Ordinance. Also, please consider this letter as notice in accordance with, the requirements for
Approval of Plans, Section 4(8), this office may require revisions in the plan and its implementation to ensure
compliance with the Ordinance.
Please note that this approval is based in part on the accuracy of the information provided concerning

NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401
Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division
of Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500 to the North Carolina
Department of Environment and Natural Resources, Division of Water Resources, resulting in
the placement of fill and culverts into 1,195 linear feet of intermittent streams and 467 linear feet
of perennial streams, flooding of 1,100 linear feet of intermittent streams, and fill in 0.012 acre
of wetlands within the Kit Creek Watershed, associated with the construction of Breckenridge
Subdivision in Wake County, pursuant to an application filed on the 23rd day of October of
2000.
The application provides adequate assurance that the discharge of fill material into Kit
Creek in conjunction with the proposed work will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that
this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-
500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set
forth.
This approval is only valid for the purpose and design that you submitted in your
application and as described in the Public Notice. If you change your project, you must notify us
and send us a new application for a new certification. If the property is sold, the new owner must
be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. Should additional wetland or stream fill be requested in the future,
compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7).
For this approval to be valid, you must follow the conditions listed below. In addition, you
should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Solid Waste, Sediment and Erosion control, Non-discharge and
Water Supply Watershed regulations.
Condition(s) of Certification:
1. That the activity be conducted in such manner as to prevent significant increase
in turbidity outside the area of construction or construction related discharge (50 NTU's
in streams and rivers not designated as trout waters by DWQ; 25 NTU's in all saltwater
classes, and all lakes and reservoirs; 10 NTU's in trout waters).
2. Should waste or borrow sites be located in wetlands, compensatory mitigation
will be required since it isa direct impact from construction activities.
3. All temporary fill shall be removed to the original grade after construction is complete
and the site shall be stabilized to prevent erosion;
4. All sediment and erosion control measures placed in wetlands or waters shall be
removed and the natural grade restored after the Division of Land Resources releases
the project;
5. Measures shall be taken to prevent live or fresh concrete from coming into contact with
waters of the State until the concrete has hardened;
6. The enclosed "Certification of Completion Form" is to be used to notify DWQ when all
work included in the 401 Certification has been completed;
7. We understand that you have chosen to contribute to the Wetland Restoration Program
in order to compensate for the impacts to streams. In accordance with 15A NCAC 2R
.0402 and 15A NCAC 2B .0242(7), this contribution will satisfy our compensatory
mitigation requirements under 15A NCAC 2H.0506(h) and 15A NCAC 2B .0233(10).
Until the Wetland Restoration Program receives and clears your check (made payable
to: DENR - Wetlands Restoration Program), wetland and stream impacts (including
fill) shall not occur. Mr. Ron Ferrell should be contacted at (919)733-5208 if you have
any questions concerning the Wetland Restoration Program. You have one month from
the date of this Certification to make this payment. For accounting purposes, this
Certification authorizes the fill of 467 feet of perennial streams and 0.012 acre of
wetlands, in the Neuse River and sub-basin and 467 feet of stream mitigation is
required. Please be aware that the Wetland Restoration Program (WRP) rules
require rounding of stream impacts to the nearest foot (15A NCAC 2R.0503(b))."
8. In addition to the WRP payment stipulated in Condition 7, mitigation also includes
preservation of 1,700 linear feet of intermittent streams and associated riparian areas
extending a minimum of 30 feet from the edge of the channel, perservation of a buffer
around approximately 40% of the lake, and creation of a 5-foot littoral shelf around
approximately 50% of the lake, as outlined in the application and Public Notice.
Violations of any condition herein set forth shall result in revocation of this Certification
and may result in criminal and/or civil penalties. This Certification shall become null and void
unless the above conditions are made conditions of the Federal 404 Permit. This Certification
shall expire upon expiration of the 404 Permit.
If this Certification is unacceptable to you have the right to an adjudicatory hearing upon
written request within sixty (60) days following receipt of this Certification. This request must
be in the form of a written petition conforming to Chapter 150B of the North Carolina General
Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C.
27611-7447. If modifications are made to an original Certification, you have the right to an
adjudicatory hearing on the modifications upon written request within sixty (60) days following
receipt of the Certification. Unless such demands are made, this Certification shall be final and
binding.

Enclosed is the application of Froehling & Robertson, Inc., submitted on behalf of
Morrisville, LLC, for Department of the Army authorization and a State Water Quality
Certification to authorize the proposed placement of culverts and fill into 1,195 linear feet of
intermittent stream channel and 467 linear feet of perennial stream channel, flooding of 1,100
linear feet of an intermittent stream channel, and placement of fill within 0.012 acre of wetlands,

We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the

until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by December 16, 2000, the District Engineer will
deem that waiver has occurred.

Enclosed is the application of Froehling & Robertson, Inc., submitted on behalf of
Morrisville, LLC, for Department of the Army authorization and a State Water Quality
Certification to authorize the proposed placement of culverts and fill into 1,195 linear feet of
intermittent stream channel and 467 linear feet of perennial stream channel, flooding of 1,100
linear feet of an intermittent stream channel, and placement of fill within 0.012 acre of wetlands,
within the Kit Creek watershed, associated with construction of Breckenridge Subdivision, in
Morrisville, Wake County, North Carolina.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by December 16, 2000, the District Engineer will
deem that waiver has occurred.

PUBLIC NOTICE
Lochmere Homeowners Association, c/o HRW Management Corporation, 1183 West
Chatham Street, Cary, North Carolina 27513, has applied for a Department of the Army (DA)
permit TO EXCAVATE 7,500 CUBIC YARDS OF ACCUMULATED SEDIMENTS FROM
APPROXIMATELY 1.5 ACRES OF THE UPPER END OF LAKE LOCH LOMOND AND
DISCHARGE THE EXCAVATED MATERIAL INTO APPROXIMATELY 1.5 ACRES OF A
DEEPER PORTION OF THE LAKE, IN THE LONG BRANCH WATERSHED,
ASSOCIATED WITH LOCH LOMOND IMPROVEMENT PROJECT, IN CARY, WAKE
COUNTY, NORTH CAROLINA.
The following description of the work is taken from data provided by the applicant and
from observations made during a site visit by a representative of the Corps of Engineers. Plans
submitted with the application show the proposed excavation of 3 feet of accumulated sediments
by bulldozer from approximately 1.5 acres of lake bottom, and the repositioning of the sediments
into 1.5 acres of a deeper portion of the lake bottom to provide for deeper water conditions at the
upper end the lake. The sediments will be moved by bulldozer from the upper portion of the
lake, where existing water depths range from 0 to 6 feet, to the middle if the lake, where existing
depths range from 6 to 9 feet. The 7,500 cubic yards of sediments will be repositioned after
water levels have been lowered to allow dry access to the work areas. Prior to excavation, a
diversion ditch will be dug to transport water entering the lake from Long Branch along the
eastern shoreline to a point below the sediment deposition area. A permanent sediment trap
measuring 10 feet across and 10 feet deep will be excavated immediately downstream of the
discharge of Long Branch into the lake to allow heavier sediments to be trapped before entering
the lake to prevent future sediment accretion. The purpose of the work is to provide for deeper
water at the upper end of the lake. Plans showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine the need for the
applicant to obtain any required State authorization. No Department of the Army (DA) permit
will be issued until the coordinated State viewpoint on the proposal has been received and
reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of
Water Quality (NCDWQ) has determined the applicability of a Water Quality Certificate as
required by PL 92-500.
This application is being considered pursuant to Section 404 of the Clean Water Act (33
U.S.C. 1344). Any person may request, in writing within the comment period specified in the

notice, that a public hearing be held to consider this application. Requests for public hearing
shall state, with particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the National Register of
Historic Places for the presence or absence of registered properties, or properties listed as being
eligible for inclusion therein, and this site is not registered property or property listed as being
eligible for inclusion in the Register. Consultation of the National Register constitutes the extent
of cultural resource investigations by the District Engineer, and he is otherwise unaware of the
presence of such resources. Presently, unknown archeological, scientific, prehistorical, or
historical data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that the proposed
activity will affect species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of the probable
impacts, including cumulative impacts, of the proposed activity and its intended use on the
public interest. Evaluation of the probable impacts which the proposed activity may have on the
public interest requires a careful weighing of all those factors which become relevant in each
particular case. The benefits which reasonably may be expected to accrue from the proposal
must be balanced against its reasonably foreseeable detriments. The decision whether to
authorize a proposal, and if so the conditions under which it will be allowed to occur, are
therefore determined by the outcome of the general balancing process. That decision should
reflect the national concern for both protection and utilization of important resources. All factors
which may be relevant to the proposal must be considered including the cumulative effects
thereof. Among those are conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in
accordance with Executive Order 11988), land use, navigation, shore erosion and accretion,
recreation, water supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in general, the needs and
welfare of the people. For activities involving the placement of dredged or fill materials in
waters of the United States, a permit will be denied if the discharge that would be authorized by
such permit would not comply with the Environmental Protection Agency's 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a
permit will be granted unless the District Engineer determines that it would be contrary to the
public interest.
The Corps of Engineers is soliciting comments from the public; Federal, State and local
agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate
the impacts of this proposed activity. Any comments received will be considered by the Corps of
Engineers to determine whether to issue, modify, condition or deny a permit for this proposal.
To make this decision, comments are used to assess impacts on endangered species, historic
properties, water quality, general environmental effects and the other public interest factors listed
above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an
Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act

(NEPA). Comments are also used to determine the need for a public hearing and to determine
the overall public interest of the proposed activity.
Generally, the decision whether to issue this Department of the Army (DA) permit
modification will not be made until the North Carolina Division of Water Quality (NCDWQ)
issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The
NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302,
306, and 307 of the Clean Water Act. The application and this public notice for the Department
of the Army (DA) permit serves as application to the NCDWQ for certification.
Additional information regarding the Clean Water Act certification may be reviewed at the
offices of the Environmental Operations Section, North Carolina Division of Water Quality
(NCDWQ), Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such
materials will be furnished to any person requesting copies upon payment of reproduction costs.
All persons desiring to make comments regarding the application for Clean Water Act
certification should do so in writing delivered to the North Carolina Division of Water Quality
(NCDWQ), Wetlands/401 Unit, 1621 Mail Service Center, Raleigh, North Carolina 27699-
1621, on or before November 15, 2000, Attention: Mr. John Domey.

The U. S. Army Corps of Engineers (COE) has reviewed the Individual Permit
Application Report and Supporting Documentation for the Breckenridge Subdivision and has
requested minor changes. Although the information contained in the revised report is almost
identical, the format and the presentation of the drawings and figures has changed. As per a
telephone conversation with Rob of the DWQ on October 6, 2000, enclosed please find two
copies of the revised Individual Permit Application Report and Supporting Documentation for
circulation in the central and regional offices. Also included is a map which highlights the
sections at Breckenridge that will be set aside for preservation.
Morrisville, LLC, has stated that the highlighted areas on the map (outside of the impacts
this permit is applying for) will not be cleared during construction and will remain wooded.
These areas, along with the remaining areas of green space will be deeded over to the
Breckenridge Homeowners Association when the Breckenridge Subdivision is complete. The
deed will place a restriction on the areas set aside for preservation that will prohibit clearing.
This preservation measure will include, but is not limited to approximately 1,700 linear feet of
undisturbed channel with a wooded buffer generally ranging from 30 feet to more than 100 feet
wide. F&R recognizes that due to the project layout demands, a few area of the buffer along the
streams will be within 10 feet of a sewer line or a privately owned lot. F&R also recognizes that

this preservation measure will also include several disturbed areas, including areas that have
been temporarily altered by the placement of sewer lines. However, the disturbed areas have not
been considered for mitigation or in the above stated total of 1,700 linear feet of undisturbed
channel with a wooded buffer. The undisturbed channels included in the mitigation package are
the three intermittent channels the flow into the perennial channel.
Please note that the same preservation effort will apply to the areas that will remain wooded
around the proposed lake as shown on sheet No. 4 of 11 in Appendix A of the revised Individual
Permit Application Report.

1.0 INTRODUCTION
Froehling & Robertson, Inc. (F&R) has been contracted by Morrisville,, LLC (the current
property owner) to proceed on the Owner's behalf as the Owner's agent for wetland consulting
and permitting issues pertaining to the residential development of the approximately 215 acre
Breckenridge Subdivision located in Morrisville, Wake County, North Carolina.
Morrisville, LLC is submitting this application to the Department of the Army for a permit
to discharge fill material into wetlands and unnamed intermittent and perennial tributaries of Kit
Creek. Approximately 0.01 acres of wetlands and approximately 1,662 linear feet (approximately
0.13 acres) of intermittent and perennial channel are proposed to be impacted. The purpose of the
discharge is primarily for road crossings in connection with residential development associated with
Breckenridge Subdivision and temporary stream impacts associated with sewer line crossings. The
unavoidable stream impacts associated with this project have been balanced by minimizing impacts as
much as practical as well as proposing a compensatory mitigation plan.
The wetlands and "Other Waters of the United States" have been delineated by Soil &
Environmental Consultants (S&EC) and verified by Mr. Todd Tugwell of the U.S. Army Corps of
Engineers (COE) on October, 29, 1998. The wetlands located on the project site consist of four
unnamed intermittent and one perennial tributary of Kit Creek, as well as three other small areas of
wetlands. The three small areas of wetlands total approximately 5, 500ft 2 or 0.13-acres in size.
F&R performed a site
of the project site on June 13, 2000, and observed the
four intermittent channels. The intermittent channels exhibited a strong continuous bed & bank
with moderate differentiation in channel substrate from the surrounding soils. The intermittent
channels were dry eventhough the area had experienced average rainfall recently. Large quantities
of leaf litter and a few terrestrial plants were observed in the intermittent channels. The channels

were not particularly sinuous, and riffle pool structures, undercut banks and other in-stream
habitat structures were not observed. The COE has determined that the unnamed intermittent
tributaries do not perform important aquatic functions and have been classified by the COE as
"unimportant", or not requiring compensatory mitigation for impacts.
The perennial channel exhibited a strong continuous bed & bank with stronger
differentiation in channel substrate from the surrounding soils than the aforementioned
intermittent channels. The channel was flowing and contained little, if any, leaf litter. The
channel is sinuous and does contain undercut banks and other in-stream habitat structures,
however, riffle pool structures were not observed. The NCDENR - Division of Water Quality
(DWQ) Classification for the perennial stream is Class C and is furthermore classified by the COE
as performing "important" aquatic functions, therefore requiring mitigation for impacts. The
unnamed perennial stream is also mapped by the U.S. Fish and Wildlife Service on the National
Wetlands Inventory Map as a stream through a bottomland forest where the streamflow is
moderate and alluvium is fairly well drained.
The project site is located within the Cape Fear River Basin and all of the streams are
located outside of the Jordan Lake Reservoir Protection Area with the exception of one
intermittent stream. The intermittent stream located on the western most portion of the project
site adjacent to Old Maynard Road is located within the Jordan Lake Reservoir Protection Area.
F&R has initiated preliminary discussions with the COE and the DWQ. On July 12, 2000,
F&R met with Mr. Todd Tugwell of the COE and on July 17, 2000, F&R met with Ms. Beth
Barnes of the DWQ to discuss such topics as avoidance, minimization, and mitigation
requirements for the current phase of development. F&R has since had several additional
telephone conversations and/or meetings with both Mr. Tugwell, Ms. Barnes, and other members
of the DWQ concerning the Breckenridge project. Based on preliminary conversations, impacts
to the channel classified as "important" will be mitigated for at a 1:1 ratio. Of the 1,662 linear
feet of stream impacts, only 467 linear feet are to the channel classified as "important". The

1 construction of vegetative shelves in the proposed lake) to lessen impacts. F&R has also
contacted the North Carolina Wetlands Restoration Program (NCWRP) on behalf of Morrisville,
' LLC to request that the NCWRP provide mitigation for the unavoidable impacts to streams
1 performing important aquatic functions. In a letter dated September 8, 2000, the NCWRP has
agreed to provide up to 467 linear feet of stream restoration for impacts to "important" channels
1 associated with the project.
While no portion of the work impacting wetlands or "Other Waters of the United States"
1 outlined in this application has begun, an earlier phase of the project which was previously
permitted has commenced. The earlier phase of the project was previously permitted under COE
Nationwide Permit Nos. 12, 13 and 26, dated June 6, 2000 (COE Project Nos. 200020223 - 4
and 200020538) and received 401 certification from the DWQ on February 3, 2000 (DWQ No.
1 991282).
1 2.0 APPLICATION FOR PERMIT - SUPPLEMENTAL INFORMATION
Due to the amount of space allotted on the Application for Department of the Army Permit and
the complexity of some of the answers, the following information is provided to offer a more complete
response to the questions contained on the permit application. The section numbers correspond to the
item sections located on the permit application.
2.1 BLOCK 15 - LOCATION
Breckenridge Subdivision is approximately 215 acres of mostly undeveloped wooded land
located along Old Maynard Road (SR 1632) approximately 0.5 miles north of its intersection with
Koopers Road (SR 1635) in Morrisville, Wake County, North Carolina. The project site is located at

2.2 BLOCK 18- NATURE OF ACTIVITY
The residential development proposed for Breckenridge Subdivision will require extensive
grading to prepare the site for development. The Breckenridge project will include construction of
single family homes, townhomes, two lakes, recreation areas, as well as incorporate areas of green
space.

The unavoidable road crossings and temporary sanitary sewer line channel impacts required for
the project site development have been minimized to the greatest extent practical. Based on
correspondence with Priest, Craven & Associates, the land use consultants for the Breckenridge
project site, the typical road crossing will range from placing a single 36' or 42" diameter reinforced
concrete pipe (RCP) culvert with flared end sections; to placing triple 72" culverts with concrete end
walls in the channel. The culvert will be placed slightly below the current grade of the stream to allow
for maximum water flow. If triple culverts are required, then one culvert will be placed slightly lower
to also allow for maximum water flow through one of the culverts. Each culvert will have rip-rap inlet
protection and rip-rap velocity dissipator outlet protection. Compacted earthern fill will be placed over
the culvert to bring the roadway to the proposed grade. A curb and gutter street section varying from
27 feet to 56 feet in width with a 5 foot wide concrete sidewalk will be constructed upon the fill (see
Sheets No. 8 of 11-11 of 11 for Cross Section Views of Proposed Wetland Impacts in Appendix A).
The typical sanitary sewer line crossing will consist of a narrow excavation (typically less than 5 feet
wide) to install an 8 inch ductile iron pipe (DIP) and backfilling with the excavated earthen materials.
The mechanical equipment used during the constriction of the project site will include
conventional earth moving equipment used during residential development such as excavators,
bulldozers, compactors, pans, and other conventional earthwork construction equipment.

2.3 BLOCK 19 - PROJECT PURPOSE
The Research Triangle Park (RTP) area is experiencing an enormous amount of growth.
There is a strong demand for housing in the RTP area. Morrisville, LLC is helping to meet this need by
providing an environmentally responsible mixed residential development for the RTP area. It is our
belief that the proposed project, along with the approved Storm Water and Erosion Control
Management Plans and the stream mitigation efforts, will not have a negative effect on water quality or
contribute to the cumulative loss of Jurisdictional Waters of the United States.
The date for this phase of the project, described in this application, to start has passed.
Morrisville, LLC is currently delaying the start date for this project until receiving a 404 permit from
the COE and a 401 Certification from the DWQ. The scheduled date to complete the project is
currently three months after receipt of permit.
2.4 BLOCK 20- REASON(S) FOR DISCHARGE
The stream crossings shown on the wetland impacts maps in Appendix B are needed to
maintain adequate vehicle access and circulation, to provide emergency vehicle access, as well as
adequately sewer the proposed residential development. These stream crossings are also needed to
meet the requirements imposed by the Town of Morrisville. The road crossings are required for
accessing large portions of the project site, which without access would make developing the site
economically unfeasible and subtract from the project purpose of meeting RTP's need for housing.
The number and placement of sanitary sewer crossings has been scrutinized in great detail, and
based on correspondence with Priest, Craven & Associates, the topography and location of the streams
causes more stream crossing then may be initially anticipated. Based on their experience, the proposed
location of sewer line will minimize the overall disturbance to the stream and the bank on each side of
the channel.

1 2.5 BLOCK 21 - TYPES OF MATERIALS USED
The types of materials used in the construction of the road crossings and sewer crossings
' will include RCP, DIP, rip-rap, geotextile fabrics, onsite soils and other conventional construction
materials.
2.6 BLOCK 22 - IMPACTS
The proposed wetland impacts have been numerically designated on a table shown on Sheet
' No. 1 of 11 in Appendix A and have been keyed to the Wetland Impacts Map located on Sheet No. 3
of 11 also included in Appendix A. The wetland impacts table includes the reason for impact (e.g. road
' crossing, sewer line, etc...) and the size of the impact including channel length, width and area
1 impacted.
The purpose of the discharge is primarily for road crossings in connection with residential
1 development associated with Breckenridge Subdivision and temporary stream impacts associated with
sewer be crossings. However, a small portion of the proposed impacts are necessary for the
construction of residential foundations, building pads and attendant features (see Sheet No. 7 of 11 in
Appendix A for illustration). The impacts associated with the construction of residential foundations,
' building pads and attendant features will account for approximately 5% of the total impacts and have
been restricted to streams which do not perform "important" aquatic functions.
' Unavoidable impacts to streams, especially the perennial stream, have been carefully
1 minimized to the furthest extent practical while still allowing for an economically -feasible project.
Impacts to the perennial stream or the "important" channel have been limited to 467 linear feet
1 (see Sheets No. 5 and 6 of 11 in Appendix A). Furthermore, significant mitigation measures have
been proposed to offset the unavoidable impacts to the important aquatic value of the stream
' channels.
The Breckenridge project will also require the flooding of approximately 1,100 linear feet
1 of intermittent stream channel to construct the required storm water management lake located
southeast of Wetland Impact No. 1 as shown on Sheet No. 4 of 11 in Appendix A. The surface
' area of the proposed lake will encompass approximately 2.6 acres. The lake depth will range

3.0 AVOIDANCE AND MINIMIZATION
3.1 No PRACTICAL ALTERNATIVE ANALYSIS
Several alternatives were considered to avoid the proposed stream impacts, including a no
project alternative. Due to the engineering, grading and planning requirements, as well as the need
to utilize the land in an efficient manor, the impacts to the streams located on the Breckenridge
project site can not be avoided.
The "no project alternative" was considered, however, this alternative would not help
meet the housing needs of the RTP area or be economically beneficial. The preliminary plan for
Breckenridge Subdivision did not include road crossings at Impact Nos. 2 and 3 as depicted on
sheet No. 5 of 11 located in Appendix A. Impact No. 2 is being required by the Morrisville
Planning Department for safety and traffic flow reasons and Impact No. 3 is required to allow for
access to a proposed thourghfare planned for developed north of the project site. Based on
discussions with Ms. Mary Beerman of the Town of Morrisville Planning Department and a letter
from Ms. Beerman to Mr. Todd Tugwell dated August 16, 2000, concerning avoidance of stream
impacts, the Breckenridge Subdivision is designed to minimize the impacts to stream channels
while still maintaining adequate traffic access and circulation. Ms. Beerman stated she reviewed
the plan again in light of the concern over number of stream crossings, however, Ms. Beerman
could not envision any alternate subdivision designs that would reduce the number of stream
crossings.
The number and placement of sanitary sewer crossings has been scrutinized in great detail, and
based on correspondence with Priest, Craven & Associates, the topography and location of the streams
causes more stream crossing then may be initially anticipated. The perennial channel is bound on one
side by a steep bluff and a less steep area on the other, furthermore, the steep bluff is not consistently
on the same side of the channel. Priest, Craven & Associates has stated that, based on their experience,
the location of the manholes and sewer line on the flatter side of the channel will minimize the overall
disturbance to the stream and the bank on each side. Also, three other intermittent streams divide
Breckenridge into four separate development areas, each needing to be sewered. Therefore, requiring
additional channel impacts.

3.2 Nt[NINIIZATION ANALYSIS
Based on correspondence with Priest, Craven & Associates, the relatively steep topography
(10 - 15 % range) and the Morrisville vertical street design standards (which are more stringent than
most municipalities) are two controlling factors that cause the proposed road grades at the channel
crossings to be larger than the typical road crossing in this region. Therefore, requiring a deeper and
wider fill sections at the channel crossing. Also, the significantly meandering streams cause the length
of the channel impact within the road crossing to be greater than normally anticipated in this region.
The use of retaining walls or head walls was considered as an alternative to minimize the stream
impacts. However, due to the significant meandering of the streams, the negligible reduction in impacts
by using retaining walls does not permit this option to be economically feasible.
As part of F&.R's preliminary meetings with the COE and NCDENR, the number and
placement of sanitary sewer crossings has been discussed. Priest, Craven & Associates has
reevaluated the sanitary sewer line layout in an effort to limit the amount of disturbance caused by
the channel crossings. Based on Priest, Craven & Associates reevaluation, two of the proposed
sewer line crossings located near Impact No. 10 and illustrated on Sheet No. 6 of 11 have been
eliminated. The sewer line will now cross at a proposed road crossing thereby lessening the sewer
line impacts by 51 linear feet. However, no other option to the proposed sewer layout has been
plausible.
4.0 COMPENSATORY MITIGATION
Morrisville, LLC recognizes the need for mitigation to compensate for the unavoidable
impacts to streams performing important aquatic functions. In their commitment to having an
environmentally responsible project, Morrisville, LLC is incorporating onsite mitigation measures
(i.e. wooded buffers for streams, deed restrictions on green space and construction of vegetative
shelves in the proposed lake) to lessen the unavoidable impacts. The remained of the stream
mitigation will be provided by payment to the NCWRP in accordance with 15A NCAC 2R.0402
to satisfy the compensatory mitigation requirements under 15A NCAC 2H .0506(h).

4.1 ON-SITE MITIGATION MEASURES
Morrisville, LLC is proposing to provide stream/buffer preservation to mitigate for 10 %
of the 467 linear feet of impacts to steams providing "important" water quality functions. The
undeveloped areas shown on the Wetland Impact Map located on Sheet No. 3 of 11 in Appendix
A will remain in a naturally wooded state. After development of the subdivision is complete,
Morrisville, LLC will deed the stream channels and associated green space to the Breckenridge
Homeowners Association. The deed transferring the stream channels and associated green space
to the homeowners association will contain restrictions that the areas remain wooded and are not
to be cleared. This preservation measure will include, but is not limited to approximately 1,700
linear feet of undisturbed channel with a wooded buffer generally ranging from 30 feet to 100+
feet wide. F&R recognizes that due to the project layout demands, a few area of the buffer along
the streams will be within 10 feet of a sewer line or a privately owned lot. F&R also recognizes
that this preservation measure will also include several disturbed areas, including areas that have
been temporarily altered by the placement of sewer lines. However, the disturbed areas have not
been considered for mitigation or in the above stated total of 1,700 linear feet of undisturbed
channel with a wooded buffer.
This act of preservation will also be applied to the proposed lake as shown on the Sheet
No. 4 of 11 in Appendix A. A vegetation buffer will be established around the proposed pond.
The vegetative buffer will include approximately 40% wooded areas which will not be cleared
during construction and will be restricted from clearing in the future by means of a deed
restriction.
Morrisville, LLC is further compensating for unavoidable losses to wetland resources by
establishing a vegetative shelf around approximately 50% of the proposed lake as illustrated on
Sheet No. 4 of 11 in Appendix A. The shelf will consist of an approximately 5 foot wide shelf
sloping to approximately 1 foot deep and will be allowed to become naturally vegetated. This
vegetative shelf will help reduce the amount of sediment being deposited into the lake and lower
the amount of nutrients, available to algae, thereby lowering the occurrence of algae blooms.

The purpose of this letter is to notify you that the North Carolina Wetlands
Restoration Program (NCWRP) will accept payment for stream impacts associated
with the subject project in accordance with the Memorandum of Understanding
between the North Carolina Department of Environment and Natural Resources and
the U.S. Army Corps of Engineers dated November 4, 1998. Based on information
supplied by you in a fax dated August 25, 2000, an application requesting
authorization to impact 467 linear feet of stream channel has been submitted for the
subject project. The NCWRP will provide mitigation as specified in the 401 Water
Quality Certification and/or Section 404 permit (up to 467 linear feet of stream
restoration) for impacts associated with the subject project in Cataloging Unit
03030002 of the Cape Fear River basin.

It has come to our attention that the Corps of Engineers - Raleigh Regulatory
Field Office has a concern regarding the number of stream crossings within Tract 6 & 7
of the Breckenridge development in Morrisville, NC. The Town of Morrisville
understands and shares in your effort to minimize the adverse affect that crossings have
upon state waters.
I have again reviewed the plan in light of the stream crossings and cannot
envision any alternate subdivision design that would reduce the number of stream
crossings while maintaining adequate access and circulation. Therefore, it is the Town's
view that the impacts are in fact minimized by the plan as shown.

Dear Dan :
The topography of the Breckenridge development is relatively steep, in the 10 to 15%
range. Monisvitllc's vertical street design staxldards are: also more stringent than most
municipalities, requiring flatter grades and longer vertical curves. These two factors
combine to cause the proposed road grades at the creek crossings to be 1?ighm 0-tan the
typical situation in the region. This results in deeper and wider fill sections at the creek
crossings.
The stream through this tract meanden, significantly in several locations on its run
through the tract. At the proposed mad crossings, this meandering causes the length of
the channel impact to be greater than normally anticipated in plus region.
The exact size of the culverts for each Lxeek crossing has yet. to be determined. However
the sizes will range from a single 42" diaMeter culvert with flared end sections, to triple
72" culverts with concrete end walls. Each culvert. will have rip-rap inlet protection and
rip-rap velocity dissipator outlet protection. Compacted earthen fill will be placed over
the culvert to bring the roadway to the 1 nth a 5 fot. wide curand b et sidewalk will be
varying from 27 fret to 56 feet to width
constructed upon the fill.

Re : Breckenridge Proposed Sanitary Sewer Wetland Impacts
Dear Dan :
The prixnir stream which tarts in a northwesterly direction through Tracts 6 and 7 is
typically bounded on one side by a steep bluff, and on the other side by a less steep area.
The steep bluff is not consistently on the saint side of the creek. It varies along the
length of the run of the creek. Two smaller tributaries which nun in a northerly direction
drain into this primary stream. The topography on either side of these tributaries is
relatively steep, but Lypically stccpci on une side than the other. These three streams
and their associated wedwids divide the area of Tract 6 and 7 into four development
areas, located on both sides of each of the draws. Each of these four areas must be
sewered to outfdlls tuiwing along these draws. Multiple creek crossings are necessary in
order to sewer these areas. It has been our experience, that choosing the locations of
the proposed manholes carefully, placing them and the sewef line which runs between
thent va the flatter side of each draw, minimizes the overall disturbance to the stream
and the overbarik areas on each side.
We have been able to eliminate one of the proposed stream crossing by redesigning the
sewer around the proposed culverts under Willingham Road at the eastern end of Tract.

discharge from your project. This runoff is rmitted pursuant to the National Pollutant Discharge Elimination
System (NPDES) administered In North Caroli by the Division of Water Quality (DWQ). Attached is the General
Stormwater NPDES Permit, NCG01000, as re ised July 1, 1995, covering your activity. You are responsible for
complying with the General Permit requiremen s and are subject to enforcement by DWQ for any violations of the
General Permit.
Wake County's sedimentation polluti control program is pcrformance oriented, requiring protection of
the natural resources and 4oining properties. at any time during this project it is determined that the Erosion and
Sedimentation Control P1ari is inadequate to eet the requirements of the Erosion and Sedimentation Control
Ordinance of Wake County , this office may require revisions in the plan and its implementation to ensure
compliance with the Ordinance. Also, please onsider this letter as notice in accordance with the requirements for
