(NOVA), on behalf of Childress Klein, is requesting a NPDES permit be issued for water generated from dewatering operations during the construction of a new high-rise office building. Once construction below the groundwater table is completed, the collection and discharge of on-site water will be terminated. BACKGROUND INFORMATION The Subject Property consists of six (6) land parcels referenced by Mecklenburg Tax Assessor’s office as Property Identification Numbers (PINs) 12505302, 12505303, 1250304, 1250306, 1250307, and 125308 with correspondi ng addresses 522 South College Street, 518 South College Street, 510 South College Street, 509 South Tryon Street, 521 South Tryon Street, and 525 South Tryon Street, respectively. The Subject Property encompasses a total of approximately 2.09-acres of active construction. A previous Phase II Environmental Site Assessment performed by Anchor QEA dated April 2017 identified soil and groundwater impacts resulting from the historical use of the sub ject Property as a garment cleaning facility, an automotive sales and repair facility, and an automotive painting facility. Petroleum impacts to soils were reported in four (4) of the nine (9) soil borings. Chlorinated solvents above NC DEQ 2L regulations were reported in the groundwater samples in two (2) of the five (5) groundwater monitoring wells installed. NOVA collected groundwater samples from three (3) of the on-site monitoring wells on May 30, 2019. The remaining two (2) monitoring wells were dry at the time of NOVA’s May 2019 sample collection. The collected samples were analyzed for Volatile Organic Compounds (VOCs) by United States Environmental Protection Agency (US EPA) Solid Waste (SW)-846 Method 8260D, Semi-Volatile Organic Compounds (SVOCs) by USEPA SW-846 Method 8270E, Chlorinated Pesticides by USEPA SW-846 Method 8081, and Total and Dissolved Metals by USEPA SW-846 Method 6010D and 7470A. Tetrachloroethylene (0.72-µg/L) and total Chromium (0.029-µg/L, 0.020-µg/L, and 0.024-µg/L) were identified above NC DEQ 2L regulatory standards. Dissolved Chromium was not detected above laboratory detection limits. Foundation construction will extend below the groundwater table which will require dewatering for an estimated period of four (4) months. Currently, dewatering pumps will be placed in the areas of excavation with the water being routed through a pretreatment system prior to discharge into the municipal storm water system located along South Tryon Street and South College Street. The storm drains discharge to an unnamed tributary of Little Sugar Creek, part of the Sugar Creek watershed. The USGS reports provide the following information: Engineering Alternative Analysis August 21, 2019 South College Street and South Tryon Street NOVA Project Number 2019008.1 Page 3 • Drainage Area – 40.80 square miles • Summer/Winter 7Q10 – 34 cubic feet per second (cfs) • 30Q2 Flow Statistics – 87 cfs • W7Q10 Low-Flow Yield – 55 cfs • Qavg Unit Flow Yield – 12 cfs/square mile Little Sugar Creek is listed on the 303(d) as an impaired waterway. The total maximum daily limits (TMDLs) include fecal coliform (9.4x1012 cfu/100mL), dissolved oxygen (no less than 5.0mg/l for the daily average and no less than 4.0mg/l for a minimum instantaneous value during 7Q10 conditions), and turbidity. NON-MUNICIPAL FLOW PROJECTIONS Based on similar construction projects from the Charlotte downtown area, it is estimated that the dewatering pumps will produce a flow rate of approximately 50 gallons per minute (72,000 gallons per day). EVALUATION OF FEASIBLE ALTERNATIVES Alternative A: Connection to Existing Wastewater Treatment System Ms. Sarah Daley, Environmental Compliance Supervisor with Charlotte Water sent a response letter to NOVA on May 28, 2019 stating that they do not accept groundwater discharges as referenced in the City of Charlotte Sewer Use Ordinance Section 23-79 (b)(14). Alternative B: Land Application Based on the proposed new construction occurring from approximately property boundary to property boundary, on-site land application is not feasible due to the limitations of land area available. Due to the location of the project within the downtown area of Charlotte, there is limited land available in the vicinity of the Subject Property. Available land in th is area is currently valued at approximately $5,000,000 to $10,500,000 per acre (supporting information attached) making the purchase of land for the purpose of off-site land application cost prohibitive. A table detailing the cost of off-site land application is included as an attachment. Alternative C: Infiltration Galleries Based on the proposed new construction occurring from approximately property boundary to property boundary, the use of on-site infiltration galleries is not feasible due to the limitations of land area available. Due to the location of the project within the downtown area of Charlotte, there is limited land available in the vicinity of the Subject Property. Available land in this area is currently valued at approximately $5,000,000 to $10,500,000 per acre (supporting information attached) making the purchase of land for the purpose of creating off- site infiltration galleries cost prohibitive. Alternative E: Closed Loop Remediation Wells Based on the proposed new construction utilizing dewatering pumps and occurring from approximately property boundary to property boundary, this alternative is not feasible on-site due to excess water entering the system and the limitation of on-site land available. Additionally, there is limited land available in the vicinity of the Subject Property. Available land in this area is currently valued at approximately $5,000,000 to $10,500,000 per acre (supporting information attached) making the purchase of land for the purpose of installing off-site injection wells cost prohibitive. A table detailing the cost of utilizing off-site closed loop remediation wells is included as an attachment. Alternative G: Discharge to Surface Waters Discharging removed groundwater into the municipal stormwater system located along South Tryon Street and South College Street is feasible for this project. Charlotte Water has approved the use of the storm drain system as it is not anticipated to create hazardous conditions. Neither Mecklenburg County nor City of Charlotte have returned a completed Local Government Review Form. Consequently, the certified mail receipts and delivery tracking information is attached as proof of delivery.
