In response to your email below regarding the 401 submittal for this project, please review our response of how we
intend to ensure that Condition 11.9 of General Water Quality Certification 4134, which requires that work in streams be
conducted in such a way as to prevent the flowing stream from contacting the disturbed area (15A NCAC 02H
.0506(b)(3)] will be met.
We will use the following BMPs to meet the condition:
Using sandbags or rock berms, we will divert flow around the active work area for all in -stream excavation work — both
bank construction and the construction of structures. We will also remove seepage water from the active work area,
routing that water through treatment to remove turbidity prior to allowing it to reenter the stream.
A revised detail has been prepared to reflect this diversion system.

On September 20, 2019, the Division of Water Resources (Division) received your application dated September 20, 2019,
requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that
your application is incomplete and cannot be processed. The application is on hold until the following item is addressed:
There are several inconsistent references to the use of a pump around system in the submittal. Section E.1b. of
the PCN states " a pump around will be employed when necessary to avoid working in the wet." The cover letter
states "It is proposed the stream construction occur in the wet..." The erosion control notes on Sheet 0.3 state
"A pump around is not anticipated to be required." Please clearly explain how you plan to meet Condition 11.9 of
General Water Quality Certification 4134, which requires that work in streams be conducted in such a way as to
prevent the flowing stream from contacting the disturbed area. What BMPs will be used to meet this condition?

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received, the Division will be unable to
approve the application and it will be returned.
