Project Location: Adj to 102 Magnolia Dr, Wilmington, in New Hanover County
Proposed Project: The applicant proposes to excavate a shoaled area within an artificially created
access channel to remove material deposited via a drainage ditch. This channel
has not been excavated for approximately 40 years, and has been determined to
have regained the biological integrity necessary to consider this project as new
dredging, hence, the major permit process. The proposal also addresses the
stabilization of the ditch through the means of 3 check dams.

Dear Mr. Dorney:
Enclosed is the application of Dick Batten for Department of the Army
authorization and a State Water Quality Certification to excavate
approximately 0.69 acre (3,010 square feet) of shallow bottom within an
existing man-made channel off of Hewlett's Creek, adjacnet to 102 Magnolia
Drive in Wilmington, New Hanover County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by April 7, 1997, the District Engineer will deem that
waiver has occurred.

The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located adjacent to 102 Magnolia Dr.. It was received
completed on January 10, 1997, and appears to be adequate for processing at this time. The projected
deadline for making a decision is March 27, 1995. An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree alone the road right-of-way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review,

process. The proposal also addresses the stabilization of the ditch through the means of 3 check

9. Project Description 02/03/97
The project site is a 5.8 acre residential tract at 102 Magnolia Drive off of State Road 1515, adjacent
to Masonboro Sound at the mouth of Hewlett's Creek. The property has elevations ranging from 5'
to 25'. There is a residence on the property. This area is one of older homes occupying large tracts
of land. The property is vegetated with lawn grasses and other landscape vegetation. The adjacent tract
to the south is undeveloped and vegetated with oaks, pines, yaupon and wax myrtle. At the water's
edge there is an escarpment of approximately 1', giving way to marsh vegetation. There is an
artificially created canal extending across several properties, including this one, from Hewlett's Creek.
This canal is parallel to the AIWW, and was originally excavated in the 1950's. The canal terminates
at the south end of the applicant's property. There is a fringe of Spartina alterniflora averaging 25' in
width along the canal. The upper edges of the canal are lined with Juncus roemerianus. Spartina patens,
Borrichia frutescens. and Limonium carolinianum. The canal bottom is very silty, probably due to the
stagnant nature of the canal terminus. Prior to hurricane Fran, the applicant had a pier and dock in the
canal. There are 4 mooring pilings remaining.
The New Hanover County Land Use Plan classifies the area within the scope of the project as
Conservation. The Division of Marine Fisheries has designated the area as Primary Nursery, and the
waters are closed to the taking of shellfish. The Division of Water Quality has classified the waters as
SA-ORW (however, the ORW designation stops at the mouth of Hewlett's Creek). The residences in
this area of the County are served by county sewer services. They utilize private wells.
The applicant wishes to excavate the basin only within an area that has shoaled with sand carried from
a ditch between his property and the property to the north. This material is sandy, and has apparently
been deposited by the excavation of this ditch by the County. The material has accumulated the most
at the mouth of the ditch, and has spread north and south with rising and falling tides. The existing
soundings within the canal range from +.5' mlw, to -2.5' mlw. The applicant wishes to utilize a
dragline to excavate this 215' x 14' shoaled area, placing the material on a barge, and transporting it
approximately 500' to 800' to the north. The finished soundings are to be equivalent to the adjacent
areas of the canal, -1' mlw at the southern end, -1.5' at the middle, and -2.0' at the northern end. The
total cubic yardage to be removed is approximately 125. There is a temporary spoil area designated
at the Ormand property at the northern end of the canal. This area is approximately 84' x 84', and
utilizes silt fencing for temporary stabilization. This should allow for the placement of approximately
780 cubic yards of material. Coastal wetlands will have to be crossed to deposit the spoil in this area.
The applicant proposes to remedy this by the use of mats. Authorization is on file for the use of this
property. After the material is dried, the property owner wishes to use it to replenish his shoreline from
sand lost to Hurricane Fran. There are 4 stump holes averaging 20' x 20', and a stretch of shoreline
that is 180' x 12'. This area should hold approximately 140 cubic yards of dried spoil material,
covering an area of 3760 square feet of high ground. This material is to be contained on site by silt
fencing until stabilized by vegetation. With the exception of the 3 stump holes at the northernmost
extension of the Ormand lot, the area designated for permanent spoil placement is waterward of the
post-hurricane escarpment. While this is not below the mean high water line, it is subject to overwash,
and has lost any buffer that existed between the water and the escarpment. There is approximately 35-
40' between the escarpment and the coastal wetland vegetation, and another 5' to the mean high water
line.

Lastly, the applicant proposes to construct 3 check dams within the existing ditch, to prevent further
erosion of this material into the canal. There will be 3 rock structures - 6' x 3' x 1.5' Q2, and 6' x
9' x 1.5'. The ditch is vegetated with Smilax sue., Magnolia virginica, Phrag_mi_tes australis. scirpus
sue., and honeysuckle along the sides. There is no vegetation within the ditch in the location of the
proposed check dams.
10. ANTICIPATED E%IPACTS
The project as proposed will remove approximately 125 cubic yards of sandy material from
approximately 3010 square feet of shallow bottom area within a created canal; approximately 10,906
square feet of high ground will be filled with the spoil placement and the check dams. The permanent
spoil area is especially vulnerable, and subject to move in lunar tides. Turbidity will increase during
excavation. Marsh grass will have to be crossed for spoil placement. Although the canal is designated
as Primary Nursery, and has not been excavated since the 1950's, site visits and aerial photography
indicate that the material requested for removal is recently deposited sand. There is- no request to
remove the productive bottom area to increase the waterdepth of the canal.
