I talked with Ms. Carol Shaw who told me they have never issued approvals for buffer impacts based on laded rates (i.e., raw impacts x the applicable multiplier). As an example in our September 6, 2005 letter from the EEP to Town of Cary they itemize 5,820 ft2 of Zone 1 impacts and 5,065 ft2 of Zone 2 impacts. EEP recognizes that these numbers are raw impacts and that applicable multipliers will be utilized in conjunction with them because in the paragraph below the table they state: ..."EEP will take responsibility for providing the compensatory mitigation for the permitted impactsup to a 2:1 ratio, (buffers in zone 1 at a 3:1 ratio and zone 2 at a 1.5:1 ratio). Thus, our request in the PCN application on page 12 of 13 is consistent with these figures...i.e., zone 1 5820ft2 x 3 = 17,460 ft2 and 5,065 ft2 x 1.5 = 7,598 ft2. As is seen, our figures on page 12 of 13 matches the information provided in the EEP lettter dated September 6, 2005 (attached to the PCN application). To clarify, we are requesting mitigation through the fund at the loaded limits outlined in both the letter and page 12 ...i.e., Zone 1 17,460 ft2 and Zone 2 7,598 ft2.
