To assist you in assessing endangered species presence, this office maintains a list of Federally-endangered and threatened species by county within North Carolina. Habitat requirements for the Federally- listed species in the project area should be compared with the available habitat at the project site. If appropriate habitat is present, surveys for the species should be performed, and survey methodologies and results forwarded to the Federal agency that is authorizing, funding, or carrying out the proposed action. That agency will be responsible for determining effects the project may have on the Federally-listed species, and forwarding- that determination to the Service for concurrence. If a Federal agency is not involved in the proposed project, the survey results may be forwarded to this office for a technical assistance review. The attached page identifies the Federally-listed endangered, threatened, and candidate species which occur in Nash County. Candidate species refer to any species being considered by the Service for listing as endangered or threatened but not yet the subject of a proposed rule. These species are not legally protected under the Act or subject: to its provisions, including Section 7, until formally proposed or listed as threatened or endangered. New data could result in the formal listing of a candidate species. This change would place the species under the full protection of the Endangered Species Act, and necessitate a new survey if its status in the project corridor is unknown. Therefore, it would be prudent for the project to avoid any adverse impact to candidate species or their habitat. The North Carolina Natural Heritage Program should be contacted for information on species under State protection. If the proposed project will be removing pines greater than or equal to 30 years of age, or have a DBH greater than or equal to 9 inches, in pine or pine/hardwood habitat, surveys would be conducted for active red-cockaded woodpecker cavity trees in appropriate habitat within a 1/2 mile radius of project boundaries. If red-cockaded woodpeckers are observed within the project area or active cavity trees are found, the project has the potential to adversely affect the red-cockaded woodpecker, and you should contact this office for further information. The Service's ability to inform you of the presence of endangered species on your project area would be greatly facilitated if your request contained the following information: 1. To assist you in assessing endangered species presence, this office maintains a list of Federally-endangered and threatened species by county within North Carolina. Habitat requirements for the Federally- listed species in the project area should be compared with the available habitat at the project site. If appropriate habitat is present, surveys for the species should be performed, and survey methodologies and results forwarded to the Federal agency that is authorizing, funding, or carrying out the proposed action. That agency will be responsible for determining effects the project may have on the Federally-listed species, and forwarding that determination to the Service for concurrence. If a Federal agency is not involved in the proposed project, the survey results may be forwarded to this office for a technical assistance review. The attached page identifies the Federally-listed endangered, threatened, and candidate species which occur in Nash County. Candidate species refer to any species being considered by the Service for listing as endangered or threatened but not yet the subject of a proposed rule. These species are not legally protected under the Act or subject to its provisions, including Section 7, until formally proposed or listed as threatened or endangered. New data could result in the formal listing of a candidate species. This change would place the species under the full protection of the Endangered Species Act, and necessitate a new survey if its status in the project corridor is unknown. Therefore, it would be prudent for the project to avoid any adverse impact to candidate species or their habitat. The North Carolina Natural Heritage Program should be contacted for information on species under State protection. If the proposed project will be removing pines greater than or equal to 30 years of age, or have a DBH greater than or equal to 9 inches, in pine or pine/hardwood habitat, surveys would be .t conducted for active red-cockaded woodpecker cavity trees in appropriate habitat within a 1/2 mile radius of project boundaries. If red-cockaded woodpeckers are observed within the project area or active cavity trees are found, the project has the potential to adversely affect the red-cockaded woodpecker, and you should contact this office for further information. The Service's ability to inform you of the presence of endangered species on your project area would be greatly facilitated if your request contained the following information: 1. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, pollutant removal and aquatic life habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) unless the issues outlined below are successfully addressed. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. As I discussed on the phone with Mr. Joyner, we believe that you have two feasible design options in order to allow us to issue the 401 Certification: 1) shift the proposed buildings along US 301 to the south as shown on the attached sketch. This would reduce wetland impacts to less than or equal to one-third acre; or 2) agree in writing to preserve the existing pond downslope of the wetland along Compass Creek with a deed restriction or conservation easement. This pond would then serve as stormwater management for the development (existing and future). If reconfiguration of the pond is needed a littoral shelf planted with freshwater marsh species would be helpful to filter runoff. In any event, a maintenance agreement would be needed to ensure the long time functioning of the pond. Any documentation such as maps and narrative that you can supply to address altemative designs for your project may be helpful in our review of your 401 Certification. Please respond within two weeks of the date of this letter by sending a copy of this information to me and one copy to Mr. Eric Fleek at the Raleigh Regional Office at 3800 Barrett Drive, Raleigh, NC 27609. The EA was conducted in accordance with the 1987 Corps of Engineers Manual for Identifying and Delineating wetlands. The Daniels Property comprises approximately 33 acres and is located in the southeast quadrant of the intersection of US 301 by-pass and Compass Creek. The property is bordered by US 301 by-pass to the west, Compass Creek to the North, Atlantic Coast Railroad to the east and the Nash Brick Company to the south. The site is currently zoned as Industrial. The Daniels property was previously owned by the Nash Brick Company. The property appears to have been mined for clay as indicated by the uneven terrain, deep borrow pits and large spoil piles. Two of the deepest borrow pits approximately 0.46 acres and 0.13 acres appear to maintain an apparent surface water depth of 3 to 24 inches. A dug ditch approximately 6 to 8 ft wide and 8 to 10 feet deep connects directly to the largest wetland area. The ditch may indirectly connect the smaller 0.13 acre wetland hydraulically by a shallow water table. This ditch begins on the adjacent property to the south and appears to flow north into the two wetlands on the subject property. Mr. Eric Alsmeyer with the Corps of Engineers has determined that the dug ditch is not a jurisdictional wetland. Standing erect, pine snags 1 to 3 inches in diameter and 6 to 10 feet tall cover the deeper water areas of the larger wetland and ditch are indicative of a drier climate prior to the ditch being dug. Presently an area comprised of hydrophetic vegetation such as common Nettle Rush (Juncus effussus) and Sweetgum (Liguidambar styraciflua) occur along the wetland fringe between nonwetland and the deeper water that is 12 to 24 inches deep. The deeper water areas are unvegetated. This condition is similar to the dug ditch in that no vegetation is present. These two wetland areas are surrounded by the well drained Bonneau Soils (Arenic Paleudults) and Udorthents, loamy borrow pit. This map unit consists of areas where the natural soil layering sequence has been destroyed by earthmoving machines. Such operations as scraping, backfilling, trenching, or excavating have completely altered the characteristics of the soil such that it no longer can be identified with the original series. The remainder of the site consists of 10 to 15 year old Loblolly Pines. Mr. Eric Alsmeyer, Field Biologist for the US Army Corps of Engineers and I met on May 8, 1996 for an onsite concurrence of the flagged wetland delineation. Enclosed is a color coded map showing the results of our concurrence meeting. As indicated there is a combined total of approximately 0.59 acres within the two primary wetland areas. These two wetlands were determined to be located above the headwaters during our visit and should be permittable for fill under Nationwide Permit No. 26. Mr. Danny Smith and I met on site in June 1996 for a pre application meeting to discuss the needs for a water quality certification. The wetland rating system forms prepared for the site by Mr. Smith will be forwarded as quickly as they are made available to Appian. The USF&W Service was contacted on June 4, 1996 for information concerning endangered and threatened species. No known occurrence of the federally listed threatened or endangered species was identified for the property. The State Historic Preservation Office of the NC Division of Archives and History was contacted on June 5, 1996 to determine if any historic structures were located on the property. No reply has been forthcoming; however, there are no known structures on the property. Enclosed for you perusal are documents pertaining to the property. These documents include the following: Nash County Soil Survey Map #9, USGS Topographic Map, Data Forms, USF &W Service Correspondence, hand drawn wetland map and Utility map of property showing the partially developed. Currently the wetland line is being surveyed by Joyner Keeny and Associates. Once complete a copy will be forwarded to you. The Utility Map shows the two currently unsurveyd wetlands (ponds). The larger wetland area drains to the north into the non jurisdictional wetland (4 acre lake) to the north. The 3 to 4 ft wide ditch running east and entering the railroad ditch does not connect to either wetland and is formed by surface water running off the developed site. The undeveloped portion of this tract is planted to grass. This ditch was cut through well drained soils on high ground. Mr. Dorney, we would like to fill the two wetlands identified as approximately 0.46 acres and 0.13 acres. The total estimated impact would be approximately 0.59 acres. Based on the enclosed information and the historic disturbance associated with the site will a 401 Water Quality Certification be needed to fill these wetlands? To assist you in assessing endangered species presence, this office maintains a list of Federally-endangered and threatened species by county within North Carolina. Habitat requirements for the Federally- listed species in the project area should be compared with the available habitat at the project site. If appropriate habitat is present, surveys for the species should be performed, and survey methodologies and results forwarded to the Federal agency that is authorizing, funding, or carrying out the proposed action. That agency will be responsible for determining effects the project may have on the Federally-listed species, and forwarding that determination to the Service for concurrence. If a Federal agency is not involved in the proposed project, the survey results may be forwarded to this office for a technical assistance review. The attached page identifies the Federally-listed endangered, threatened, and candidate species which occur in Nash County. Candidate species refer to any species being considered by the Service for listing as endangered or threatened but not yet the subject of a proposed rule.` These species are not legally protected under the Act or subject to its provisions, including Section 7, until formally proposed or listed as threatened or endangered. New data could result in the formal listing of a candidate species. This change would place the species under the full protection of the Endangered Species Act, and necessitate a new survey if its status in the project corridor is unknown. Therefore, it would be prudent for the project to avoid any adverse impact to candidate species or their habitat. The North Carolina Natural Heritage Program should be contacted for information on species under State protection. If the proposed project will be removing pines greater than or equal to 30 years of age, or have a DBH greater than 4RECpgUAl to 9 inches, in pine or pine/hardwood habitat, surveys would be SE"r 2 01996 ENVIRONMENTAL SCIENCES PRANCH conducted for active red-cockaded woodpecker cavity trees in appropriate habitat within a 1/2 mile radius of project boundaries. If red-cockaded woodpeckers are observed within the project area or active cavity trees are found, the project has the potential to adversely affect the red-cockaded woodpecker, and you should contact this office for further information. The Service's ability to inform you of the presence of endangered species on your project area would be greatly facilitated if your request contained the following information: 1. A specific description of the proposed action to be considered. 2. Acreage of habitat, by .cover type, that will uc impacted. The Service appreciates the opportunity to comment on this matter.
