You have our approval, in accordance with the attached conditions, to place fill material in 0.018 acres
of wetlands or waters for the purpose of constructing irrigation lakes at Sunset Hills Golf Course, as you
described in your application dated 18 March 1997. After reviewing your application, we have decided that
this fill is covered by General Water Quality Certification Number 3108. This Certification allows you to
use Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed 6ne acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The purpose of this letter is to request a Nationwide Permit 26 and 401 Water Quality Certification
for the project known as the Sunset Hills Golf Course Irrigation Lakes. The proposed activity is
on lands managed and owned by Mecklenburg County as a public golfing facility. This is an
existing golf course.
The county proposes to flood un-vegetated deeply incised non-meandering channels for the purpose
of creating two irrigation lakes. The existing channels are grassed to their bank which are actively
managed as part of the golf course. Currently there is no buffer, other than mowed fescue grass, to
prevent the inflow of nutrients or pollutants into the existing channel and drainage system. hi other
words, all sheet flow enters the channel directly.
Approximately 1400 if of this low quality channel will be flooded by the proposed activity and
minor discharges (approximately 800 sf) will be necessary for the construction of the dams. The
resultant jurisdictional areas is larger than the proposed impact area and the proposed activity is by
default a stormwater and water quality feature. Therefore the project itself should serve as more
than adequate mitigation for the permit.
Total impacts to channels will be 13201f (0.30 ac) while the linear footage of channel loss is 80 if
(0.018 ac). It is our understanding that flooding constitutes an impact but not a loss and therefore
the linear footage of flooding should not count against the maximum 500 if of loss allowable under
Nationwide Permit 26.
The proposed activity is arguably a positive impact on the existing wetland and drainage systems
because it provides a mechanism to improve water quality and increase jurisdictional limits, The
activity will flood, not fill nor excavate the existing channel, and will result in more jurisdictional
waters of the US (approximately 11.5 ac.) and vegetated wetlands. The proposal to construct two
lakes with littoral benches within the golf course will provide for water quality measures that are
typically required for new courses and will result in vegetated wetlands where none currently exist.
This is an opportunity to obtain water quality protection far an existing facility which would not
otherwise be require to proved such protection.
The proposed pond will be constructed with littoral benches. These benches will provide both a
safety feature for the public and water quality enhancement mechanism.
