(Harbinger) Josh/Billy, Just following up with some additional information I found (yesterday, after I'd e-mailed Josh) in our files that relates to Ms. Olsen's project. It's a CAMA Major Permit application for the community lot in the Cypress Point 11 neighborhood, which is adjacent to Ms. Olsen's property to the north, and it shows/includes the general conditions of the entire shoreline before the majority of development in the community occurred. In particular, I just wanted to check to see if you had/know of any records of any permits/delineations being issued/done on your end for the lot to the south of Ms. Olsen (208 Waterside Drive), because looking at the Google Earth aerials, it looks like a pool was built sometime between 2013 and 2016 in an area that the 2000 CAMA application suggests could have been wet. At this point, it appears that DWR may be moving towards denial of Ms. Olsen's project, but like I mentioned in the previous e-mail to Josh, I also wanted to get the Corps' general opinion of the project before pressing forward. I included Billy this time just because I figured he might have some additional site history/background, since he'd done the delineation included in the application. From some of the responses I received to my additional information request, if the pool required any permitting, I'd guess that it didn't go through the process(es), as the homeowner's association acknowledges that the pool didn't receive permission from their Board for the pool, but the raising of the grade/fill associated with the pool is a likely reason for why Ms. Olsen is requesting the fill on her lot. Cypress Point II Homeowners Association Field Investigation Report Page Two Project Setting The Cypress Point II Homeowners Association Incorporated, owns a 20,000 square -foot parcel of land on the west side of Waterside Drive within a 32 lot single-family subdivision located in the Harbinger Community, Currituck County, adjacent Albemarle Sound. The lot, which was recently conveyed to the Association by the developer, is approximately 400 feet deep and fronts the Albemarle Sound for a distance of almost 70 linear feet. To access the site, turn west onto Edgewater Road (SR 1104) off U.S. Highway 158. At the intersection of Edgewater and Harbinger Ridge Road, turn right. After traveling 300 feet turn left onto Reggie Owens Drive. The project site lies about 200 feet south of the west end of Reggie Owens Drive. Elevation of the lot ranges F-4' above mean sea level. Vegetation noted on the lot includes large pines, sweet gum, cypress, and common reed. Immediately landward of the NWL there is a 15' wide sandy beach and landward of the beach there is a 30'-40' wide, 2' tall vegetated berm. Some non -coastal wetlands were noted in the area located between the vegetated berm and Waterside Drive. Elevation and vegetative cover of the undeveloped residential lot to the south is similar to that of the subject parcel. Development on the abutting lot to the north includes a wooden retaining wall which has been installed just landward of the sandy beach and approximately 15' landward of NNN'L. Approximately 180' to the south of the subject lot there is a 4' x 36' long pier with 10' x 10' platform at the waterward end. Eight hundred feet to the north of the project site there are cypress stumps located as far out as 300 feet into Albemarle Sound. Man-made features on the tract consist of a 6' x 400' long elevated walkway which extends from the road to the sandy beach and a 12' x 20' concrete pad which is located on the berm just landward of the sandy beach. The waters of Albemarle Sound in the vicinity of the project are classified as SB by the NC Division of Environmental Management. These waters are classified as Coastal Fishing Waters by the NC Marine Fisheries Commission and the NC Wildlife Resources Commission and as Estuarine Waters and Public Trust Waters by the NC Coastal Resources Commission. Water depths in the project area (out to 165' in the sound) measure V-4' below NWL. Although there were none in the project area, cypress knees were present in front of adjacent properties approximately 10'-20' beyond NWL. The presence of submerged aquatic vegetation was not noted in the vicinity of the project. Review of available information suggest that there are no known archelogical sites or geological formations associated with the applicant's property. Cypress Point II Homeowners Association Field Investigation Report Page Three Project Description The applicant proposes to construct a 6' x 150' pier with a 14' x 16' platform covered with a 288 sq. ft. roof, a 4' x 14' step-down swim platform, a 4' x 32' triangular finger pier, and install five mooring pilings to create two 12' x 22' boat slips. The pier/platform pilings will be set back a distance of 15' from the riparian access line on the south and approximately 28' from the riparian access line on the north side. No dredging is proposed as part of this project. Water depth at the end of the pier is 4' below NWL. Anticipated Impacts 1) Construction of the pier, roofed platform, a swim platform and finger pier will shade 1260 square feet of shallow water habitat. 2) Temporarily, localized turbidity will occur as a result of the construction of the pier. platform, and mooring slips. Cypress Point II Homeowners Association Field Investigation Report Page Two Project Setting The Cypress Point II Homeowners Association Incorporated, owns a 20,000 square -foot parcel of land on the west side of Waterside Drive within a 32 lot single-family subdivision located in the Harbinger Community, Currituck County, adjacent Albemarle Sound. The lot, which was recently conveyed to the Association by the developer, is approximately 400 feet deep and fronts the Albemarle Sound for a distance of almost 70 linear feet. To access the site, turn west onto Edgewater Road (SR 1104) off U.S. Highway 158. At the intersection of Edgewater and Harbinger Ridge Road, turn right. After traveling 300 feet turn left onto Reggie Owens Drive. The project site lies about 200 feet south of the west end of Reggie Owens Drive. Elevation of the lot ranges 1'-4' above mean sea level. Vegetation noted on the lot includes large pines, sweet gum, cypress, and common reed. Immediatelv landward of the NWL tbef is a 15' wide sandy beach and landward -of the beach there is a 30'-40' wide, 2' tall vegetated "e"6. Some non -coastal wetlands were noted in the area located between the vegetated berm and Waterside Drive. Elevation and vegetative cover of the undeveloped residential lot to the south is similar to that of the subject parcel. Development on the abutting lot to the north includes a wooden retaining wall which has been installed just landward of the sandv beach and approximately 15' landward of N vN1. Approximately 180' to the south of the subject lot there is a 4' x 36' long pier with 10' x 10' platform at the waterward end. Eight hundred feet to the north of the project site there are cypress stumps located as far out as 300 feet into Albemarle Sound. Man-made features on the tract consist of a 6' x 400' long elevated walkway which extends from the road to the sandy beach and a 12' x 20' concrete pad which is located on the berm just landward of the sandy beach. The waters of Albemarle Sound in the vicinity of the project are classified as SB by the NC Division of Environmental Management. These waters are classified as Coastal Fishing Waters by the NC Marine Fisheries Commission and the NC Wildlife Resources Commission and as Estuarine Waters and Public Trust Waters by the NC Coastal Resources Commission. Water depths in the project area (out to 165' in the sound) measure F-4' below NWL. Although there were none in the project area, cypress knees were present in front of adjacent properties approximately 10'-20' beyond NWL. The presence of submerged aquatic vegetation was not noted in the vicinity of the project. Review of available information suggest that there are no known archelogical sites or geological formations associated with the applicant's property. Cypress Point Il Homeowners Association Field Investigation Report Page Three Project Description The applicant proposes to construct a 6' x 150' pier with a 14' x 16' platform covered with a 288 sq. ft. roof, a 4' x 14' step-down swim platform, a 4' x 32' triangular finger pier, and install five mooring pilings to create two 12' x 22' boat slips. The pier/platform pilings will be set back a distance of 15' from the riparian access line on the south and approximately 28' from the riparian access line on the north side. No dredging is proposed as part of this project. Water depth at the end of the pier is 4' below NWL.
