The site is located on Idlewild Road in both Mecklenburg and Union counties, North Carolina, with impacts being located in Union County. Impacts associated with this request include 296 linear feet of permanent impacts to jurisdictional non -wetland Waters of the US and 0.0119 acres of impacts to jurisdictional wetlands Waters of the US. We are also requesting a 401 WQC from NC DWR for the above referenced impacts. A preliminary Jurisdictional Determination request was received by the Army Corps Asheville Field Office on behalf of the Charlotte Field Office on 08/01/18, with a site visit conducted by Mr. David Shaeffer on 09/14/18. The revised approximate depiction of aquatic resources based upon the results of this site visit is included with this notification. Project Purpose and Need The purpose of the proposed project is to construct a residential subdivision to meet the growing demand for housing within the region. Project Description The proposed project consists of the proposed development, appurtenant parking and infrastructure, stormwater facilities, and connection to an existing on-site sanitary sewer system. 296 linear feet of permanent impacts to Tributary 3 are necessary for two road crossings in order to access high ground. 0.0119 acres of permanent impacts to Wetland A100 (W2 on impact exhibit) are proposed in order to support parking facilities. The site will be constructed under an approved sediment and erosion control plan in order to minimize risk of materials incidental to construction activities being transported into downstream receiving waters. Avoidance and Minimization The project has been carefully designed to minimize impacts to aquatic resources to the maximum extent practicable. Headwalls will be utilized on both the upstream and downstream portions of both proposed road crossings in order minimize stream disturbance. Temporary impacts for pump -around will be located within the proposed impact areas. A large retaining wall (approximately 125 linear feet) is being proposed adjacent to Wetland Impact 1 in order to minimize impacts to the maximum extent practicable. Compensatory Mitieation In order to mitigate for unavoidable losses, the applicant proposes to provide compensatory mitigation for permanent culvert stream impacts at a 2:1 ratio. The riprap energy dissipators will be pressed into the stream bed at existing elevation in order to maintain aquatic life passage; thus, compensatory mitigation is not proposed for riprap impacts. As impacts to jurisdictional wetlands are less than 1/10th acre and assessed to be no more than minimal, compensatory mitigation is not proposed for these impacts. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved.
