4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
This site is in the heart of Downtown Boone in Watauga County, NC near the campus of Appalachian State University. Primary land uses in the vicinity include student housing and
apartments, commercial and transportation. The project property is used for small businesses on the left bank and a parking garage on the right bank.

4h. Explain the purpose of the proposed project:*
The purpose of the project is to stabilize eroding stream banks on Boone Creek as well as repair a building toe of the building on the left bank. The building toe of the business on the
left bank of Boone Creek will be repaired and stabilized to avoid more undercutting in the future. Urban development within the watershed has caused degradation of the reach, so
streambank benching and sloping, natural channel structures, and a planted riparian forest buffer will be implemented to restore this portion of the stream.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The project will provide bank stabilization and grade control using natural channel design structures (1 j -hook). A bankfull bench will be constructed ,banks will be sloped and stabilized
using coir matting/live stakes and a riparian buffer of native woody vegetation will be planted where possible. Equipment used for this proposed construction may include track -hoes,
skid steers, and dump trucks.

1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
The proposed work and associated impacts are intended to stabilize approximately 38 In ft of stream bank along Boone Creek as well as repair and
protect the toe of the building from structural failure. Design measures which minimize impacts include installation of natural channel design structures
which will improve stream stability and provide habitat. All disturbed buffer areas will be immediately seeded upon completion, matted (coir matting)
and stabilized at the close of each day.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
All streambank disturbances will be stabilized same day and covered with coir matting and live staked to reduce sedimentation during construction.
Only well maintained equipment will be used; no leaks will be tolerated. Equipment will work from streambanks whenever possible while performing the
work and will only work in the channel when absolutely necessary. Following construction the banks of the restored channel will be seeded with a mix
of rye (temporary cover) and perennial grasses and clover (permanent seed). The disturbed riparian buffer will be live -staked, seeded, and planted
with native woody vegetation.

BFEC completed the USFW IPaC regulatory review process. BFEC then reviewed information for each species listed on the provided species list,using
the Asheville Ecological Services Field Office pace and USFWS fact sheets. No Critical Habitat is located at this site. Habitat requirements are not met
for the species on the list due to specific habitat requirements such as high elevation rocky outcrops/summits or spruce fir forest. No known caves
are located at the project site. No bat maternity roosts are known on site and mature trees are not present in the project area.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be"waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review
area that could be affected by the proposed activity, based on the following
information:

Subject: Consistency letter for the 'Haircut 101' project indicating that any take of the northern
long-eared bat that may occur as a result of the Action is not prohibited under the ESA
Section 4(d) rule adopted for this species at 50 CFR §17.40(o).
Dear Jordan Bailey:
The U.S. Fish and Wildlife Service (Service) received on October 03, 2019 your effects
determination for the 'Haircut 101' (the Action) using the northern long-eared bat (Myotis
septentrionalis) key within the Information for Planning and Consultation (IPaC) system. You
indicated that no Federal agencies are involved in funding or authorizing this Action. This IPaC
key assists users in determining whether a non -Federal action may cause "take"til of the northern
long-eared bat that is prohibited under the Endangered Species Act of 1973 (ESA) (87 Stat.884,
as amended; 16 U.S.C. 1531 et seq.).
Based upon your IPaC submission, any take of the northern long-eared bat that may occur as a
result of the Action is not prohibited under the ESA Section 4(d) rule adopted for this species at
50 CFR §17.40(o). Unless the Service advises you within 30 days of the date of this letter that
your IPaC-assisted determination was incorrect, this letter verifies that the Action is not likely to
result in unauthorized take of the northern long-eared bat.
Please report to our office any changes to the information about the Action that you entered into
IPaC, the results of any bat surveys conducted in the Action area, and any dead, injured, or sick
northern long-eared bats that are found during Action implementation.
If your Action proceeds as described and no additional information about the Action's effects on
species protected under the ESA becomes available, no further coordination with the Service is
required with respect to the northern long-eared bat.
The IPaC-assisted determination for the northern long-eared bat does not apply to the following
ESA -protected species that also may occur in your Action area:
• Blue Ridge Goldenrod, Solidago spithamaea (Threatened)
• Carolina Northern Flying Squirrel, Glaucomys sabrinus coloratus (Endangered)

INSPECTION AND MAINTENANCE:

structures (J -Hooks, Cross vanes, etc.) and planting of the stream
banks and riparian areas. In the event that the stream structures
shift, wash away, settle, or otherwise physically cannot function as
designed, contact the area NRCS Agent. If the new plantings
experience a mortality rate of greater than 25%, the dead/dying
plants will need to be replaced.

Seedbed Preparation:
Disturbed soils within riparian areas will be amended to provide an
optimum environment for seed germination and seedling growth.
Surface soils will be loose enough for water infiltration and root
penetration. Lime will be added to the soil to ensure a pH level
between 5.5 - 7. Fertilizer (18-46-0) will be added to nutrient deficient
areas. All riparian areas will be raked to loosen compacted soil prior to
seeding.
