Division of Water Resources' Central and Regional staff has reviewed the application package
received August 7, 2019. However, additional information is required before the review may be completed.
Please address the items on the attached pages no later than the close of business on November 11, 2019.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through C, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete.
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed and dated (where needed), with two paper
copies and one electronic copy submitted to my attention at the address below.

A. Signature Authority:
Per Application Instruction A of FORM: DCAR 06-16 and 15A NCAC -2T .0106(b)(4), the
Applicant's Certification on page 3 of the DCAR 06-16 form shall be signed by an executive
officer, elected official in the highest level of elected office, or any authorized employee. Please
either submit a delegation letter pursuant to the requirements in 15A NCAC 02T .0106(c)
authorizing Mr. Lee Smith to sign on behalf of the Applicant, or resubmit the application with the
proper signing official.
B. Operation & Maintenance Plan 115A NCAC 02T .1110 a :
1. The submitted Operation and Maintenance Plan does not meet the requirements for a residuals
management program listed in Application Instruction H of FORM: DCAR 06-16 and the 15A
NCAC 02T .I 100 rules. According to 15A NCAC 02T .I I I0(a), the Permittee shall maintain a
Division -approved Operation and Maintenance Plan that shall include:
a. Description of the program, and associated facilities and equipment, in sufficient detail to show
what operations are necessary for the program to function and by whom the functions are to be
conducted;
b. Description of anticipated maintenance of facilities and equipment associated with the
program;
c. Include provisions for safety measures, including restriction of access to sites and equipment;
d. Spill control provisions:
i. Response to upsets and bypasses including control, containment, and remediation; and
ii. Contact information for plant personnel, emergency responders, and regulatory agencies;
e. Detailed inspection procedures:
i. Names or titles of personnel responsible for conducting inspections;
ii. Frequency and location of inspections, and procedures to assure that the selected locations
and inspection frequency are representative of the residuals management program; and
iii. Description of record keeping and actions to be taken by the inspector in the event that
noncompliance is observed;
f. Detailed sampling and monitoring procedures:
i. Names or titles of personnel responsible for conducting sampling and monitoring;
ii. Description of monitoring procedures including parameters to be monitored; and
iii. Sampling frequency and procedures to assure that representative samples are collected.
Fluctuation in temperature, flow, and other operating conditions can affect the quality of
the residuals gathered during a particular sampling event. The sampling plan shall account
for any foreseen fluctuations in residuals quality and indicate the most limiting times for
residuals to meet pathogen and vector attraction reduction requirements.
The Permittee shall submit an updated Operation and Maintenance Plan that meets all of the above
requirements. Please pay attention to Application Instruction H in the DCAR 06-16 form for more
specific details of what this plan should contain.

C. Product Information Sheet:
In accordance with 15A NCAC 02T .1109(c), Class A residuals that are to be sold or given away
shall either have a label affixed to the bag or other container, or an information sheet shall be
provided to the person who receives the residuals. The label or information sheet shall contain the
following information:
i. the name and address of the person who prepared the residuals;
ii. a statement that land application of the residuals is prohibited except with the instructions
on the label or information sheet; and
iii. that residuals must be applied at agronomic rates and recommended rates for intended uses.
The Permittee shall submit a product label or information sheet that meets the above requirements.
Please pay attention to Application Instruction D in the DCAR 06-16 form for more specific details
of what this information sheet should contain.
