Division of Water Quality (DWQ) for a 401 Water Quality Certification to impact 4.34 acres of wetlands or waters for your project (development of a commercial building) located at US 64/264 and NC 345 in Dare County. This review will likely require an on-site inspection prior to the approval, modification or denial of your project site. If you have sent additional information to the U.S. Army Corps of Engineers concerning this project, please be certain that our staff have copies of this material so we can use it in our process in making a decision. According to our preliminary, in-house review since you propose to disturb greater than one acre of wetlands, it is likely that compensatory mitigation will be required by DWQ for this project as described in 15A NCAC 211.0506 (h). Our Regional Office staff can make this decision during their site visit. If adequate mitigation is required but not provided, this project will likely have to be denied. Also if a mitigation plan is required, we will place this project on hold until its receipt in our Central Office. Enclosed are materials describing compensatory mitigation requirements for this program. Please call me at 919-733-1786 to discuss these matters if necessary. Until a mitigation plan is provided, this application is considered to be incomplete and our processing time will not start. We recommend that you not impact any wetlands or waters on your project site until a 401 Water Quality Certification has been issued from Raleigh, The issuance of a Corps of Engineers 404 Permit does not mean that your project can proceed According to the Clean Water Act, the 404 Permit is not valid until a 401 Certification is also issued. If DWQ staff observe impacts which are not allowable, you will be required to remove the fill and restore the site to its original condition. Private projects in the area have recently been received by the Division of Water Quality (DWQ). One project by Mr. Rudolph Collins is to develop a Food Lion Shopping Center near the NC 345/US 64-264 intersection. A map supplied by the consultant for that project indicated that there would be direct access to the Manteo Bypass. A recent application for a mining permit from the Bamhill Construction Company on behalf of Mr. Rudolph Collins concerns land adjacent to the proposed Food Lion Shopping Center. We believe that this mine is being developed as a source of borrow for the US 64-264 causeway. The resource agencies' policy has been to require compensatory wetland mitigation for impacts due to borrow or wasting within wetlands. We re- emphasised this policy in our February 12, 1997 letter stating that DOT should require the contractor to locate suitable borrow in upland sites. The mining permit did not have a wetland delineation line on it. However, the Food Lion Shopping Center map shows wetlands continuing on the adjacent property. The issue of partial / no control of access continues to be of concern to DWQ due to cumulative wetland impacts. The purpose of the project is to improve hurricane evacuation and bypass Manteo to reduce some of the "through traffic". DWQ has been told from the initial stages of this project that there would be "full control of access where possible, thereby limiting new development / roadside interference" (August 19, 1993 handout). Since we have already received projects with known wetland impacts due to the road construction, DWQ suggests that DOT select one of these strategies for the FONSI: 1) change to full control of access or 2) fully discuss secondary and cumulative impacts to wetlands and waters. Should the FONSI be released without one of these strategies, we will object to the document. In my April 28 letter, I requested that you immediately submit additional information regarding avoidance, minimization, and compensatory mitigation for proposed wetland impacts associated with your project. To date, my staff has not received this information, which is critical to our expeditious evaluation of your application. It was discovered during the above mentioned telephone conversation, that it may be some time before the requested information is made available to my staff. Additionally, we have learned that the North Carolina Division of Water Quality has suspended their review of your project pending receipt of an acceptable mitigation plan. Based upon these facts, my staff is unable to proceed with the evaluation of your application. RUDOLPH COLLINS, c/o GARY MITCHELL AND ASSOCIATES, INC., 128 NORTH HARDING STREET, GREENVILLE, NORTH CAROLINA 27858, Telephone (919) 752-4077, has applied for a Department of the Army permit TO DISCHARGE FILL MATERIAL INTO 4.34 ACRES OF SECTION 404 WETLANDS FOR THE PURPOSE OF FACILITATING THE CONSTRUCTION OF A BUILDING PAD, INCLUDING PARKING, TO ALLOW FOR COMMERCIAL DEVELOPMENT, LOCATED ON THE SOUTHEAST CORNER OF THE U.S. 64/264 AND NC 345 INTERSECTION, ROANOKE ISLAND, NAGS HEAD TOWNSHIP, DARE COUNTY, NORTH CAROLINA. The following description of the work is taken from data provided by the applicant and from observations made during an onsite inspection on February 25, 1997, by a representative of the Corps of Engineers. Plans submitted with the application show that the applicant proposes to fill 4.34 acres of wetlands primarily vegetated with loblolly pine, sweetbay, redbay, sweetgum, wateroak, cinnamon fern, and assorted wetland herbaceous undergrowth. The fill area will be approximately 395 feet wide by 480 feet long with the ultimate fill area within wetlands of 189,050 square feet (4.34 ac.). The purpose of the work is to create a building pad for the construction of a commercial facility. Plans showing the work are included with this public notice. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the' North Carolina Division of Coastal Management (NCDCM) for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management (NCDEM). b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management (NCDCM). -2- c. The issuance of a permit under the North Carolina Coastal Area Management Act (CAMA) by the North Carolina Division of Coastal Management (NCDCM) or their delegates. d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration (NCDA) and the North Carolina Council of State. e. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources (NCDLR), pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested Department of the Army (DA) permit will be denied if any required State or local authorization and/or certification is denied. No DA permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archaeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on -3- the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Additional information regarding the Clean Water Act certification may be reviewed at'the offices of the Environmental Operations Section, North Carolina Division of Environmental Management (NCDEM), Salisbury Street, Archdale Building, Raleigh, North Carolina. The applicant has agreed to discuss potential on-site mitigation in order to compensate for potential wetland losses associated with the project. The following description of the work is taken from data provided by the applicant and from observations made during an onsite inspection on February 25, 1997, by a representative of the Corps of Engineers. Plans submitted with the application show that the applicant proposes to fill 4.34 acres of wetlands primarily vegetated with loblolly pine, sweetbay, redbay, sweetgum, wateroak, cinnamon fern, and assorted wetland herbaceous undergrowth. The fill area will be approximately 395 feet wide by 480 feet long with the ultimate fill area within wetlands of 189,050 square feet (4.34 ac.). The purpose of the work is to create a building pad for the construction of a commercial facility. Plans showing the work are included with this public notice. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management (NCDCM) for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management (NCDEM). b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management (NCDCM). 1 -2- c. The issuance of a permit under the North Carolina Coastal Area Management Act (CAMA) by the North Carolina Division of Coastal Management (NCDCM) or their delegates. d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by *the North Carolina Department of Administration (NCDA) and the North Carolina Council of State. e. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources (NCDLR), pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). - - The requested Department of the Army (DA) permit will be denied if any required State or local authorization and/or certification is denied. No DA permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Enaineers. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archaeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on -3- the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal.
