You have our approval, in accordance with the attached conditions, to place fill material in 0.10 acres of
wetlands or waters for residential use at your property between Pamlico Sound and NC 12, as you described in
your application dated 4 March 1997. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3112.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project. including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mr. Dorney:
Please reference the application of Carroll Gray for Department of the
Army (DA) authorization and a State Water Quality Certification to place fill
material within Section 404 wetlands, on property located off N.C. Highway 12,
adjacent the Pamlico Sound, in Buxton, Dare County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by April 29, 1997, the District Engineer will deem that
waiver has occurred.

8. PROJECT SUMMARY: The applicant would like to fill 4,356 square feet of an isolated pocket of 404
wetlands. Approximately 3,924 square feet of the material fill will be placed within the Estuarine
Shoreline AEC, but no closer than 20' to the adjacent man-made canal.

SITE DESCRIPTION
The property is located between the Pamlico Sound and NC 12, north of the Pilot House
Restaurant in Buxton, Dare County. The property is between 2.5 and 3 acres, over half of
which consists of 404 and coastal wetlands. Found along the sound is a Juncus marsh that
extends from the sound 600' in an easterly direction to a high ground ridge. On the east side
of the high ground ridge is an isolated pocket of freshwater wetlands (404) wetlands. The
isolated pocket,is approximately 13,588 square feet and of that 4,902 square feet are on the
applicant's property.
Vegetation on the high ground ridge includes Live Oak (Quercus virginiana), Loblolly Pine
(Pinus taeda), Wax Myrtle (Myrica cerifera). Vegetation in the 404 wetlands is primarily
Black Needle Rush (Juncus roemerianus) and Saltmeadow Cordgrass (Spartina patens). A
shallow canal crosses the northeastern comer of the property. A dirt road follows along the
canal and runs south along the back of the high ground, ridge. Except for the dirt road the
property is relatively undisturbed. No man made structures are on the property.
PROJECT DESCRIPTION
The applicant would like to fill 4,356 square feet in the isolated pocket of 404 wetlands around
the southeast section of the property, north of an upland ridge. Approximately 3,924 square
feet of fill will be placed within the Estuarine Shoreline AEC. The average depth of the fill
will be 3'-0" and will result in 484 cubic yards of material being placed in the freshwater
wetland. The fill will be graded and sloped at 2:1 and a silt fence will be placed along the
outside toe of the fill, adjacent to the remaining 404 wetlands, to prevent siltation.
ANTICIPATED ]IMPACTS
The project will result in the loss of 4,356 square feet of freshwater wetlands. The property
will be developed for residential use once fill has been placed on the property and stabilized.
With development, it can reasonably be anticipated that a more intense use will be made of the
property.
No archeological sites, remnant species or geological formations are known to be associated
with this particular property. A recorded archeological site is located south of the Gray
property where the Pilot House Restaurant is currently situated (Site Reference DR2). North
of the property, behind the school is a site referenced as DR 25.
