ADDITIONAL CONDITIONS
You have our approval to place fill material in 0.55 acres of wetlands or waters for the purpose of
construction of an education center at N.C. Central University at NC 55 and Cecil Street, as you described in
your application dated 27 December 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in.your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed
below. A deed restriction or conservation easement shall be added to all remaining wetlands in this site to
prevent future fill. A stormwater management plan shall be submitted to DWQ for written approval by 1
April 1997. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Staff met with your agent, Mr. Sam pridgsn with, The John R. McAdams eomoauy,
on your 5-7 acre tract of land located north of Burlington Avenue, south of
Cecil Street, east of Alston Avenue (N.c., Highway 55), went of Lincoln
avenue, in Durham, Durham County, North Carolina. The site is located
adjacent to, and above the headwaters of, an unnamed tributary to Third Fork
Creek. The purpose of the site inspecti= was to dezesmiae the presence of
wetlands subject to our regulatory jurisdiction pursuant to Seecion 404 of the
Clean Water Act and to determine whether any Department of the Army (DA)
permits may be required for your proposed Construction of the new Education
Building, parking facilities and access road.
During the Site inspection, it was determined that there are watlands
present on the property. Based upon the field inspection and topographic
maps, it was determined that all areas subject to our regulatory authority are
=%caincd within and below iLhe 302-foot cparcur line- Enclosed are copies of
2 Wetland Determination F6mma, providing specific information obtained ar-
stations on your property. The data on these forms support the derormd-=tion
that wetlands occur on the tract of the proposed facility.
Based upon the prellmin my drawings utilized by Mr. pr3.dgen in the
meeting, it was determined that portions of the parking lot and tIM mccens
road may encroach into the identified wetlands. Any discharge of excavated or
fill material into these wetlands, including mechanized landelearing, will
requ:.rs DA permit authorization. AS discussed with Mr. Pridgen, the above
aativi.t;.ea within the project wetlands may be eligible for au"orization by
nationwide permit, depending upon the type of construction, tdchaiquee utilized
and the amount of wetlands impacted. Once final plane become available, they
should be forwarded to our office for final review of permit eligibility.
Please be rami.nded that issuance of Department of the Army authorization
must precede any placement of excavated or fill material within any wetlands
on your property. Unauthorized activity would be a violation of Federal law.

The above referenced project has been successfully bid and the State Construction
Office has issued an award letter to let the construction contracts.
As you can imagine, all parties involved with this project are anxious for construction
to commence. Therefore, it is with a sense of urgency that we submit this Section
401 application. In addition, any extra attention you can afford to the review of this
application would be greatly appreciated.
We are tentatively scheduling a Pre-Construction conference prior to January 15,
1996. We would appreciate Division of Environmental Management approval by this
date. It is with this request that we submit seven (7) copies of the Section 401

STORM WATER MANAGEMENT NARRATIVE
The project is a proposed School of Education Building at NCCU in Durham. The site is
located west of Highway 55 between Cecil Street and Burlington Avenue.
The proposed construction includes a single building, a parking lot behind the building
adjacent to Burlington Avenue, and a parking lot in front of the building.
The existing site is partially wooded with a row of existing houses along Burlington
Avenue. There are clearings for existing sewer line easements which bisect the site from
east to west and from north to south. An existing drainage swale bisects the northeast
corner of the site from Hwy.55 to Cecil Street.
The northern half of the site is mostly wooded and includes low lying wetland areas. The
intent of the site plan is to squeeze the development into the northern half of the site
thereby creating as little impact as possible on the wooded areas and wetlands in the
northern half of the site. The wetlands occur in the northeast quadrant of the site below
elevation 302.
The stormwater management plan is designed to protect the wetlands from any adverse
impact both during the temporary construction phase and after construction in normal
use. Water quality is addressed in the permanent sense by capturing runoff from the
impervious areas in the storm drainage system and discharging the water away from the
wetlands.
Stormwater runoff from almost all of the building and the entire parking lot is completely
captured in the storm drainage system and discharged to the box culvert crossing Alston
Avenue without being discharged into the wetlands. The only runoff from an impervious
area which is discharged to the wetlands is from the entrance drive at FES 15 and 8400
SF of the roof area at FES 6. The discharge from FES 6 is filtered through 120 LF of
undisturbed woods before reaching the wetlands. The entrance drive contributes a very
small area, and this runoff is discharged directly to the drainage swale 230 feet from the
box culvert. Therefore this minimal runoff will be carried out of the wetland area quickly
and will be confined to the very small area of the drainage swale.
To limit impact to the wetlands during construction, extensive perimeter sediment control
devices are employed. All runoff from the site will be directed to either storm drainage
structures with inlet protection devices, silt fence, or stone check dams. The total

end off of Cecil Street and the other on the south end from Burlington Avenue.
Silt fence is used along grading limit perimeters. Permanent rip rap stabilization is shown
on drainage slopes north and south of the building. Three stone check dams are shown at
drainage channels which capture small areas. Inlet protection will be installed at each
storm drain inlet.
This stormwater management plan should protect the water quality of the wetlands both
during the construction phase of the project and afterwards during normal use.

We find the plan to be acceptable and hereby issue this letter of approval. If any
modifications, performance reservations, or recommendations are applicable, a list is
enclosed and is incorporated as a part of this letter of approval. If any modifications
are not incorporated into the plan and implemented in the field, the site will be in
violation of the Sedimentation Pollution Control Act of 1973 (North Carolina General
Statute, hereinafter NCGS, 113A-61.1). In addition, it should be noted that this plan
approval shall expire three (3) years following the date of approval in accordance with
Title 15A, North Carolina Administrative Code (NCAC) 48.0029, if no land-disturbing
activity has been undertaken.
The land-disturbing activity described in the plan for this site may be subject to
the approval of other Local, State or Federal agencies. This could include the
Division of Water Quality under stormwater or other water quality regulations, the
U. S- Army Corps of Engineers under Article 404 jurisdiction, county, city or town
agencies under other local ordinances, or other approvals that may be required. The
approval issued in this letter cannot supersede any other required permit or approval.
Since this project will disturb five or more acres, one such required approval
relates to the stormwater that will discharge from your project. This runoff is
permitted pursuant to the National Pollutant Discharge Elimination System (NPDES)

Through coordination with your agent, Mr. Rick Bond with The John R.
McAdams Company, Inc., we have learned of your plans to impact approximately
24,000 square feet (0.55 acre) of jurisdictional wetlands associated with the
construction of parking facilities and an access road to serve the new
Education Building. Specifically, the project is located on a 5-7 acre tract
of land bordered to the south by Burlington Avenue, to the north by Cecil
Street, to the east by Alston Avenue (N.C. Highway 55), and to the west by
Lincoln Avenue, in Durham, Durham County, North Carolina. The site is located
adjacent to, and above the headwaters of, an unnamed tributary to Third Fork
Creek.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your proposed work, as illustrated in the plans submitted by your agent
on March 20, 1995, is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM). You should contact Mr. John
Dorney, telephone [phone], regarding water quality certification. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur. If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation to complete the activity under the present
terms and conditions of this nationwide permit.
