ADDITIONAL CONDITIONS
You have our approval to place fill material in 0.86 acres of wetlands or waters for the purpose of
developing a commercial site at 15-501 and Mt. Moriah Road, as you described in your application dated 20
December 1996. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26
when it is issued by.the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed
below. Mitigation shall be done on the entire Dawn McFarland tract on New Hope Creek. Additional written
approval for the wetland mitigation and stormwater management plan is required before wetland fill occurs. A
deed restriction or conservation easement shall be added to the entire mitigation tract to prevent future fill.
The smallest pasture on this tract may be utilized for spoil disposal if requested. In addition, you should get
any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in
the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

MINUTES: Jan. 14 minutes approved
Ryals passed out an article from the AICP Pl= ners Casebook, Stunner 1995,
which focused on the bistory of planning around the 15-5.01/140 interchange & the
Durham/Orange county line. The article stated that this was an example of how planning
to
will uldmtely fait without ordinances to enforce good planning, and the political will
carry them out.
REPORTS: iVlaunsell and Ed Harrison reported about a' "Trails for the Triangle"
Conference which they attended on Feb. 8 which was sponsored by DOST, TLC, and
others. Maunsell said the focus ofthe coR£erence was about bringing interested groups'
-together into one movement; and about joining up the yarious trail systems. There was
talk abmit how. to connect trails in the 15-501/I4.0 area. Harrison said that the Durbaffi
subgroup spoke.aboutconneeting the American Tobacco Trail to the Chapel Hill trails.
Commissioner Reckhdw saw a strong need to get trails on the ground soon, and Planner
'Beverly Norwood said that the North-South trail west of the New Dope should be the first.
priority. ACTION: Harrison will get together with NoAvood, Danner, Waldrop, and
Coulter to walk the potential trail. Maunsell's mentioning bike/pedestrian/equestrian trails
sparked Stark's concern, which he said was voiced by sportsmen and wildlife officials
alike, that equestrian trails should be separate from bike/pedestrian trails. Kent said
equestrian trails had been separate in some public parks for some time. ACTION: Ryals
agreed to send Stark a copy of $).e NHCCAC response to the 1995/96 Am3y Corps of
3 Engineers Master Plan.
Harrison attended a NCDOT•transportation roundtable on. Feb. 11, and statedAhat
Deputy Secretary David Kittg asked Ed about the prospects fors bicycle trail, paved or
gravel, along New Hope Creek. Harrison asked the DOT staff about the Citizens Adviso-N
Committee report expressing concern about what kind of bridge would be rebuilt for 15-
501 across New Hope Creek_ They suggested that they are not accustomed to being told
l)v citizens what sorts of bridges they should build.
Coulter brought up a confereu.ce being sponsored by the Triangle J Council of
Governments on March 14 in Raleigh, "This Land Is Our Land", to help create a strategy
to preserve and maintain open. spaces.
Edeburn mentioned a US-TALE Conference on. Landscaping to be held at the

Thanks for taking the time to update inc on your follow ups from our pre-
application meeting on September 5, 1996 regarding our pending 401 water
Quality Certificate application fvr the development of a Target store in
Durham, North Carollua at the intersections of US 151501 and Mount Moriah
Road. Based on our conversation, I understand that you will be meeting with
Bradley Bennett on 'C6ureday to discuss with him this project as well as DEM
policy with respect to the type of stormwater management system that was
discussed as a potential option for this prtliect. Since your meeting is a policy
meeting, we will not attend, but as discusmd, we would like to meet with you
and Bradley next week to discuss the results of that meeting and to determine
how to best manage stormwater on the proposed Target site.
Since we will not he attending your lmlic:y meeting, we would like to reiterate
sonic points made during our pre-application meeting for your consideration at
that time. Our client has a number of constraints imposed by others on this
property and has tried diligently to date tc} work with adjoining property owners
to develop a "big picture" resolution to stormwater management in the area but
to no avail. Our client would prefer to use: a traditional gravity flow system
and not incur the cost of an attemmtive method. However, until off-site options
become available when adjoining property owners develop those lands, we are
examining an expensive although not ideal system (from our perspective) as a

utilize a traditional gravity flow system to a basin off site in the future and to
develop (recapture) the areas an site that will temporarily he dedicated for the
proposed basins for the option proposed. 't'arget Is willing to provide whatever
assurances from a maintenance perspective that are necessary, such as back up
pourer supplies in the event of failure, ere. to ensure the system works during
its term of operation should this be the method chosen.
In summary, as you are c onsidcring a policy decision regarding pumping
stornawater by mechanical means, we ask that you consider permanent versus
temporary optionq and ennsider options in the policy that sites could be
cemsidered on a case by case basis for such circumstances as described above.
As we are in the planning and pre-application process, the stormwater system is,
one option that has been proposed for this site. We believe that conventional
gravity systems are ttre preferred method for managing stormwater due to costs
and past experience with these systems, however, that option may not be
available on this tract if all stormwater is to be handled on site- We are open to
suggestions as to how we can satisfy both water quality goals and project
development goals and working with your Departtnent to fund a solution.
We are looking forward to meeting with you and Bradley Bennett to discuss
this project specifically next week. Again, thank you for your assistance oil
this project and your consideration of the above during your meeting. Any

9. This site was previously part of a larger assemblage of parcels to be developed
by others as a Wal-Mart and Sams commercial center. The previous developer
delineated the wetlands on the tract which were certified by the U.S. Corps of
Engineers in 1991. It is our understanding that permits were issued to the
previous owner for the proposed Wal-Mart development.
14. Due to the location of the wetlands within the parcel as well as other size and
development constraints associated with the property, wetland avoidance is not
feasible. Wetland minimization/mitigation efforts are detailed on the attached
mitigation summary. In summary, 1.72 acres of wetlands will be created in the
New Hope Creek watershed.

As part of the 401 Water Quality Certification, Target Stores is incorporating several stormwater
management measures for water quality to meet the State's antidegradation policy. These
management measures are based on several conversations with NCDEHNR staff through site visits
and pre-application meetings. In summary, Target Stores will treat stormwater generated by the
proposed development through the use of sand filters ("Delaware" filters) and create 1.72 acres of
wetlands off site to compensate for the functions lost as a result of impacting the 0.86 acres of
wetlands on site.
The Stormwater Plan prepared by Kimley-Horn and Associates, Inc. includes the typical location
and type of filters to be used to treat stormwater on-site. The final design will be submitted after the
City of Durham has reviewed the project so that any changes to the plan can be incorporated at that
time. In addition, since the stormwater that is flowing through the stream on site will need to be
piped through tr.e site, measures have been taken to slow flows of the stream through in pipe
measures as shown on the plan in order to reduce potential erosion and maintain the existing stream
channel configuration off site.
The wetlands creation will occur on property owned by Mrs. Dawn McFarland to the north of the
property. This property is located along an unnamed tributary to New Hope Creek. The site is
currently used for agriculture. The drainage area generating stormwater being discharged onto the
Target site is similar in size to the drainage area generating stormwater being discharged to the
McFarland property. In addition, both drainages contain similar developed uses and are subject to
the same future development potential. The applicant will create 1.72 acres of forested wetland from
active upland agricultural fields. The location is shown on the attached USGS map. The exact
location will be determined in the future. The owner has agreed to sell the acreage necessary. The
final location will depend on further study, location of site boundaries and input from NCDEHNR.
The final plans will be submitted with the final plans for the sand filters.

Staff biologists with the North Carolina Wildlife Resources Commission have
reviewed the subject application for 401 Water Quality Certification with respect to
anticipated project impacts on aquatic habitats. Our comments are provided in accordance
with certain provisions of the Fish and Wildlife Coordination Act (Stat. 401, as amended; 16
U.S.C. 661 et. seq.), and Section 401(b) of the Clean Water Act of 1977 (as amended), and
North Carolina General Statutes (G.S. 113-131 et scq).
The applicant proposes to fill 0.86 acres of wetlands for the construction ol'a Target
Store. The wetlands are located in the New Hopc Creek Subbasin, which is designated Class
C NSW in this Section.
The applicant has proposed mitigation of 1.72 acres in the New Hope watershed to
replace the functions that will be lost at the developed site. The applicant proposes to treat
stormwater from the site by use of sand filters.
While we are pleased that 1.72 acres of wetlands will be restored in the New Napo
C`.rcck Subbasin, we question if 1.72 acres will be sufficient to replace the lost functions at the
Target site. It appears that storrnwater currently flaws from adjacent developments through
the Target wetlands prior to discharge to New Hope Creek. While the sand filters should treat

stormwater from the Target development, stormwater and pollutants from adjacent areas will
be allowed to flow untreated to New Hope Creek. Additionally, we are concerned that the
sand filters will become clogged with silt and debris; and thus, fail to function properly. A
wet retention pond installed downstream of the Target Store to treat all stormwater flowing
from the proposed Target wd adjacent development would better protect aquatic resources.
We request that this permit be modified as follows.
1. Raquirc that off site stormwater flowing through this drainage be treated as well as the
stormwater from the Target develOpn0ent.
2. Require that sand filters be checked and maintained at regular intervals to unsure peak
function.
3. Require that energy from any stormwater discharge be dissipated to prevent scouring
downstream areas.

This letter serves to transmit our joint application for a nationwide permit from
the US Army Corps of Engineers and Section 401 Water Quality Certification
from the North Carolina Department of Environment, Health, and Natural
Resources. This permit application is being submitted on behalf of our client,
Dayton Hudson Corporation, c/o Target Stores, for the construction of a Target
center in Durham County. The site is located at the intersection of US 151501
and Mt. Moriah Road in the northeast quadrant.
Permit authorization is being requested for filling 0.86 acre palustrine forested
wetlands associated with an intermittent, unnamed tributary to Dry Creek. This
wetland area received a 46 rating based on your wetlands value rating analysis.
Due to the location of the wetlands within the property, avoidance of these areas
was not feasible. Proposed mitigation for the wetland impacts includes the
creation of 1.72 acres of wetlands in agricultural fields owned by Dawn
McFarland. This property is located within the New Hope Creek watershed.
Mitigation efforts are detailed in a mitigation summary memo included as part of
the permit application package.
Based upon conversations with you and Danny Smith during our numerous pre-

permit application package is a stormwater management plan showing our
proposed use of sand filters to treat on-site water. The sand filters were designed
using recommendations from your staff during our pre-application meetings and
DEHNR's November 1995 publication, "Stormwater Best Management
Practices". For off-site stormwater, as shown on the attached site plan,
mechanisms have been incorporated into the design to slow the water flows and
prevent erosion. The proposed mitigation is through wetlands
creation/restoration in agricultural fields owned by Dawn McFarland, located
north of the subject property.
It is requested that the permit be issued based on the agreed to measures for
treating stormwater conditioned upon approval by your office of a final design.
The applicant is currently scheduled to meet with the City in January/February
to complete final design with your conditional approval of the design. If
possible, a 6 month time frame to finalize the plan would be preferred in the
event the City postpones the meeting with the applicant. However, it is our
desire to finalize the plans within the next few months.

requirements and options for storm water management on the site as it relates

storm water would not be allowed and briefly explained their reasoning.
Bob Miller, stated he had investigated the "Delaware" sand filter system and
had obtained information from two manufacturers regarding prefabricated

guidelines, met the requirements for treatment of on-site storm water. Mr.
Bennett indicated that no formal monitoring and reporting would be required as
long as routine maintenance was performed.
Peter Bishop indicated that the intent was to install the sand filters under the
parking lot area in a fashion that would allow the storm water to flow into the
filters with overflow being captured by standard inlets " downstream" of the
filters. Mr. Bennett agreed that this appeared to be an appropriate approach
but that he would have to see the actual design before approval. Peter Bishop
indicated that velocity controls would be incorporated into the pipe outlet
system. Mr. Dorney and Mr. Bennett agreed that this was acceptable.
A brief discussion of the treatment of off-site storm water and the replacement
of the treatment function of the approximately 0.9 acre of wetlands being
eliminated followed. It was agreed that an off-site regional retention pond
would meet the requirements, and if designed appropriately (adequate size),
could meet requirements for on-site water as well. Wetland replacement was
also discussed in lieu of the retention pond. John Dorney indicated that he
would prefer that any replacement occur on the Dry Creek tributary preferably
down stream of the Target site. He indicated that he would consider any
proposal and would judge each on its merits, including replacement in other
parts of the New Hope Creek basin.

Thanks for taking the time to update me on your follow ups from our pre-
application meeting on September 5, 1996 regarding our pending 401 Water
Quality Certificate application for the development of a Target store in
Durham, North Carolina at the intersections of US 15/501 and Mount Moriah
Road. Based on our conversation, I understand that you will be meeting with
Bradley Bennett on Thursday to discuss with him this project as well as DEM
policy with respect to the type of stormwater management system that was
discussed as a potential option for this project. Since your meeting is a policy
meeting, we will not attend, but as discussed, we would like to meet with you
and Bradley next week to discuss the results of that meeting and to determine
how to best manage stormwater on the proposed Target site.
Since we will not be attending your policy meeting, we would like to reiterate
some points made during our pre-application meeting for your consideration at
that time. Our client has a number of constraints imposed by others on this
property and has tried diligently to date to work with adjoining property owners
to develop a "big picture" resolution to stormwater management in the area but
to no avail. Our client would prefer to use a traditional gravity flow system
and not incur the cost of an alternative method. However, until off-site options
become available when adjoining property owners develop those lands, we are
examining an expensive although not ideal system (from our perspective) as a

near term solution due to the unique site constraints. It is our client's desire to
utilize a traditional gravity flow system to a basin off site in the future and to
develop (recapture) the areas on site that will temporarily be dedicated for the
proposed basins for the option proposed. Target is willing to provide whatever
assurances from a maintenance perspective that are necessary, such as back up
power supplies in the event of failure, etc. to ensure the system works during
its term of operation should this be the method chosen.
In summary, as you are considering a policy decision regarding pumping
stormwater by mechanical means, we ask that you consider permanent versus
temporary options and consider options in the policy that sites could be
considered on a case by case basis for such circumstances as described above.
As we are in the planning and pre-application process, the stormwater system is
one option that has been proposed for this site. We believe that conventional
gravity systems are the preferred method for managing stormwater due to costs
and past experience with these systems, however, that option may not be
available on this tract if all stormwater is to be handled on site. We are open to
suggestions as to how we can satisfy both water quality goals and project
development goals and working with your Department to find a solution.
We are looking forward to meeting with you and Bradley Bennett to discuss

The meeting was scheduled as a follow-up to earlier meetings regarding site
water quality measures. The purpose of the meeting was to explore
requirements and options for storm water management on the site as it relates
to compliance with 401 Water Quality Certification.
John Dorney stated that he and Bradley Bennett had considered issues discussed
at our last meeting and had made a policy decision that pumping of stormwater
would not be approved. He indicated that some of their main concerns were
maintenance, the ability to handle significant storm events, and the fact that
pumping is an unprecedented approach in North Carolina. He pointed out that
a pumped system would treat only a portion of the water that fell on a site
while a pond or other gravity system handles, to some degree, all of the water
passing through the site. He explained the procedure if Target wished to

pursue this matter further. It was stated that Target was still exploring
alternatives and these meetings are a part of the pre-application process to get
guidance and input before decisions are made.
John Dorney then related an alternative suggested by Bradley Bennett which
they felt would be acceptable. He suggested that the off-site drainage be
treated using a gravity fed retention pond and that on-site drainage be treated
using sand filters which are also gravity fed and could be located under parking
areas. These systems have been approved in North Carolina and are an
acceptable alternate control in the BMP manual. He explained that using the
sand filters for on-site should work because the site was mostly impervious
surface and there should not be problems with the sand filter clogging up.
They did not recommend sand filters for the off-site water because of the
higher percentage of pervious surface and the potential for the sand filters
being clogged by sediment and flotsam. It was agreed that Target would
explore this option.
There was a general discussion regarding the possibility of providing equivalent
treatment capacity for the off-site water elsewhere in the watershed and not
necessarily on site. Mr. Dorney indicated that this was an acceptable approach
which has been used elsewhere in North Carolina.
Mr. Dorney reiterated that the reason for the requirement to treat off-site water
was to replace the treatment function of the on site wetlands proposed for
elimination. Jim Eisenhardt suggested that if the treatment function currently
being provided by the on-site wetland was less than that assumed and this
could be demonstrated, the treatment capacity and hence the size of any pond
or other acceptable treatment method could be smaller. It was further
suggested and agreed to that off-site water did not have to go through a pond or
other means if the wetlands lost were replaced within the watershed. Mr.
Dorney was to inform Mr. Bennett our findings and Kimley-Horn and
Associates was to contact Bradley to discuss technical requirements regarding
the use of sand filters.

On June 6, 1996 Danny Smith from the RRO conducted a preliminary
site visit for Mr. James Eisenhardt of Kimley-Horn and Associates,
Inc. During this site visit the wetlands at the proposed Target
Center located at the Junction of 15-501 and Mt. Moriah Rd in
Durham were discussed.
Mr. Eisenhardt satisfactorily communicated their inability to avoid
the wetlands impacts. Under current permitting procedure the RRO
recommends issuance of the 401 Certification with the requirement
of a stormwater pond. It was noted that stormwater devices may be
required by the city of Durham as well. The RRO office recommends
sending DEM's design specifications along with the Certification
upon receipt of a formal application.
Note: this is preapplication comments, if an application is
submitted under the new rules please remit application to RRO for
additional comments under the new criteria of the rules.
