Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The 77 -acre project area is composed fo-23.7 acres of forested land crossed by old farm roads and sanitary sewer and overhead powerline utility easements. The existing processing facility occupies the balance of the -53.3 acre project area. There are multiple permanent structures located within the project area, group into three main areas: the existing processing facility is located in the southeastern corner of the project area, a guard house with a covered carport is centrally located along the entranceway near the eastern boundary of the project area, and a tractor scale house and weigh station are located between the existing processing facility and the existing guard house. Land uses within the project area include the existing processing facility with associated loading bays and parking, trailer staging areas, and undeveloped mixed -hardwood forested tracts. Land use in the vicinity of the project area consists primarily of agricultural development and undeveloped forested land. 4b. Explain the purpose of the proposed project:* In 2017, Individual Section 404/401 permits were issued for the construction of an approximately 495,175 square foot cold storage distribution center and associated truck staging area connected to the existing Smithfield Foods processing facility. The original Section 404/401 permit authorized impacts included 2.38 -acres of freshwater forested wetlands (non -riparian) and 0.01 acre of jurisdictional ditch. During a post -construction site review, Kimley-Horn staff identified areas of wetland disturbance that occurred outside the authorized impact areas. This information was brought to the attention of the applicant (Smithfield Foods) and proactive actions were taken to rectify this inadvertent, unauthorized issue and request a modification to the original permits and be in compliance with their Section 404/401 permits. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The permit modification request associated with this permit and the unauthorized wetland impacts included 0.47 -acre of mechanized land clearing (conversion) associated with a 30 -foot permanent transmission line easement and infrastructure installed by Four Counties Utilities which runs parallel to the newly constructed truck staging area. In addition, there is 0.02 - acre of permanent wetland fill associated with an a#ended concrete pad at the weigh station needed to epand the turning radius required for the larger trucks. Therefore, the total modification request required for permanent wetland impacts is 0.49 -acre. A majority of the unauthorized impacts (1.26 -acres) are associated with areas that were inadvertently cleared by the site contractor. The contractor's GPS unit containing the wetland file lost coverage in the dense canopy cover. The contractor was relying on what the thought were the wetland delineation flags to determine the wetland limits; however, there was flagging on the project site denoting multiple features and the flagging the contractor used was not the wetland flagging. In the limited areas where the grading was done, Smithfield Foods proposes to regrade these areas back to pre-e>asting contours and replant these areas as well as the balance of the cleared area with native wetland vegetation; therefore, no permanent wetland impacts are requested for this area. 4j. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to wetlands were minimized through design by reducing the width of the driveway isles within the trailer staging areas located north of the proposed distribution center, and by tightening the proposed limits of disturbance of the projects. Per Section 404(b)(1) guidelines during the original Individual Permit application process, off-site alternatives as well as six (6) on-site alternatives were evaluated to ensure the Preferred Alternative was the least environmentally damaging alternative. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Reduced the number of required trailer positions from 390 to 329; relocated the northern truck access drive from north of the existing CR. England facility to south of the facility avoiding impacts to Wetland W4 (a 0.72 -acre reduction of impact); decreased the driveway isle widths within the trailer staging areas north of the distribution center from 420 feet to 410 feet (a 0.83 -acre reduction of impact); tightening of the limits of disturbance to the greatest extend practical (a 0.27 -acre reduction of impact). 2. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire.
