Dear Mr. White:
On July 8, 2019, the Division of Water Resources (Division) received your application requesting
a 401 Water Quality Certification from the Division for your project. The Division has
determined that your application is incomplete and cannot be processed. The application is on -
hold until the following information is received:
1. Page 7 of 7 of the PCN depicts the signature of Tyler Probst. The application package
requires an agent authorization letter signed by the applicants. A sample agent
authorization letter has been attached to this letter. Please e-mail a signed agent
authorization form to Stephanie Goss at stephanie.f;ossCa@ncdenr.gov [15A NCAC
02H .0502(f)]
2. In the Neuse River Basin, intermittent streams, perennial streams, lakes, ponds and
estuaries depicted on USGS maps and NRCS soil survey maps are subject to the Riparian
Buffer Rules. Impacts to the riparian buffers must be identified on your plans [15A
NCAC 02B .0233 (8)(b)(iv)]. If a stream is depicted on either map it is subject to the
riparian buffers. [Note: if the permittee believes the maps inaccurately depict surface
waters he or she must consult Johnston County to secure a formal on-site
determination. If Johnston County has provided an onsite determination, please e-mail
the confirmed determination letter to Stephanie Goss at stephanie.goss@ncdenr.gov.]

3. Avoidance & Minimization for Wetland Impacts - Please provide more details regarding
the wetland impacts for this project. As far as the application and impact map stands, it
is not possible to match up the impacts depicted in the PCN and impact map. Also, the
lot boundaries depict wetlands overlapping the lot boundary. Please explain if the
wetlands will be impacted within the lot boundaries by fill or grading [15A NCAC
02H .0506(f) and (g)].
4. Please provide documentation for review that the U.S. Army Corps of Engineers has
verified all stream, wetland, and/or open water locations for the project. [15A NCAC
02H .0502(a)(7)]
5. The Corps of Engineers must also verify the Nationwide Permit that is to be used to
authorize this project. [15A NCAC 02H .0502(a)(7)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Water Quality Certification Rules for
this activity.
