2.0 PROJECT LOCATION
The approximately 0.43 -acre site is located off Lowland Road in Hobucken, Pamlico County,
North Carolina. The site is proposed to be improved with a 80 ft x 80 ft tower compound and 24
ft x 279 ft access road / utility easement for a cell tower. The project site is located on the Lowland,
NC United States Geological Survey (USGS) 7.5 -minute topographic quadrangle map. The
approximate center of the site and the project location is located at 35.2553370N, -76.5766570W.

.0 PROJECT DESCRIPTION
The proposed project will consist of the development of a cell tower with a gravel road for access
/ utility easement. A total of 0.415 acres of jurisdictional freshwater forested wetlands have been
identified where the proposed cell tower compound and access road are planned to be built. The
applicant proposes to impact 0.30 acres of jurisdictional freshwater forested wetlands for
construction of a gravel road crossing / utility easement and the cell tower compound construction.
4.0 PROJECT PURPOSE
The purpose of the project is to develop a cell tower off Lowland Road in Hobucken, North
Carolina to support improvement to cellular communication coverage in the area. The
improvement in cellular coverage in the area needed to improve basic community services and
improve emergency response.
5.0 EXISTING CONDITIONS
5.1 Wetlands and WOTUS
The 0.415 -acres of wetlands that will be impacted are jurisdictional freshwater wetlands. The
overstory in the wetland areas primarily consists of loblolly pine (Pinus taeda) and southern
magnolia (Magnolia grandiflora). Saplings and shrubs consist of water oak (Quericas nigra),
southern magnolia (Magnolia grandiflora), common reed (Phragmites australis), wax myrtle
(Morella cerifera), and eastern poison ivy (Toxicodendron radicans).
There is 0.010 -acres of non -jurisdictional wetlands along Lowland Road (surface water ditch).
5.2 Uplands
There is 0.005 -acres of uplands located on site along Lowland Road. The uplands consist of
maintained grass along the shoulder of Lowcountry Road.
5.3 Local Hydrology
The site is located in the Tar -Pamlico River Basin (HUC# 03020104). The hydrology is driven
through natural processes that result in seasonal inundation of freshwater forested wetlands
located on the site. The project will cause minimal disruption to the local hydrology.

6.0 SITE SELECTION
The site currently contains undeveloped woodlands and a surface water ditch. The site selected
meets the project purpose. Additionally, the location of the site adjacent to an existing water tower
presents the opportunity to consolidate utilities in the area, thereby minimizing wetland impacts.
7.0 PRACTICABLE ALTERNATIVES ANALYSIS
As a component of the permit applications to discharge dredged or fill material into wetlands
and/or WOTUS, the United States Army Corps of Engineers (USACE) is required to analyze and
evaluate alternatives to the proposed project that could achieve its purpose and need. The
USACE conducts this analysis pursuant to two main requirements:
The 404(b)(1) Guidelines (Guidelines) associated with the Clean Water Act (CWA)
of 1972, Federal Register, 40 CFR Part 230, and
The USACE Implementation Procedures for the National Environmental Policy Act
(NEPA) of 1969, Federal Register, 33 CFR Part 325, Appendix B.
Under Section 404(e) of the CWA, the USACE can issue general permits to authorize activities
that have minimal individual and cumulative adverse environmental effects. The proposed project
meets the conditions to qualify for a Nationwide Permit.
7.1 Alternatives
Site and design alternatives were evaluated for the project site to avoid and minimize the wetland
impacts associated with the proposed project. The alternatives considered are summarized
below.
7.1.1 Alternative A: No -Action Alternative
The no -action alternative would prevent the project from being completed either through no
federal decision or by not conducting the proposed project. The no -action alternative was rejected
because it does not meet the project purpose and need.
7.1,2 Alternative B: Standard Cellular Tower Compound
The applicant initially proposed a 100 ft x 100 ft square compound area and a 32 ft x 279 ft access
road for construction of the tower and associated support structures, which is the applicant's
standard footprint for cell towers of this size. This alternative would have resulted in approximately
0.415 acres of wetland impacts. This alternative was rejected as no wetland impact avoidance
was achievable due to the site conditions.

7_1-a Alternative C: Proposed Site Design (preferred alternative)
Various layouts were considered for the development to avoid and minimize impacts to the
existing wetlands on the site to the maximum extent feasible while maintaining the project goal of
developing the cell tower. The existing impact drawings provided in Appendix A depict the
proposed site design, which includes the cell tower, gravel access road, and easement area.
Alternative layouts within the site were considered; however, each of the layouts results in
comparable impacts to wetlands for construction of various components of the proposed
development. The applicant reduced the footprint of the proposed wetland impacts to 80 ft x 80 ft
and reduced the access road width to 24 ft x 279 ft to reduce wetland impacts to 0.300. The
applicant will minimize impacts to WOTUS including wetlands by implementing stormwater best
management practices during construction. The impacts to wetlands will be further minimized
through the use of pervious fill material predominantly consisting of gravel.
8.0 CUMULATIVE WETLAND IMPACTS
Adverse effects are those that reduce the quality and/or quantity of habitat, including direct,
indirect, site specific, or habitat wide impacts, including individual, cumulative or synergistic
consequences of actions. The current plan balances the least wetland impacts while meeting the
project purpose. The degree of threat associated with the proposed wetland impacts are not likely
to adversely affect WOTUS and they do not significantly alter the habitat of the site or surrounding
region.
9.1) MITIGATION
Section 404 of the CWA requires permits for the discharge of dredged or fill material into WOTUS,
including wetlands. Jurisdictional wetlands and WOTUS are defined by 33 C.F.R. § 328.3(b) and
are protected by Section 404 of the CWA (33 U.S.C.A. § 1344), which is enforced by the USACE,
Washington District in North Carolina.
The permit drawings depicting the proposed wetland impacts on the site are included in Appendix
A. The North Carolina Pre -Construction Notification (PCN) Form is included in Appendix B.
The proposed impacts associated with the project do not conflict with Section 23(c) of the 2017
Nationwide Permit General Conditions. The 0.30 -acre wetland impact will be mitigated through
the North Carolina Department of Environmental Quality (NCDEQ) Division of Mitigation Services
in -lieu fee program. The approval letter for the NCDEQ North Carolina's in -lieu fee program is
included in Appendix B.

10.0 WATER QUALITY
The site is located within the Tar -Pamlico River Basin (HUC# 03020104) in Pamlico County and
consists primarily of the Pamlico River and its tributaries. The basin occupies a drainage area of
6,148 miz. Land use/land cover in the basin includes: 29% agriculture land, 23% wetlands, 27%
forested land, 12% grassland/scrub land, and 7% developed area. The watershed is made up of
2,521 stream miles, 3,976 acres of lake water, and 665,593 acres of estuarine areas. The
Pamlico River drains into the Atlantic Ocean via the Pamlico Sound. The Tar -Pamlico River Basin
accepts drainage from the Lower Tar River Basin.
The site's receiving water body, Upper Springs Creek, is not documented as impaired on the U.S.
Environmental Protection Agency (EPA) Water Quality Assessment status on the most recent
2016. The creek is in good status with the EPA and is classified as shellfish harvesting waters
(SFH). The closest downstream water quality monitoring station from the project site is
0982500C, which is located approximately 7.4 miles north of the site at Pamlico River between
mouths of Plungo River and Goose Creek Mid -Channel.
This project meets the specific conditions and regional conditions of the 401 Water Quality
Certification.
The proposed wetland impacts associated with the project will not result in an increase of turbidity
in the receiving water systems that is substantially different from its current layout except during
the duration of construction. Additionally, no oils or other pollutants will be released into the
receiving water systems as a result of this project. All work performed during construction will be
conducted in a manner to prevent interference with any legitimate water uses. No non -allowable
discharges into receiving waters will result in associated environmental impacts. The proposed
project is not likely to have an adverse effect on water quality.
11.0 STORMWATER
The applicant will implement best management practices that will minimize erosion and migration
of sediments on and off the project site during and after construction. Additionally, land
disturbance activity will comply with the NC Department of Water Quality (DWQ) Stormwater Best
Management Practices.
All stormwater runoff from built upon areas will be transported primarily via vegetated
conveyances. These practices will include the use of appropriate grading and sloping techniques
and erosion prevention and sediment control measures capable of preventing erosion, migration
of sediments, and bank failure. All disturbed land will be stabilized and sloped where appropriate
with a minimum 3:1 slope upon project completion as applicable. Once the project is initiated, it
will be carried to completion in an expeditious manner, minimizing the period of disturbance to
the environment.

Temporary best management practices such as silt fence and/or other diversionary structures will
be used during construction. Permanent stabilization of embankments will contain appropriately
sized rip -rap over geotextile liner or other similar approved permanent erosion control features
where applicable. Temporary and permanent stormwater controls may be used to minimize
sedimentation and erosion and minimize impact to the stream areas.
12.0 CULTURAL RESOURCES
A review of the North Carolina State Historic Preservation Office HPOWEB GIS Service (General
Audience) revealed that no sites have been identified as eligible for listing or potentially eligible
for listing in the Federal Register of Historic Places on or immediately adjacent to the project site.
13.0 PROTECTED SPECIES
Pursuant to Section 7 of the Endangered Species Act, the list of protected species known to occur
in Pamlico County was reviewed, and evaluations were performed regarding the likelihood of the
presence of each species within the project area. A search of the United States Fish and Wildlife
Service (USFWS) database provided existing information concerning the potential occurrence of
threatened or endangered species within Pamlico County.
The North Carolina Department of Environment and Natural Resources (NCDENR) Natural
Heritage Program database was also reviewed for information regarding species with state
endangered or threatened status. Information obtained from the USFWS and NCDENR
databases regarding state and/or federally rare, threatened, or endangered species in Pamlico
County is included in Table 13-1.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.

You are correct that there would be no features present in the project area that would possibly be subject to the buffer
rules, primarily because there are none mapped on either that most recent topo, or the most recent printed NRCS soil
survey for Pamlico Co.
As far as your stormwater questions, I showed Carl Dunn (one of the stormwater engineers with the Division of Energy,
Mineral, and Land Resources (DEMLR)) the plans you'd sent me. Based on what you'd sent, the only trigger that he/we
saw that might likely kick you into needing a stormwater permit would be if the total disturbed area in your project
exceeded an acre (meaning that you'd also need a sediment and erosion control plan from DEM LR).

Hey this is Will Vesely with Terracon. I have a couple questions regarding the Pamlico County buffer rules as it applies to
our site.
We are working on a nationwide permit application for a 0.3 -acre wetland impact (construction of a cell tower
compound and access road/utility crossing) in Hobucken, see attached. The site is located off Lowland Road adjacent to
a water tower. The impact will include crossing over a ditch. I wanted to verify the site does not need a buffer, due to
the ditches not being mapped streams on the most recent topo and they are not modified natural streams.
Also do you know if a stormwater management plan will be required, we should have —10% impervious surface.
Any further guidance would be greatly appreciated.

Thank you for the information it was very helpful.
Attached is the signed DMS In -Lieu fee request form for US-NC-5069-Hobucken site. DWR confirmed we do not have to
meet the buffer requirements. Emily Thompson of the ACOE said we have to do a 2:1 mitigation fee ($32,000 for 0.3
acre impact) and it could be higher based on their wetland review.

The DMS In -Lieu Fee request form is attached. Once you know the impacts you need to request mitigation credits for,
send me the completed form (both pages) and I can respond with an acceptance letter.
Just a heads up that for buffer impacts in that service area (Tar -Pamlico 03020104), DMS offers credits "out of huc" and
that will likely trigger the DWR to require more mitigation. DMS has had difficulty procuring buffer credits in the lower
Tar -Pamlico. In NC, if credits are available from a private bank in the service area where the impact is, developers are
restricted from requesting DMS credits. I don't see any banks in the lower Tar -Pam, though given that DMS will offer
credits out-of-huc, you can ask Anthony if he would prefer you use the bank in Tar -Pamlico 03020103 (pages 7 and 8 of
the DWR list).

The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the

prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
