CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to David F. Couch pursuant to
an application filed on the 11th day of April, 1988 to prepare a tract
for development near NC Highway 68 at Deep River.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of a tributary
to East Fork Deep River in conjunction with the proposed land
development activity in Guilford County will not result in a violation
of applicable Water Quality Standards and discharge guidelines.
Therefore, the State of North Carolina certifies that this activity will
not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217
if conducted in accordance with the application and conditions
hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. That appropriate sedimentation and erosion control
measures shall be employed to minimize turbidity
and siltation impacts.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Dear Mr. Mills:
Enclosed please find the completed application for
Water Quality Certification and Permit to Excavate
and/or Fill for the 46 acre tract of land referenced in
Mr. Charles Hollis' letter dated February 12, 1988. I
have included a site plan of the proposed development
and labeled the area in which the proposed work is to
be performed.
As stated in Mr. Hollis' letter, I have met with David
Lekson and Ken Jolly from the Corps of Engineers'
staff. It was determined in this meeting that the
project site consists of high ground and open water.
It was also determined that no vegetated wetlands exist
on the site.
It is my understanding that the Section 401 Water
Quality Certification must be obtained before
proceeding with the Nationwide Permit No. 26 (PDN).
Therefore, I will hold off on submitting the pre-
discharged notification form to the Corps of Engineers
until I have received word back from you concerning the
Water Quality Certification. If this is not proper
procedure and if my understanding of this procedure is
incorrect, please let me know as soon as possible.
