Surry County
Based on your renewal request for the subject permit (dated December 31, 2018), the Division of Water
Resources (DWR or the Division) hereby transmits a renewal draft for your review and comment. Please
review it carefully to ensure your understanding of the permit limits and monitoring requirements, and to
correct errors, if any.
Facility Upgrades and Outfall Relocation. DWR understands that the Town of Dobson (Dobson) has
awarded a contract to J. S. Haren Company to upgrade WTP solids -handling facilities, estimated to have
commenced during first quarter of 2019. DWR has to date received no progress report (previous permit
compliance deadline April 1, 2017). In addition, Dobson has pledged since 2015 to fund and extend
Outfall 001 to the main -stem Fisher River (— 300 feet downstream). We anticipate your allocation of
funding and completion of this project.
Reasons Dobson Should Extend Outfall 001 to the Fisher River.
1. The unnamed tributary (UT) affords no effluent dilution because the instream waste
concentration (IWC) = 100%, i.e., the discharge comprises 100% of the stream flow.
2. Fishing River affords ample dilution [IWC — 0.65%] for metals & WET -testing.
3. WET -testing has not passed at the UT but has passed at main stem (14 quarterly tests)
4. Total Copper (Cu) requires permit limits for this renewal based on RP analysis.
5. Effluent discharged at the main stem (with dilution) will likely pass new permit limits for Cu.
6. Continued discharge to the UT will require future treatment for Cu.
Finally, resolving the above issues and their potential non-compliance will qualify Dobson for -a
Certificate of Coverage (COC) under WTP General Permit NCG590000.
Eligibility for General Permit NCG590000. In August 2014, the Division implemented NPDES General
Permit NCG590000 (NCG59) as less restrictive for WTPs like Dobson utilizing Greensand and
Conventional -type treatment technologies to produce potable water. The Certificate of Coverage (COC)
annual fee for NCG59 is $100 [verses $860 for an individual permit], and monitoring is less frequent [see
enclosed permit NCG59]. Please note NCG591s Tables B. (1.) and B. (3.) showing requirements
specific to the Dobson's facility. In applying for the general permit, Dobson should formally request to
rescind current permit NC0089265. See our website.

Whole Effluent Toxicity (WET) - TestingHistory. Dobson's WET -testing results reported for the
previous permit cycle indicate all quarterly tests "Fail" [8 calendar quarters]. Again, this resulted
from no effluent dilution afforded at the UT to Fisher River [zero flow receiving -stream conditions;
7Q10 and 30Q2 = 0.0 cfs].
Changes for Renewal — WET -Testing "Limited." Renewal WET -Testing at the UT stipulates an
effluent concentration of 90% and "monitoring only" is hereby stipulated as WET -test "Limited" [see
Section A. (2.)]. Any test "failure" at the UT moving forward exposes Dobson to stipulated penalty
assessment. Only after moving Outfall 001 may Dobson take advantage of dilution (0.65%) afforded by
Fisher River's main stem [see WET -Test Section A. (3.)].
Concurrent with this notification, the Division will solicit public comment on this draft by
publishing a notice in newspapers having circulation in the general Surry County area, as required
by the NPDES Program. Please provide your written comments, if any, to DENR / DWR /
NPDES Program no later July 1, 2019 (approximately 30 days after receiving this document).

During the period beginning on the effective date of this permit and lasting until expiration, the

1. The Permittee shall submit discharge Monitoring Reports electronically using DWR's eDMR
submittal system [See Section A. (4.)].
2. Limit and monitoring apply only if facility adds chlorine or chlorine derivatives to filter backwash
water. The Division shall consider compliant all effluent TRC values reported below 50µg/L.
However, the Permittee shall continue to submit all values reported by North Carolina -certified
test methods (including field certified), even if these values fall below 50µg/L.
3. TN = (NO2-N + NO3-N) + TKN, where (NO2-N + NO3-N) and TKN are Nitrite/Nitrate nitrogen
and Total Kjeldahl Nitrogen respectively.
4. WET -Testing 7-Day Chronic Pass/Fail — effluent test concentration depends on outfall location
[see sections A. (2) and A. (3.)] at respective 90% or 0.65% using Ceriodaphnia dubia, monitoring
during February, May, August, and November.

A. (2.) CHRONIC TOXICITY 7-DAY PASS/FAIL - LIMITED
[15A NCAC 02B .0200 et seq.]; for discharges to the UT of Fisher River.
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent
versions or "North Carolina Phase H Chronic Whole Effluent Toxicity Test Procedure" (Revised- December
2010) or subsequent versions. The tests will be performed during the months of February, May, August,
and November These months signify the first month of each three-month toxicity testing quarter assigned to
the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and
shall be performed at the NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter

Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and
program reports. The final NPDES Electronic Reporting Rule was adopted and became effective on
December 21, 2015.

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the
facility being physically located in an area where less than 10 percent of the households have
broadband access, then a temporary waiver from the NPDES electronic reporting requirements
may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1,
2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to
the mailing address above. See "How to Request a Waiver from Electronic Reporting" section
below.
Regardless of the submission method, the first DMR is due on the last day of the month following the
issuance of the permit or in the case of a new facility, on the last day of the month following the
commencement of discharge. Starting on December 21, 2020, the permittee must electronically report
the following compliance monitoring data and reports, when applicable:

• Sewer Overflow/Bypass Event Reports;
• Pretreatment Program Annual Reports; and Sewer Overflow/Bypass Event Reports;

• Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to Request a
Waiver from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time
of each electronic submission. The permittee should use the EPA's website resources to identify
the initial recipient for the electronic submission.

electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to

the Division for written approval at lest sixty (60) days prior to the date the facility would be
required under this permit t�begin submitting monitoring data and reports. The duration of a

temporary waiver shall not exceed 5 -years and shall thereupon expire. At such time, monitoring
data and reports shall be submitted electronically to the Division unless the permittee re -applies for
and is granted a new temporary electronic reporting waiver by the Division. Approved electronic
reporting waivers are not transferrable. Only permittees with an approved reporting waiver request
may submit monitoring data and reports on paper to the Division for the period that the approved
reporting waiver request is effective.

II, Section B. (I 1.)(a) or by a duly authorized representative of that person as described in Part II,
Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR
reporting purposes.
