Additionally, any emissions activities determined from your air permit application as meeting the exemption requirements contained in 15A NCAC 2Q .0102 have been listed for information purposes as an II A TT ACHMENT11 to the enclosed air permit. Please note the records retention requirements are contained in General Condition 2 of the General Conditions and Limitations. Please note that pursuant to Section 19( d) of the Federal Natural Gas Act, The United States Court of Appeals for the circuit in which a facility subject to section 717b of this title or section 717f of this title is proposed to be constructed, expanded, or operated shall have original and exclusive jurisdiction over any civil action for the review of an order or action of a ... State administrative agency acting pursuant to Federal law to issue, condition, or deny any permit, license, concurrence, or approval ... required under Federal law, other than the Coastal Zone Management Act of 1972 ( 16 U.S.C. 1451 et seq.). [ref. 15 U.S.C. § 717r(d)] To the extent review of this permit is not governed by federal law, review will be governed by the North Carolina Administrative Procedure Act. Under G.S. 150B-23 of the North Carolina Qeneral Statues, if any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request a formal adjudicatory hearing within 30 days following receipt of this permit, identifying the specific issues to be contested. Such a request will stay the effectiveness of the entire permit. This request must be submitted in writing to the Director and must be identify the specific provisions or issues for which the modification is sought. Unless exempted by a condition of this permit or the regulations, construction of new air pollution sources or air cleaning devices, or modifications to the sources or air cleaning devices described in this permit must be covered under a permit issued by the Division of Air Quality prior to construction. Failure to do so is a violation of G.S. 143-215.108 and may subject the Permittee to civil or criminal penalties as described in G.S. 143-215.114A and 143-215.114B. This permit shall be effective from February 27, 2018 until January 31, 2026, is nontransferable to future owners and operators, and shall be subject to the conditions and limitations as specified therein. For PSD increment tracking purposes, PMlO emissions from this modification are increased by 4.18 pounds per hour. Changes have been made to the permit stipulations. The Permittee is responsible for carefully reading the entire permit and evaluating the requirements of each permit stipulation. This permit is subject to the following specified conditions and limitations including any TESTING, REPORTING, OR MONITORING REQUIREMENTS: I A. SPECIFIC CONDITIONS AND LIMIT A TIO NS l. Any air emission sources or control devices authorized to construct and operate above must be operated and maintained in accordance with the provisions contained herein. The Permittee shall comply with applicable Environmental Management Commission Regulations, including Title 15A North Carolina Administrative Code (NCAC), Subchapter 2D .0202, 2D .0503, 2D .0516, 2D .0521, 2D .0524 (40 CFR 60, Subpart JJJJ, Subpart K.KKK, Subpart OOOOa), 2D .0535, 2D .0540, 2D .0611, 2D .1100, 2D .1111 (40 CFR 63, Subpart ZZZZ), 2D .1806, 2Q .0102, 2Q .0309 and 2Q .0711. 2. PERMIT RENEWAL AND EMISSION INVENTORY REQUIREMENT -The Permittee, at least 90 days prior to the expiration date of this permit, shall request permit renewal by letter in accordance with ISA NCAC 2Q .0304(d) and (f). Pursuant to 15A NCAC 2Q .0203(i), no permit application fee is required for renewal of an existing air permit (without a modification request). The renewal request (with AA application form) should be submitted to the Regional Supervisor, DAQ. Also, at least 90 days prior to the expiration date of this permit, the Permittee shall submit the air pollution emission inventory report (with Certification Sheet) in accordance with 15A NCAC 2D .0202, pursuant to N.C. General Statute 143 215.65. The report shall be submitted to the Regional Supervisor, DAQ and shall document air pollutants emitted for the 2024 calendar year. 3. PARTICULATE CONTROL REQUIREMENT-As required by 15A NCAC 2D .0503 "Particulates from Fuel Burning Indirect Heat Exchangers," particulate matter emissions from the fuel burning indirect heat exchangers shall not exceed the allowable emission rates listed below: Source Emission Limit (lbs/million Btu) natural gas-fired boiler (5.25 million Btu per hour heat input) I 0.60 (WH-01) Permit No. 10466ROO Page 3 4. SULFUR DIOXIDE CONTROL REQUIREMENT -As required by 15A NCAC 2D .0516 "Sulfur Dioxide Emissions from Combustion Sources, 11 sulfur dioxide emissions from the combustion sources shall not exceed 2.3 pounds per million Btu heat input. 5. VISIBLE EMISSIONS CONTROL REQUIREMENT -As required by 15A NCAC 2D .0521 "Control of Visible Emissions," visible emissions from the emission sources, manufactured after July 1, 1971, shall not be more than 20 percent opacity when averaged over a six-minute period, except that six-minute periods averaging not more than 87 percent opacity may occur not more than once in any hour nor more than four times in any 24-hour period. However, sources which must comply with 15A NCAC 2D .0524 "New Source Performance Standards" or .1110 "National Emission Standards for Hazardous Air Pollutants" must comply with applicable visible emissions requirements contained therein. 6. 15A NCAC 2D .0524 "NEW SOURCE PERFORMANCE STANDARDS" -For the following equipment, the Permittee shall comply with all applicable provisions, including the notification, testing, reporting, recordkeeping, and monitoring requirements contained in Environmental Management Commission Standard 15A NCAC 2D .0524 "New Source Performance Standards" (NSPS) as promulgated in 40 CFR Part 60, Subpart indicated below, and including Subpart A "General Provisions. I Emission Sour~s) ] Regulation Subpart JJJJ Standards of natural gas-fired emergency generator (14.9 million Btu per hour heat Performance for input, 1,818 horsepower output, 1,300 kilowatts electric) (ID No. EG-01) Stationary Spark Ignition Combustion Engines (SI ICE) a. Monitoring Requirements -As required by 15A NCAC 2D .0524, the following monitoring requirements shall apply: 1. If the emergency stationary SI ICE that is greater than or equal to 500 HP that was built on or after July 1, 2010, does not meet the standards applicable to non-emergency engines, the Permittee shall install a non-resettable hour meter. [60.4237(a)] b. Compliance Requirements -As required by ISA NCAC 2D .0524, the following compliance requirements shall apply: 1. The Permittee shall operate and maintain stationary SI ICE that achieve the emission standards as required in 40 CFR 60.4233 over the entire life of the engine. [60.4234] ii. Owners and operators of stationary SI ICE who conduct performance tests shall follow the procedures in 40 CFR 60.4244. [60.4244] m. If the stationary SI ICE must comply with the emission standards specified in 40 CFR 60.4233(d) or (e), the Permittee shall demonstrate compliance I Permit No. 10466ROO Page4 according to one of the methods specified in paragraphs A and B of this section. [60.4243(b)] A. Purchasing an engine certified according to procedures specified in this subpart, for the same model year and demonstrating compliance according to one of the methods specified in paragraph I and II of this section. [60.4243(b )(1 )] L If the certified stationary SI ICE and control device are operated and maintained according to the manufacturer's emission-related written instructions, the Permittee shall keep records of conducted maintenance to demonstrate compliance, but no performance testing is required. The Permittee shall also meet the requirements as specified in 40 CFR Part 1068, Subparts A through D, as they apply to the engine. If engine settings are adjusted according to and consistent with the manufacturer's instructions, the stationary SI ICE will not be considered out of compliance. [60.4243(a)(l)] IL If the certified stationary SI ICE and control device are not operated and maintained according to the manufacturer's emission-related written instructions, the engine will be considered a non-certified engine, and the Permittee shall demonstrate compliance according to the following, as appropriate. [60.4243(a)(2)] (a) If the stationary SI ICE is less than 100 HP, the Permittee shall keep a maintenance plan and records of conducted maintenance to demonstrate compliance and shall, to the extent practicable, maintain and operate the engine in a manner consistent with good air pollution control practice for minimizing emissions, but no performance testing is required. [60.4243(a)(2)(i)] (b) If the stationary SI ICE is greater than or equal to 100 HP and less than or equal to 500 HP, the Permittee shall keep a maintenance plan and records of conducted maintenance and shall, to the extent practicable, maintain and operate the engine in a manner consistent with good air pollution control practice for minimizing emissions. In addition, the Permittee shall conduct an initial performance test within 1 year of engine startup to demonstrate compliance. [60.4243(a)(2)(ii)] (c) If the stationary SI ICE is greater than 500 HP, the Permittee shall keep a maintenance plan and records of conducted maintenance and shall, to the extent practicable, maintain and operate the engine in a manner consistent with good air pollution control practice for minimizing emissions. In addition, the Permittee shall conduct an initial performance Penn it No. 10466ROO Page 5 test within 1 year of engine startup and conduct subsequent perfonnance testing every 8,760 hours or 3 years, whichever comes first, thereafter to demonstrate compliance. [ 60.4243(a)(2)(iii)] B. Purchasing a non-certified engine and demonstrating compliance with the emission standards specified in 40 CFR 60.4233(d) or (e) and according to the requirements specified in 40 CFR 60.4244, as applicable, and according to the following: [60.4243(b)(2)] I. If the stationary SI ICE is greater than 500 HP, the Pennittee shall keep a maintenance plan and records of conducted maintenance and shall, to the extent practicable, maintain and operate the engine in a manner consistent with good air pollution control practice for minimizing emissions. In addition, the Pennittee shall conduct an initial perfonnance test and conduct subsequent performance testing every 8,760 hours or 3 years, whichever comes first, thereafter to demonstrate compliance. [ 60.4243(b )(2)(ii)] iv. For an emergency stationary ICE, the Permittee shall operate the emergency stationary ICE according to the requirements in paragraphs A through C of this section. In order for the engine to be considered an emergency stationary ICE under this subpart, any operation other than emergency operation, maintenance and testing, and operation in non-emergency situations for 50 hours per year, as described in paragraphs A through C of this section, is prohibited. If the Permittee does not operate the engine according to the requirements in paragraphs A through C of this section, the engine will not be considered an emergency engine under this subpart and shall meet all requirements for non-emergency engines. [60.4243(d)] A. There is no time limit on the use of emergency stationary ICE in emergency situations. [60.4243(d)(l)] B. The Permittee may operate the emergency stationary ICE for any combination of the purposes specified in paragraph I of this section for a maximum of 100 hours per calendar year. Any operation for non-emergency situations as allowed by paragraph C of this section counts as part of the 100 hours per calendar year allowed by this paragraph B. [60.4243(d)(2)] I. Emergency stationary ICE may be operated for maintenance checks and readiness testing, provided that the tests are recommended by federal, state or local government, the manufacturer, the vendor, the regional transmission organization or equivalent balancing authority and transmission operator, or the insurance company associated with the engine. The Permittee may petition the Administrator Permit No. 10466ROO Page 6 for approval of additional hours to be used for maintenance checks and readiness testing, but a petition is not required if the Pennittee maintains records indicating that federal, state, or local standards require maintenance and testing of emergency ICE beyond 100 hours per calendar year. [60.4243(d)(2)(i)] C. Emergency stationary ICE may be operated for up to 50 hours per calendar year in non-emergency situations. The 50 hours of operation in non-emergency situations are counted as part of the 100 hours per calendar year for maintenance and testing provided in paragraph B. Except as provided in paragraph I of this section, the 50 hours per year for non-emergency situations cannot be used for peak shaving or to generate income for a facility to an electric grid or otherwise supply power as part of a financial arrangement with another entity. [ 60.4243( d)(3)] I. The 50 hours per year for non-emergency situations can be used to supply power as part of a financial arrangement with another entity if all of the following conditions are met: [60.4243( d)(3)(i)] (a) The engine is dispatched by the local balancing authority or local transmission and distribution system operator; [60.4243(d)(3)(i)(A)] (b) The dispatch is intended to mitigate local transmission and/or distribution limitations so as to avert potential voltage collapse or line overloads that could lead to the interruption of power supply in a local area or region; [60.4243(d)(3)(i)(B)] (c) The dispatch follows reliability, emergency operation or similar protocols that follow specific NERC, regional, state, public utility commission or local standards of guidelines; [ 60.4243( d)(3)(i)(C)] (d) The power is provided only to the facility itself or to support the local transmission and distribution system [60.4243(d)(3)(i)(D)]; and (e) The Pennittee identifies and records the entity that dispatches the engine and the specific NERC, regional, state, public utility commission or local standards or guidelines that are being followed for dispatching the engine. The local balancing authority or local transmission and distribution system operator may keep these records on behalf of the Perrnittee. [ 60.4243( d)(3)(i)(E)] Permit No. l 0466R0O Page 7 v. For a stationary SI ICE that is natural gas fired, the Permittee may operate this engine using propane for a maximum of l 00 hours per year as an alternative fuel solely during emergency operations, but shall keep records of such use. If propane is used for more than 100 hours per year in an engine that is not certified to the emission standards when using propane, the Permittee is required to conduct a performance test to demonstrate compliance with the emission standards of 40 CFR 60.4233. [60.4243(e)] c. Record.keeping Requirements -As required by 15A NCAC 2D .0524, the following recordkeeping requirements shall apply: i. The Pennittee shall keep records as follows: (60.4245] A. All notifications submitted to comply with this subpart and all documentation supporting any notification; [60.4245(a)(l)] B. Maintenance conducted on the engine; [60.4245(a)(2)] C. If the stationary SI ICE is a certified engine, documentation from the manufacturer that the engine is certified to meet the emission standards and information as required in 40 CFR parts 90, 1048, 1054, and 1060, as applicable [60.4245(a)(3)]; and D. If the stationary SI ICE is not a certified engine or is a certified engine operating in a non-certified manner and subject to 40 CFR 60.4243(a)(2), documentation that the engine meets the emission standards. [60.4245(a)(4)] ii. For non-certified engines greater than 25 HP, a copy of the maintenance plan and conducted maintenance. [60.4243(a)(l)] iii. Copies of any performance testing required under this Subpart. [60.4245(d)] 1v. All records required under this section shall be maintained for a period of two years following the date of such record. All records shall be kept on-site and made available to DAQ personnel upon request. The Permittee shall be deemed in noncompliance with 15A NCAC 2D .0524 ifrecordkeeping requirements are not maintained. [40 CFR 60.7(f)] d. Reporting Requirements -As required by I SA NCAC 2D .0524, the following reporting requirements shall apply: 1. If the SI ICE is subject to performance testing, the testing shall be conducted according to the requirements of 40 CFR 60.4244, and the Permittee shall submit a copy of each performance test within 60 days after the test has been completed. [60.4243(a)(2), (b)(2), (e), and (f)] 11. For stationary SI ICE greater than or equal to 500 HP that have not been certified by an engine manufacturer to meet the emission standards in 40 Permit No. 10466ROO Page8 CFR 60.4231, the Permittee shall submit an initial notification as required in 40 CFR 60.7(a)(l). The notification shall include the information in paragraphs (A) through (E) of this section. [60.4245(c)] A. Name and address of the owner or operator; [60.4245(c)(l)] B. The address of the affected source; [60.4245(c)(2)] C. Engine information including make, model, engine family, serial number, model year, maximum engine power, and engine displacement; [60.4245(c)(3)] D. Emission control equipment; [60.4245(c)(4)] and E. Fuel used. [60.4245(c)(5)] m. For an emergency stationary SI ICE with a maximum engine power more than 100 HP that operates for non-emergency situations as described above, the Permittee shall submit an annual report according to the requirements in paragraphs A through C of this section. [60.4245(e)J A. The report shall contain the following information: I. Company name and address where the engine is located. IL Date of the report and beginning and ending dates of the reporting period. III. Engine site rating and model year. IV. Latitude and longitude of the engine in decimal degrees reported to the firth decimal place. V. Hours spent for operation for non-emergency situations as described above, including the date, start time, and end time for engine operation for these non-emergency situations. The report shall also identify the entity that dispatched the engine and the situation that necessitated the dispatch of the engine. B. The first annual report shall cover the calendar year 2015 and shall be submitted no later than March 31, 2016. Subsequent annual reports for each calendar year shall be submitted no later than March 31 of the following calendar year. C. The annual report shall be submitted electronically using the subpart specific reporting form in the Compliance and Emissions Data Reporting Interface (CEDRI) that is accessed through EPA's Central Data Exchange (CDX) (www.epa.gov/cdx). However, if the reporting form specific to this subpart is not available in CEDRI at the time that Permit No. 10466ROO Page9 I I the report is due, the written report shall be submitted to the Administrator at the appropriate address listed in 40 CFR 60.4. 7. ISA NCAC 2D .0524 "NEW SOURCE PERFORMANCE STANDARDS11 -For the following equipment, the Permittee shall comply with all applicable provisions, including the notification, testing, reporting, recordkeeping, and monitoring requirements contained in Environmental Management Commission Standard 15A NCAC 2D .0524 "New Source Performance Standards" (NSPS) as promulgated in 40 CFR 60, Subpart indicated below, and including Subpart A "General Provisions." NSPS Reporting Requirements -In addition to any other notification requirements to the Environmental Protection Agency (EPA), the Permittee is required to NOTIFY the Regional Supervisor, DAQ, in WRITING, of the following: 1. The actual date of initial start-up of an affected source, postmarked within 15 days after such date; b. NSPS Recordkeeping -The Permittee shall maintain records of the fuel quality chara.cteristics in a current, valid purchase contract, tariff sheet or transportation contract for the fuel, specifying that the maximum total sulfur content of the natural I Permit No. 10466ROO Page 10 gas used is 20 grains of sulfur or less per 100 standard cubic feet and has potential sulfur emissions of less than 0.060 pounds SO2 per million Btu heat input. d. All performance tests shall be conducted in accordance with EPA Reference Methods, contained in 40 CFR 60, Appendix A. ii. The EPA Administrator retains the exclusive right to approve equivalent and alternative test methods, continuous monitoring procedures, and reporting requirements. 111. Within 60 days after achieving the maximum production rate at which the equipment will be operated, but not later than 180 days after the initial start-up of the equipment, the Permittee shall conduct the required performance _test(s) and submit two copies of a written report of the test{s) to the Regional Supervisor, DAQ. 1v. After the initial performance test, subsequent NOx performance tests shall be conducted on an annual basis (no more than 14 calendar months following the previous performance test). A. If the NOx emission result from the performance test is less than or equal to 75 percent of the NOx emission limit for the turbine, you may reduce the frequency of subsequent performance tests to once every 2 years {no more than 26 calendar months following the previous performance test). B. If the results of any subsequent performance test exceed 75 percent of the NOx emission limit for the turbine, you must resume annual performance tests. Permit No. 10466ROO Page 11 v. The Permittee shall be responsible for ensuring, within the limits of practicality, that the equipment or process being tested is operated at or near its maximum normal production rate or at a lesser rate if specified by the Director or his delegate. v1. All associated testing costs are the responsibility of the Permittee. vii. At least 45 days prior to performing any required emissions testing, the Permittee must submit two copies of a testing protocol to the Regional Supervisor, DAQ for review and approval. All testing protocols must be approved by the DAQ prior to performing tests. vm. To afford the Regional Supervisor, DAQ, the opportunity to have an observer present, the Permittee shall PROVIDE the Regional Office, in WRITING, at least 15 days notice of any required performance test(s). 8. 15A NCAC 2D .0524 "NEW SOURCE PERFORMANCE STANDARDS" -For the fugitive equipment leaks (FUG-02), the Permittee shall comply with all applicable provisions, including the notification, testing, reporting, recordkeeping, and monitoring requirements contained in Environmental Management Commission Standard 15A NCAC 2D .0524 "New Source Performance Standards" (NSPS) as promulgated in 40 CFR 60, Subpart OOOOa "Standards of Performance for Crude Oil and Natural Gas Facilities for which Construction, Modification or Reconstruction Commenced After September 18, 2015t and including Subpart A "General Provisions." 9. NOTIFICATION REQUIREMENT -As required by 15A NCAC 2D .0535, the Permittee of a source of excess emissions that last for more than four hours and that results from a malfunction, a breakdown of process or control equipment or any other abnormal conditions, shall: a. Notify the Director or his designee of any such occurrence by 9:00 a.m. Eastern time of the Division's next business day of becoming aware of the occurrence and describe: 1. the name and location of the facility, ii. the nature and cause of the malfunction or breakdown, m. the time when the malfunction or breakdown is first observed, iv. the expected duration, and v. an estimated rate of emissions. b. Notify the Director or his designee immediately when the corrective measures have been accomplished. This reporting requirement does not allow the operation of the facility in excess of Environmental Management Commission Regulations. Permit No. 10466ROO Page 12 I 10. FUGITIVE DUST CONTROL REQUIREMENT-As required by 15A NCAC 2D .0540 11Particulates from Fugitive Dust Emission Sources," the Permittee shall not cause or allow fugitive dust emissions to cause or contribute to substantive complaints or excess visible emissions beyond the property boundary. If substantive complaints are received or excessive fugitive dust emissions from the facility are observed beyond the property boundaries for six minutes in any one hour (using Reference Method 22 in 40 CFR, Appendix A), the owner or operator may be required to submit a fugitive dust plan as described in 2D .0540(f). "Fugitive dust emissions" means particulate matter that does not pass through a process stack or vent and that is generated within plant property boundaries from activities such as: unloading and loading areas, process areas stockpiles, stock pile working, plant parking lots, and plant roads (including access roads and haul roads). 11. Selective Catalytic Reduction and Oxidation Catalyst REQUIREMENTS -As required by 15A NCAC 2D .0611, NOx, CO, and VOC emissions shall be controlled as described in the permitted equipment list. a. Inspection and Maintenance Requirements -To comply with the provision of this permit and ensure that emissions do not exceed the regulatory limits, the Permittee shall perform periodic inspections and maintenance (I&M) as recommended by the manufacturer. In addition, the Permittee shall perform an annual inspection of the pollution control device. b. Recordkeeping Requirements -The results of all inspections and any variance from manufacturer's recommendations or from those given in this permit (when applicable) shall be investigated with corrections made and dates of actions recorded in a logbook. Records of all maintenance activities shall be recorded in the logbook. The logbook (in written or electronic format) shall be kept on-site and made available to DAQ personnel upon request. 12. Federal and State Rules Applicable to Sources Exempted from Air Permitting Requirements -Your facility is subject to the following federal and state rules: 40 CFR 60 -NSPS --Subpart JJJJ --Standards of Performance for Stationary Spark Ignition Internal Combustion Engines 40 CFR 63 -NESHAP/MACT--Subpart ZZZZ --Reciprocating Internal Combustion Engines which are applicable to some of the emission sources at your facility listed on the "Insignificant/Exempt Activities" list attached to this permit. The purpose of this permit condition is to inform you of your compliance obligations to these applicable rules as they are enforceable. 16. Within 15 days after start-up of the new or modified facilities, the Permittee shall provide written notice of the start-up to the Regional Supervisor, DAQ. Any existing equipment being replaced is permitted to operate in compliance until the replacement equipment is operational. 17. TOXIC AIR POLLUTANT EMISSIONS LIMITATION REQUIREMENT-Pursuant to 15A NCAC 2Q .0711 "Emission Rates Requiring a Permit," for each of the below listed toxic air pollutants (TAPs), the Permittee has made a demonstration that facility-wide actual emissions, where all emission release points are unobstructed and vertically oriented, do not exceed the Toxic Permit Emission Rates (TPERs) listed in 15A NCAC 2Q .071 l(b). The facility shall be operated and maintained in such a manner that emissions of any listed T APs from the facility, including fugitive emissions, will not exceed TPERs listed in 1 SA NCAC 2Q .071 l(b). a. RECORDS RETENTION REQUIREMENT -In accordance with 15A NCAC 2D .0605, any records required by the conditions of this permit shall be kept on site and made available to DAQ personnel for inspection upon request. These records shall be maintained in a form suitable and readily available for expeditious inspection and review. These records must be kept on site for a minimum of 2 years, unless another time period is otherwise specified. 3. ANNUAL FEE PAYMENT-Pursuant to 15A NCAC 2Q .0203(a), the Permittee shall pay the annual permit fee within 30 days of being billed by the DAQ. Failure to pay the fee in a timely manner will cause the DAQ to initiate action to revoke the permit. 4. EQUIPMENT RELOCATION -In accordance with 15A NCAC 2Q .0301, a new air permit shall be obtained by the Permittee prior to establishing, building, erecting, using, or operating the emission sources or air cleaning equipment at a site or location not specified in this permit. 5. REPORTING REQUIREMENT-In accordance with 15A NCAC 2Q .0309, any of the following that would result in previously unpennitted, new, or increased emissions must be reported to the Regional Supervisor, DAQ: a. changes in the information submitted in the application regarding facility emissions; b. changes that modify equipment or processes of existing permitted facilities; or c. changes in the quantity or quality of materials processed. Pennit No. 10466ROO Page 17 If appropriate, modifications to the permit may then be made by the DAQ to reflect any necessary changes in the pennit conditions. In no case are any new or increased emissions allowed that will cause a violation of the emission limitations specified herein. 6. In accordance with 15A NCAC 2Q .0309, this permit is subject to revocation or modification by the DAQ upon a determination that information contained in the application or presented in the support thereof is incorrect, conditions under which this permit was granted have changed, or violations of conditions contained in this permit have occurred. In accordance with G.S. 143-215.l0S(c)(l), the facility shall be properly operated and maintained at all times in a manner that will effect an overall reduction in air pollution. Unless otherwise specified by this permit, no emission source may be operated without the concurrent operation of its associated air cleaning device(s) and appurtenances. 7. In accordance with G.S. 143-215.108(c)(l), this permit is nontransferable by the Permittee. Future owners and operators must obtain a new air permit from the DAQ. 8. In accordance with G.S. 143-215.108(c)(l), this issuance of this permit in no way absolves the Permittee of liability for any potential civil penalties which may be assessed for violations of State law which have occurred prior to the effective date of this pennit. 9. In accordance with G.S. 143-215. IOS(c)(l), this permit does not relieve the Permittee of the responsibility of complying with all applicable requirements of any Federal, State, or Local water quality or land quality control authority. 10. In accordance with 15A NCAC 2D .0605, reports on the operation and maintenance of the facility shall be submitted by the Permittee to the Regional Supervisor, DAQ at such intervals and in such form and detail as may be required by the DAQ. Information required in such reports may include, but is not limited to, process weight rates, firing rates, hours of operation, and preventive maintenance schedules. 11. A violation of any term or condition of this pennit shall subject the Permittee to enforcement pursuant to G.S. 143-215.l 14A, 143-215.114B, and 143-215.114C, including assessment of civil and/or criminal penalties. 12. Pursuant to North Carolina General Statute 143-215.3(a)(2), no person shall refuse entry or access to any authorized representative of the DAQ who requests entry or access for purposes of inspection, and who presents appropriate credentials, nor shall any person obstruct, hamper, or interfere with any such representative while in the process of carrying out his official duties. Refusal of entry or access may constitute grounds for permit revocation and assessment of civil penalties. 13. In accordance with G.S. 143-215.108(c)(l), this permit does not relieve the Permittee of the responsibility of complying with any applicable Federal, State, or Local requirements governing the handling, disposal, or incineration of hazardous, solid, or medical wastes, including the Resource Conservation and Recovery Act (RCRA) administered by the Division of Waste Management. 14. PERMIT RETENTION REQUIREMENT-In accordance with 15A NCAC 2Q .0110, the Permittee shall retain a current copy of the air permit at the site. The Permittee must make Permit No. 10466ROO Page 18 available to personnel of the DAQ, upon request, the current copy of the air permit for the site. 15. CLEAN AIR ACT SECTION 112(r) REQUIREMENTS -Pursuant to 15A NCAC 2D .2100 "Risk Management Program," if the Permittee is required to develop and register a risk management plan pursuant to Section 112(r) of the Federal Clean Air Act, then the Permittee is required to register this plan with the USEP A in accordance with 40 CFR Part 68. 16. PREVENTION OF ACCIDENTAL RELEASES-GENERAL DUTY -Pursuant to Title I Part A Section 112(r)(l) of the Clean Air Act "Hazardous Air Pollutants -Prevention of Accidental Releases -Purpose and General Duty," although a risk management plan may not be required, if the Permittee produces, processes, handles, or stores any amount of a listed hazardous substance, the Permittee has a general duty to take such steps as are necessary to prevent the accidental release of such substance and to minimize the consequences of any release. This condition is federally-enforceable only. 17. GENERAL EMISSIONS TESTING AND REPORTING REQUIREMENTS -If emissions testing is required by this pennit, or the DAQ, or if the Permittee submits emissions testing to the DAQ in support of a pennit application or to demonstrate compliance, the Permittee shall perform such testing in accordance with 15A NCAC 2D .2600 and follow all DAQ procedures including protocol approval, regional notification, report submittal, and test results approval.
