The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Based on the information provided by the applicant and our information on the range of trout in the project area, we do not believe this project will cause significant effects to waters supporting trout. Therefore, we do not object to the project as proposed. Thank you for the opportunity to review and comment on this project. Box 250 North Wilkesboro, NC 28659 Dear Mr. Bennett: 1 A 4" T T I D EHNR February 18,1997 Ashe County DWQ Project # 970074 You have our approval, in accordance with the attached conditions, to place fill material in 0.13 acres of wetlands or waters for the purpose of improving SR 1181-C, as you described in your application dated 5 February 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3127. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Due to the proximity of a small stream being a trib. to South Fork of New River Class WS IV HQW, we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 16 existing cross lire drainage structures that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, and marked county map. By copy of this letter I am asking Ms. Stephanie Goudreau Mt. Region Coordinator with the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request.
