APPROVAL of 401 Water Quality Certification and Authorization Certificate per the Tar-Pamlico River Buffer
Protection Rules (15A NCAC 2B.0259) with ADDITIONAL CONDITIONS (CAMA)
Dear Ms. Raburn,
You have our approval, in accordance with the attached conditions and those listed below, to dredge/excavate
approximately 903 square feet of wetlands/waters to construct the proposed boat basin as you described within your
CAMA application. After reviewing your application, we have decided that this fill is covered by the Division of Water
Quality (DWQ) General Water Quality Certification Number 3274. This Certification allows you to use Regional General
Permit No. 198000291 when issued by the US Army Corps of Engineers (USAGE). This letter shall also act as your
approved Authorization Certificate for impacts to the protected Tar-Pamlico riparian buffers as required under 15A
NCAC 2B .0259(8). In addition, you should get any other required federal, state or local permits before you go ahead
with your project including (but not limited to) CAMA Major Permit, Coastal Stormwater Permit, and Sediment and
Erosion Control Permit. Also, this approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible
for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland,
compensatory wetland mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid,
you must follow the conditions listed in the DWQ General Certification No. 3274 and any additional conditions listed
below.
1. Within. your pre-construction project area, the 50-foot protected Tar-Pamlico Buffers begin at the CAMA wetlands
line or normal water line of any surface water (whichever is more landward). Once work is complete and the "plug"
is removed, buffers will apply along the new shoreline (i.e., bulkhead) of the boat basin and the normal waterline on
the boat ramp. No new impervious surface (including [but not limited to] concrete, asphalt, gravel, buildings,
decking, etc.) shall be added within 50 feet of the new shoreline as described above (except for "exempt' activities
identified within 15A NCAC 213 .0259(6)), unless otherwise approved in writing by the DWQ. This area must remain
vegetated except for impacts approved within your application and a possible driveway to access the boat ramp. The
proposed dwelling must be greater than 50 feet from the new shoreline as described above.
2. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as
identified within 15A NCAC 213 .0259(5).

Raleigh, NC 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.

I'm not comfortable making suggestions on any of these (I already have verbal comments from Deborah on
Phil Mitchell's; I would still like a response to my previous email or comments entered into Filemaker).
They involve lots of impact, inland marinas or dredge sites. Please provide comments by the end of the
week. The Plymouth site hits 60 days on the I Ith! Thanks,

Office. The Central Office has not received your recommendations for
these projects as of March 6, 2002. If you have not received any
application, please let me know and I will fax it to you. Please take
note of the date received in the Central Office and the 60-day clock
projection. If we do not have your comments by two weeks before the
clock expires, we may have to prepare the 401 without incorporating your
comments, in order to avoid waiving the 401. Two weeks from today, the
application will be forwarded to the appropriate Central Office staff
member (Bob Zarzecki) if we do not have Regional Office comments by
then. The CO staff will then consult you if time allows and make a
recommendation on the 401 to John Dorney.

8. PROJECT SUMMARY: Applicant proposes to lengthen" an existing t 20' wide man made canal ±43'
through 404 wetlands to highground then excavate a f 40' x f 60' x -2.5' boat basin with three slips
serviced by two 2' x 20' finger piers in the basin as well as a 5' x 55' and a 2' x 32' dock landward of the
proposed bulkhead. Both sides of the canal excavated through 404 wetlands will be bulkheaded with the
height of the bulkhead flush with the wetland substrate. The entire basin will be bulkheaded. A 12'x 36'
boat ramp is also proposed to be located in the basin.

Project Setting
The project site is located off HWY 45,1/2 mile west of US 264 on a man made canal to the
Pungo River located above Leechville near Ponzer in Hyde County, North Carolina. The 13.5 acre
tract has a grassed area fronting HWY 45 with the back half wooded to the marsh/upland interface.
An upland area in the wooded portion of the tract has been cleared in preparation to construct a
residence. A wooded fringe has been left around the cleared area. The highground elevation slopes
downward to a 404 wetland fringe before transitioning to marsh vegetated with sawgrass (Cladium
jamaicense), black needlerush (Juncus roemerianus)and salt reed grass (S artina cvnosuroides). A
20' wide canal off the Pungo River bisects the marsh and intersects the project site at a point where
marsh plant species have been out competed by other wetland shrubs and grasses. This 404 wetland
fringe is f 30' wide x f 45' long and is located at the terminus of the canal and transitions on the east
and west sides to marsh, and to uplands on the north side in line with the canal and its path to the
Pungo River. Water depths in the canal range from 2.0' to 2.5'. The Pungo River is classified as SC
NSW by the Environmental Commission.
Project Description
Applicant proposes to lengthen an existing t 20' wide man made canal ±43' through 404
wetlands to highground then excavate a t 40' x ± 60'x -2.5' boat basin with three slips serviced by
two - 2' x 20' finger piers in the basin as well as a 5' x 55' and a 2' x 32' dock :landward of the
proposed bulkhead. Both sides of the canal excavated through 404 wetlands will be bulkheaded with
the height of the bulkhead flush with the wetland substrate with no backfill. Wooden equipment
mats will be used to support the heavy equipment (backhoe) while working in the 404 wetlands.
Spoil will be placed in a closed body dump truck and hauled to the upland disposal site. The entire
basin will be bulkheaded. A 12'x 36' boat ramp is also proposed to be located in the basin. Spoil
material resulting from the excavation is to be stacked on the cleared uplands, allowed to dry then
leveled. All excavation is to occur landward of a plug. Once the excavation is complete the plug
is to be removed establishing the connection between the basin and the canal to the Pungo River.
The final water depth in the basin will be 2.5'.
Anticipated Impacts
The project as proposed will result in the,excavation of 903 ft2 of 404, wetlands and 3,496 ft2
of uplands. Approximately 10,000 ft2 of uplands will be filled with the excavated material. The
project will result in the usage of the canal by boats and impacts associated with boating activity.
The project as proposed will provide water access as well as a safe harbor for the mooring of boats.

On July 24, 2000, we renewed General Permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from
the State of North Carolina.
A review of your application received January 22, 2002, for Department of the Army (DA)
authorization to create a boat basin and construct finger piers, docks; a bulkhead, and a boatramp,
on property located off NC Highway 45, adjacent to a.man-made canal to the Pungo River, near
Ponzer, in Hyde County, North Carolina, indicates it to be a candidate for Federal authorization
under this gene- pernut. Accordingly, the administrative processing of your application will be
accomplished by the North. Carolina Division of Coastal Management. Comments from Federal
review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for any reason, you
will be informed regarding its further management. If there are no unresolved differences in
State-Federal positions or policies, the final action taken on your application by the State will
result in your receiving written notice from us that your application is consistent with the general
permit and you may commence your activity. Only after receiving such confirmation should you
begin work.

authorization and a State Water Quality Certification to create a boat basin and construct finger
piers, docks, a bulkhead, and a boatramp, on property located off NC Highway 45, adjacent to
a man-made canal to the Pungo River, near Ponzer, in Hyde County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request for certification in accordance
with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be
granted until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by April 1, 2002, the District Engineer will deem
that waiver has occurred.
