Teresa Bradford, NCDE Q – Solid Waste Section STATUS OF PERMIT: A modification to the Permit to Operate Phase 1 and Phase 2-Cells 2A, 2B-East, 2B-West and 2C-South was issued on June 8, 2016. The Permit to Operate shall expire on March 12, 2020. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 1. RESOLVED: 15A North Carolina Administrative Code 13B .1626(2)(a) cited for failure to adequately cover all exposed waste on the northwest and western side slope of Phase 2-Cell 2C North. During the inspection on July 28, 2017, adequate soil cover was observed on the northwest and western side slope of Phase 2-Cell 2C North (see photograph below). 1. RESOLVED: 15A North Carolina Administrative Code 13B .1626(4)(a); 15A North Carolina Administrative Code 13B .0203(d) - Attachment 1, Part IV, General Condition 7 of Permit # 04-03 cited for failure to monitor facility structures to ensure that the concentration of methane gas or other explosive gases generated by the facility does not exceed 25 percent of the lower explosive limit. During the inspection on July 28, 2017, quarterly methane monitoring records were reviewed indicating that facility structures have been monitored and added to the methane monitoring records for future monitoring. OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS 1. The facility consists of a MSWLF and a drop-off convenience area for residential waste. 2. The facility is permitted to receive solid waste generated from within the States of North Carolina and South Carolina, consistent with the local government waste management plan and with the franchise approved by the Anson County Board of Commissioners. The facility must not receive solid waste from transfer stations that accept solid waste generated in states other than North Carolina and South Carolina. 3. Proper signage was observed at the entrance of the facility. 4. The facility utilizes two tippers. 5. The working face appeared to be restricted to the smallest area feasible and compacted. 6. No unacceptable waste was observed. 7. The facility is permitted to use a tarp, automobile shredder fluff mixed with soil, petroleum contaminated soil and seaboard solids as alternative cover material. The facility is currently utilizing automobile shredder fluff as alternative cover material. 8. Continue to remove woody vegetation on the perimeter slopes. 9. Edge of waste markers were being maintained. 10. Access roads were well maintained. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
