PURPOSE OF SITE VISIT: Technical Assistance. Follow up to Corrective Action Plan submittal. STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .1626 (2)(a) Unresolved 15A NCAC 13B .1626 (2)(c) Unresolved 15A NCAC 13B .1626 (7)(c) Unresolved OBSERVED VIOLATIONS: No new violations observed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. Cumberland County (County) submitted a corrective action plan (CAP) and solid waste project schedule to the Solid Waste Section (Section) on October 16, 2017. 2. The Section reviewed the submittals and requested a meeting to discuss the recommended changes. Meeting was scheduled for November 11, 2017. 3. The meeting was held at the County Solid Waste Office and within the MSW/CD landfill facilities. 2601-MSWLF-1997 4. The priority of the project plan shall be covering all exposed waste. Once exposed waste is covered the Section can work with the County on a more flexible timeline for applying intermediate cover, establishing vegetation, ect. 5. If the County is unable to bring the side slopes into compliance with the ratios approved in the 2601-MSWLF-1997 PTO, the County shall submit, to the Solid Waste Permitting Engineer (Permitting) for approval, to adjust the side slopes to a more feasible ratio than permitted. It is recommended that the County seek guidance on additional erosion control measures that may be implemented. Please, ensure all activities are in accordance with the County’s sedimentation and erosion control permit. 7. The Section would like the County to added more details about each planned activity within the project planner. As an example, state whether the roads will be permanent or temporary and how they will be implemented. 8. It is recommended that the plan be implemented in a way that decreases redundancies. 9. Please be aware, that if an organic topsoil material is used to cover exposed waste the depth of that material will not be applicable to the depth of the intermediate or final cover. 10. Permanent changes to the landfill site shall be updated on the foot print drawing and submitted to Permitting for approval. 11. Please, included any actions that have been taken to date or activities completed in the revised CAP. Updated plan should be submitted by November 21, 2017. If the County is unable to meet the deadline please send an email notifying the Section and request an extension. 12. The edge of waste markers around the MSWLF were clearly visible. Looked very good. 2601-CDLF-1997 13. The area of the cap of the closed MSWLF adjacent to the base of the CDLF had been replaced with clay soil and regraded. Looked very good. 2610-COMPOST-2011 14. The Section would like to see the County break out the CAP for the Wilkes Rd. facility similarly to the CAP for the MSW facility. It is recommended the activities be planned in chronological order and in a manner as to reduce redundancy of activities for the County. 15. The priority for the facility shall be extinguishing the fire. Please, notify the Section once the fire has been extinguished. 16. Included in the CAP actions that have been taken to date to remediate the site and put out the fire. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The County shall document all attempts to recycle/manage the material ‘stockpiled’ over the closed LCID. The documentation must be submitted, if a variance request is submitted.
