RESOLVED: 15A NCAC 13B .1626(2)(a) cited for failure to completely cover all disposed solid waste with six inches of earthen material or the facility’s approved alternative daily cover (tarps) at the end of each operating day. Landfill operations were observed at the working face, which was again found to be small and well managed. The FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 waste was being compacted effectively as it was added to the landfill, and there was very little windblown litter in the area surrounding the working face. The operations being carried out at the working face demonstrate the county’s adherence to operational procedures and requirements set forth in the permit and the approved operations plan (dated August 2012). Additional repairs to the side slopes and perimeter ditch had been completed. Although some erosion rills were present on the slope located directly across the access road from the current working face, no uncovered waste was visible. Therefore, this violation is resolved. Working face is small and well-maintained. Waste is compacted as it is placed into the landfill. Slope on back side of working face area being graded with additional soil cover being applied. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1626(7)(a) cited for failing to prevent silt from leaving the MSWLF facility. All of the side slopes had been repaired, graded and seeded, with new vegetation beginning to take hold by the time this inspection took place. Most of the perimeter ditch had been cleaned out and rip-rapped or matted. However, there were a few areas that appeared to be in need of additional work. At the southernmost point of the active landfill, the perimeter ditch appeared to be filled with sediment. Mr. Neugent stated that he didn’t remember this portion of the ditch being repaired, and agreed that it needed to be cleaned out. The northern end of the lower slope berm on the southwest slope of the active landfill appeared to have either been damaged or left unfinished, and as a result, some of the vegetative cover had eroded away and sediment was observed to have washed down the slope and into the rip-rapped ditch below. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1626(7)(b) cited for failing to prevent on-site erosion. Erosion was observed on several of the side slopes that had been previously repaired. Berms had been installed at several levels in various areas of the landfill slopes to slow the flow of surface water and help to curb erosion. All slope drains now have a “T” installed at the outlet end to help slow and disperse the water flow. Based on observations made during the inspection and conditions seen in the two photos above, it appears that there is the potential for additional erosion on the side slopes. 4. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1626(7)(c) cited for failing to provide for a vegetative cover sufficient to restrain erosion within 30 working days or 120 calendar days of completion of any phase of MSWLF development. New vegetation was in evidence on all of the landfill slopes, and appeared to be taking hold in most areas. Mr. Neugent stated that spot seeding would be taking place in the near future to repair areas that had been seeded but damaged again by rain as well as those spots where vegetation had never emerged. 5. RESOLVED: 15A NCAC 13B .0203(d) cited for accepting waste that the facility is not permitted to receive. During this inspection, no unacceptable materials were observed at the landfill, in the wood waste collection area or in the inert debris collection area. Therefore, this violation is resolved. 6. RESOLVED: 15A NCAC 13B .1626(8)(d) cited for failure to contain leachate within a lined disposal cell or leachate collection and storage system, or to treat all leachate prior to discharge. No leachate seeps were observed during this inspection. Ervin Lane, Compliance Hydrogeologist, reviewed documentation of the final sampling event and stated that he is satisfied that the leachate issue has been resolved and that no further corrective action is required at this time. Therefore, this violation is resolved. OBSERVED VIOLATIONS: No additional violations were observed during this inspection. ADDITIONAL COMMENTS 1. Current landfill operations were observed to be taking place in the Phase 3 Vertical Expansion. 2. The facility was observed to be clean and free of windblown litter. Mr. Neugent stated that the landfill slopes would be mowed sometime this fall. 3. Access roadways are of all-weather construction and were observed to be well maintained. Mr. Neugent explained that the working face access road was going to be undergoing some maintenance to install a drain along the western side that would be piped under the perimeter roadway to a small catch basin. He added that this should help to eliminate the erosion problems that had been experienced in this area. 4. The working face was again observed to be small and well maintained. No unacceptable waste was observed at the working face. The tipping area was covered with a sufficient amount of dirt to keep trash from becoming exposed during landfill operations, and was properly sized to allow vehicles and equipment to maneuver safely. 5. The wood waste grinding operations had been completed, and all of the processed material had been removed from the site. A new brush pile had been started, and no unacceptable waste was observed in the pile. Please ensure that the brush pile is maintained so that fire breaks and adequate access lanes are incorporated into it, as required by general permit condition #29 of the permit to operate. 6. The inert debris stockpile was very large in size but did not appear to contain any unacceptable material. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
