STATUS OF PERMIT: Permit To Operate (PTO) issued April 19, 2016 Permit To Construct (PTC) issued in conjunction with PTO PTO expiration date April 19, 2021 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS On September 20, 2017, John Patrone met with Robert Fryar to conduct a comprehensive inspection of the Fryar Grading and Hauling, Inc. LCID Landfill on McLeansville Road in McLeansville, Guilford County. 1. The facility is a land clearing and inert debris (LCID) landfill. 2. The facility is owned and operated by Robert Fryar. 3. The permit approves the operation of the 2010 Cell and the construction and operation of the 2015 Cell. 4. The SWS - Permitting Branch received the Engineer’s Certification for the 2015 Cell. 5. The facility permit, site plan, and operations plan were discussed. 6. The facility is in operation Monday through Friday 7:30 am to 5:00 pm [8:00 am to 4:30 pm November through February]. 7. The facility is permitted to receive waste generated within Alamance and Guilford Counties. 8. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 9. Solid waste must be covered with 1 foot of suitable soil cover at least once per month, or when the active area reaches one acre in size, whichever occurs first. 10. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. 11. Excavation, grading, and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical feet (3:1). 12. The facility annual report (FAR) was received by the SWS, dated July 24, 2017. Ensure that the estimated facility throughput for July 2016 through June 2017 is calculated correctly. If necessary, contact Christine Ritter, SWS – Permitting Hydrogeologist, at 919-707-8254 to discuss increasing the disposal rate. 13. A ready supply of soil shall be available for cover material. 14. Edge of waste markers have been installed. 15. There was no indication of uncontrolled erosion or runoff. 16. The facility manages a small amount of leaves that is used for erosion control on the landfill cap. Mr. Fryar stated that the leaves are not distributed to the public. 17. Access roads are of all-weather construction. 18. The facility is secured by a locked gate. 19. The facility has signage. 20. The PTO expiration date is April 19, 2021. 21. The permit renewal application shall be submitted to the SWS by October 15, 2020. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
