The County had not sought or received approval to use waste glass as road base at this facility. Any changes to the approved operations or the permit for this facility must be submitted to and approved by the permitting branch before proceeding. All glass must be removed disposed of at a permitted solid waste facility. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEARING/INERT DEBRIS (LCID) LANDFILLS Land Clearing and Inert Debris (LCID) landfills shall meet the following operational requirements: (1) Operational plans shall be approved and followed as specified for the facility. The waste storage area over the closed LCID landfill was larger than previously approved. Per the response to Wilkes Road Improvements to Site Operations Report, “only a portion of the pad for the storage area for wood material over the LCID was constructed, instead of the entire LCID area as proposed in the application. If the storage area is to be expanded in the future, cover thickness verification will need to be submitted.” The area being utilized for storage has well exceeded the originally permitted 0.56-acres. It was also brought to the Section’s attention that the cover used as a pad, beyond what was initially approved, is composed of compost from the adjacent Large Type 1 Compost Facility. All leaf debris must be removed from over the LCID cap and processed or disposed of properly. ADDITIONAL COMMENTS 1. Interior roadways must be of all-weather construction and maintained in good condition. Crushed waste glass was observed on the interior road by the storage, composting and curing areas of the facility. The waste glass was observed comingled into the processed and finished piles. All waste glass must be removed. 2. As stated in the permit to operate the “Storage of wood and mulch material is approved for operation on top of the closed landfill. Composting is not approved on top of the closed landfill. A minimum of one foot of soil cover on top of the landfill cap (for a total of 2 feet of soil cover over the waste) must be maintained for storage areas. The road onto the landfill must be reinforced to prevent damage to the landfill cap. A 50-foot buffer is required between storage of wood material/mulch and the property line.” However, the approved waste storage area over the closed LCID landfill was larger than previously approved. The County was instructed that if it needed to utilized additional area over the LCID, a request for approval would need to be submitted to the Permitting Engineer, Donna Wilson. The facility has utilized greater area of the closed LCID without obtaining approval and properly following pad construction requirements. All leaf debris must be removed from the closed LCID area. 3. All sides of waste storage and compost areas must be maintained clear and drivable, to provide vehicular access in the event of a fire. 4. Vegetative debris must be maintained in windrows. The pile of waste to be ground appeared to be pushed as it was dumped without windrows. 5. The facility is currently processing vegetative debris, yard waste and yard trash without recording temperatures as required to ensure pathogen reduction for Type I facilities, therefore, the material should not be distributed to the public until the process has been completed properly. Composting operations should be performed in accordance to the rules for Type I compost facilities found in 15A NCAC 13B .1400 (.1401 - .1409). 6. County Staff stated that a contract is in the works with a facility that will take the unprocessed material for use as boiler fuel. Please, notify the Solid Waste Section when the contract has been confirmed. 7. Windrow dimensions for active composting must be limited to maximum 30 feet wide and 15 feet high, and at least 8 feet spacing between rows, unless otherwise approved by the Section. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 8.Stockpiling of all curing and finished compost, and unprocessed and processed wood material/mulch, must be limited to a maximum of 30 feet high and 50 feet wide. Facility appeared to be within the size limitations required by the permit to operate at the time of this inspection. 9.Ensure that the facility is graded for positive drainage. Ponding water was observed around areas of waste. Make sure no waste is being placed in water. 10.Any changes to the approved operations and permit conditions for this facility should be submitted to the Permitting Engineer, Donna Wilson, for approval before implementation of any changes. 11.Corrective measures are necessary as a result of the inspection findings and should be completed within 30 days’ receipt of this report.
