REGAN Secretary MICHAEL SCOTT Director June 26, 2017 CERTIFIED MAIL 7009 0820 0000 2474 1381 RETURN RECEIPT REQUESTED Mr. Harold Blaylock Blaylock Grading LLP 345 Caulton Brown Road Lillington, North Carolina 27546-7826 SUBJECT: Notice of Continuing Violation Compliance Inspection Report Blaylock Grading LCID Landfill 43C-LCID- Harnett County Dear Blaylock: On May 17, 2017, the State of North Carolina, Division of Waste Management Solid Waste Section (Section) issued a Notice of Violation letter to Blaylock Grading LCID Landfill. The following violation(s) were listed: A. 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” Blaylock Grading LCID Landfill is in violation of 15A NCAC 13B .0566(4), in that at the time of this inspection, uncovered waste was exceeding one acre and had not been covered as required by rule. The Solid Waste Section conducted a follow-up inspection(s) of the site on June 21, 2017. Due to the fact that the violation(s) noted in the May 17, 2017 NOV letter have not been corrected at this time, you are hereby notified that the Section intends to move forward in the enforcement process. In order to potentially abate any further action forthcoming, it is recommended that the following actions be taken within 30 days of receipt of this notice: 1) Upon receipt of this Notice of Violation, uncovered waste needs to be covered within 30 days of receipt of this Notice of Violation Blaylock Grading LCID Landfill Notice of Continuing Violation Page 2 of 2 June 26, 2017 2) Operator will continue to keep the LCID working face as small as possible with a ½ acre maximum size to comply with #7 of the approved operations plan. The violations(s) listed above were observed by Section staff and require action on behalf of the facility and/or all responsible parties in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to Blaylock Grading LCID Landfill. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. We solicit your cooperation and would like to avoid taking further enforcement actions. At the same time, it is your responsibility to comply with the requirements of the General Statutes and/or the North Carolina Administrative Code.
