The Permit to Operate shall expire on August 11, 2021, based on the existing franchise of the facility. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility is permitted to operate a Scrap Tire Monofill as defined in 15A NCAC 13B .1101 for the exclusive disposal of scrap tires. 2. The service area for the facility includes North Carolina, South Carolina, Virginia, West Virginia, Georgia, Tennessee and Florida. 3. The facility is secured by a gate at the facility entrance. A security guard is also present during the evening and nighttime hours. 4. The current franchise agreement with the City of Concord expires on August 11, 2021. Operations Inspection of the Tire Monofill: 5. Continue to ensure that the working face is kept as small as practicable. 6. Shredded tires from the scrap tire processing facility and tires too large to process (off-road vehicles and heavy earth moving equipment) are disposed of in the monofill. 7. No unacceptable waste was observed. 8. The facility has been approved by the Section to cover the waste with six inches of earthen materials at least twice per week. 9. A good vegetative cover was being maintained on inactive areas. Continue to seed and mulch as needed. Records Review: 10. Reviewed the permit, operations plan, groundwater and surface water sampling reports (April 2016 and October 2016), tonnage records and scrap tire certification forms. 11. Take measures to ensure that a notation of the date and time of soil cover placement is recorded in the operating record.
