The Permit to Operate expired on July 1, 2016. Permit information was received by the Solid Waste Section - Permitting Branch and deemed incomplete. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.”  Attachment 1, Part IV, General Condition 7 states: “This permit is issued based on the documents submitted in support of the permit application for the facility including those identified in Attachment 1, “List of Documents for Approved Plan”, and which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of the Permit shall govern.”  The approved Operations Plan is included in the list of Documents for the Approved Plan. As stated in FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 Section 3.4.6 (Gypsum Wallboard/Sheetrock Recycling) of the Operations Plan located in Appendix H of the Construction Plan Application and Composting Facility Permit Application approved by the Section on July 1, 2011 (DIN 14284), the material will be stockpiled outdoors, but is covered with weighted tarps to keep the material dry awaiting processing. During the inspection, no tarps were observed at the gypsum drywall/sheetrock area. To achieve compliance, within 10-days of receipt of this inspection report, the gypsum drywall/sheetrock stored outside must be covered with weighted tarps. 2. 15A NCAC 13B .0544(d)(1)(A) states, “Owners and operators of all C&DLF units must ensure that: (A) the concentration of methane gas or other explosive gases generated by the facility does not exceed 25 percent of the lower explosive limit in on-site facility structures (excluding gas control or recovery system components).” Review of the quarterly methane monitoring reports indicate that on-site facility structures have not been monitored. To achieve compliance, within 30-days of receipt of this inspection report, all on-site facility structures must be monitored to ensure that the concentration of methane gas or other explosive gases generated by the facility does not exceed 25 percent of the lower explosive limit. ADDITIONAL COMMENTS 1. The Permit to Construct the Phase 1 Expansion and the Permit to Operate the Construction and Demolition Landfill -Existing Phases 1-3, Construction and Demolition Treatment and Processing Facility and Type 1 Composting Facility was issued on July 1, 2011. The Permit to Operate expired on July 1, 2016. Permit information was received by the section. However, according to a letter entitled Determination of Completeness – Application Incomplete dated December 9, 2016, issued by the Solid Waste Section, the application was deemed incomplete. The facility consists of a Construction and Demolition Landfill, a Treatment and Processing facility and a Type 1 Composting facility. 3. The facility is permitted to receive solid waste generated within the following counties: Cabarrus, Mecklenburg, Union, Stanly, Iredell and Rowan. 4. The facility is secured by a locked gate at the facility entrance. 5. Access roads are of all-weather construction. 6. Post inspection research was conducted on the status of permitting and other operations at the facility. Operations Inspection of the CDLF: 7. The facility was working in Phase 3 during the inspection. 8. The working face appeared to be less than ½ acre in size and was well controlled. 9. During the inspection, waste from a property cleanup was unloaded at the working face. Facility personnel informed the driver that the load was unacceptable and the waste was reloaded onto the trailer. The driver was given information to the closest municipal solid waste landfill. 10. Observed wood waste consisting of pallets and dimensional cut lumber being stockpiled to be recycle. 11. Observed concrete and asphalt being stockpiled to be ground and reused. 12. Edge of waste markers were being maintained. 13. Windblown waste was well controlled. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Operations Inspection of the Type 1 Compost Facility: 15. No unacceptable waste was observed. 16. The compost area was well managed. 17. Ensure that a twenty-five (25) foot minimum buffer is maintained between compost areas and swales or berms to allow for adequate access of firefighting equipment. Operations Inspection of the Treatment and Processing Facility: 18. Only gypsum wallboard/sheetrock is being processed in the recycling facility. No other waste type was observed. 19. Ensure that paper from the gypsum wallboard/sheetrock is picked up on a daily basis. Records Review: 20. Reviewed the permit, operations plan, quarterly methane monitoring, groundwater and surface water monitoring, training records, random inspection records (3 per week), load refusal records, mobile home deconstruction records, soil cover log and compost temperatures. 21.
