PART I: GENERAL FACILITY 1. This permit is issued by the North Carolina Department of Environmental Quality, Division of Waste Management (Division), Solid Waste Section (Section). In accordance with North Carolina Solid Waste Management Rule (Rule) 15A NCAC 13B .0201(d), a solid waste management facility permit shall have two parts: a Permit Approval to Construct and a Permit Approval to Operate. The Permit Approval to Construct (PTC) must be implemented in accordance with Attachment 2 of this permit. The Permit Approval to Operate (PTO) must be implemented in accordance with Attachment 3 of this permit. 2. The persons to whom this permit is issued (“permittee”) are the owners and operators of the solid waste management facility. 3. The certified copy of the permit issued on December 10, 2012 (DIN 17444) was presented and recorded in Book Number R7427 and Page Number 1150 through 1157 by Guilford County Register of Deed Office on December 20, 2012 (DIN 17984). 4. When this property is sold, leased, conveyed, or transferred in any manner, the deed or other instrument of transfer shall contain in the description section in no smaller type than that used in the body of the deed or instrument, a statement that the property has been used as a sanitary landfill and a reference by book and page to the recordation of the permit. 5. By beginning receiving waste at the facility the permittee shall be considered to have accepted the terms and conditions of this permit. 6. Construction or operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (N.C.G.S. 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Failure to comply may result in compliance action or permit revocation. 7. This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in the “List of Documents for the Approved Plan” which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of Permit shall govern. 8. This permit may be transferred only with the approval of the Section, through the issuance of a new or substantially amended permit in accordance with applicable statutes and rules. 9. In accordance with N.C.G.S. 130A-295.2(g) the permittee shall notify the Section thirty (30) days prior to any significant change in the identity or business structure of either the owner or the operator, including but not limited to a proposed transfer of ownership of the facility or a change in the parent company of the owner or a change in the operator of the facility or parent company of the operator. 10. The permittee is responsible for obtaining all permits and approvals necessary for the development of this project including approval from appropriate agencies for a General or Individual National Pollutant Discharge Elimination System Stormwater Discharge Permit, if applicable and a sedimentation and erosion control permit. Issuance of this permit does not remove the permittee’s responsibilities for compliance with any other local, state or federal rule, regulation or statute. PART VI - TRANSFER STATION/TREATMENT & PROCESSING UNIT(S) 4119TP-TIRETP-, Guilford County Scrap Tire and White Goods Collection Site General Operating Conditions 1. This permit shall expire September 13, 2022. No later than July 15, 2022, the permittee must submit the Section a request for permit review and must update pertinent facility plans including, but not limited to, the facility operation. 2. This facility is permitted to receive and temporarily store the following waste streams from Guilford, Alamance, Cabarrus, Davidson, Forsyth, Mecklenburg, Rowan, and Wake Counties. a. Scrap tire as defined in N.C.G.S. 130A-309.53 (7). b. White goods as defined in N.C.G.S. 130A-290(a)(44). c. Electronic wastes as defined in N.C.G.S. 130A-309.131 and battery. d. Commingled recyclable materials as defined in N.C.G.S. 130A-290(a)(26). 3. Any changes in the facility or operational conditions, the permittee must submit the Section a written request for an approval prior to implementation according to N.C.G.S. 130A-295.8(b)(3). 4. Pursuant to N.C.G.S. 130A-309.25, the permittee must employ a trained and knowledgeable personnel on-site during operating hours to screen wastes and to assure that operations at this facility are in accordance with Rules of 15A NCAC 13B, the permit conditions set forth in this permit, and the approved operation plan. The non- conformance wastes or non-permitted wastes must be properly managed, handled, or disposed of at a permitted facility according to the approved Operations Plan (DIN 27870). 5. The permittee must adequately secure the site to prevent unauthorized entry and maintain the access road that is passable by any motor vehicle, including fire truck at all times according to Rules 15A NCAC 13B .1106(c)(4) & (c)(8). A sign with the name of the facility, the permit number, operating hours, and emergency phone number must be maintained at the entrance of the facility according to Rule 15A NCAC 13B .1107(2)(d). 7. The facility may operate outside of the normal operation days and time listed in the approved operation plan to facilitate the collection of recyclables, to collect from a natural disaster, and to conduct community clean-up events. 8. The permittee must operate, maintain, and temporarily store received scrap tires and recyclables in reasonably sized areas or piles with adequate fire breaks and lanes, with sufficient dust and odor control measures to minimize airborne emissions and to prevent dust or litter from becoming a nuisance or safety and fire hazard in accordance with Rules 15A NCAC 13B .0104(e) & (f) and .1107. Effective vector control measures shall be applied as necessary to control mosquitoes, flies, rodents, insects, or vermin. 9. The permittee shall divert surface water from all operational and storage areas to prevent standing water in operational areas and under or around storage areas. 10. Pursuant to Rule 15A NCAC 13B .1106(c)(6), the permittee must construct or install all operational sedimentation and erosion control measures in accordance with the Sedimentation Control Act N.C.G.S. 113A-50, et seq. and rules promulgated under 15A NCAC 4 to mitigate excessive on-site erosion and to prevent silt from leaving the operating area or unit during the service life of the facility. 11. Modifications to the approved sedimentation and erosion control activities require approval by the North Carolina Land Quality Section. The Section must be notified of any sedimentation and erosion control plan modifications 12. The permittee must notify the Regional Senior Environmental Specialist within 24 hours of a fire or other emergency involving potential off-site impacts. Within two weeks, after occurrence, the operator of the site shall submit to the Section a written report describing the cause(s) of the emergency, actions taken to deal with the emergency, results of the actions taken, and an analysis of the success of failure of these actions according to Rule 15A NCAC 13B .1107(2)(j). The Section may require the permittee taking further action to correct any condition that may adversely affect public health or the environment. 13. Copies of this permit, the approved plans, and all records that are required to be maintained by the permittee according to the approved document (DIN 27870) and Rule Facility Permit No. 4119TP-TIRETP Permit Approval to Operate Guilford County Scrap Tire and White Goods Collection Site Issuance Date:June 09, 2017 DIN 27871 Page 8 of 11 15A NCAC 13B .1107(2)(k) and must be maintained at the facility and made available to the Section upon request during normal business hours. 14. The permittee must maintain a record of the amount of wastes received at the facility including daily records of waste received and origins of the loads in accordance with the approved documents (DIN 27870) and Rule 15A NCAC 13B .1106(d)(6). The daily records should be summarized into a monthly report for use in the required annual reports. 15. On or before August 1 annually, the permittee must submit an annual facility report to the Section, on forms prescribed by the Section. a. The reporting period shall be for the previous year beginning July 1 and ending June 30. b. The annual facility report must list the amount of waste received, in tons and be compiled: i) On a monthly basis. ii) By county or city of origin. iii) By diversion to alternative management facilities. c. The completed report must be forwarded to the Regional Senior Environmental Specialist for the facility by the date due on the prescribed annual facility report form. d. A copy of the completed report must be forwarded to each county manager for each county from which waste was received at the facility. Documentation that a copy of the report has been forwarded to the county managers must be sent to the Regional Senior Environmental Specialist by the date due on the prescribed annual facility report form. 16. Within one (1) month after termination of operations at the site or a major portion thereof or upon revocation of this permit, all scrap tires, white goods, recyclables, and associated derived products must be removed to a permitted solid waste management facility approved to receive this type of waste. The permittee must conduct the site closure according to the approved plan (DIN 27870) and Rule 15A NCAC 13B .1109(b). OPERATIONAL CONDITIONS – SCRAP TIRE COLLECTION SITE Facility Permit No. 4119TP-TIRETP Permit Approval to Operate Guilford County Scrap Tire and White Goods Collection Site Issuance Date:June 09, 2017 DIN 27871 Page 9 of 11 17. The permittee shall operate the scrap tire collection site, as defined in N.C.G.S. 130A- 309.53(1) in accordance with Rule 15A NCAC 13B .1107, the approved Operations Plan (DIN 27870), and the permit conditions set forth in this permit. 18. The permittee is approved to place and temporarily store collected scrap tires inside the storage building, in trailers or in piles outside the storage building. At no time shall more than 60,000 scrap tires be stored onsite according to Rule 15A NCAC 13B .1107(2)(l). 19. When the collected scrap tires are placed and temporarily stored in piles outside the storage building but within the permitted facility boundaries, the permittee must ensure that: a. A minimum of a 50-foot buffer between all property lines and scrap tire storage areas is constantly maintained according to Rule 15A NCAC 13B .1106(c)(2). b. Stored scrap tires shall be covered upon receipt with a water shedding material and kept free of grass, underbrush, and other potentially flammable vegetable at all times. c. Tire trailers, when full, must be transported by a registered tire hauler, according to Rule 15A NCAC 13B .1112, to an off-site permitted facility for treatment, process or disposal. d. If a trailer is not available for storing collected scrap tires, scrap tires may be stockpiled in the designated contingency area. The Regional Senior Environmental Specialist must be contacted within 24 hours in the event of outdoor storage. The scrap tire pile must have dimensions less than 200 feet in length, 50 feet in width, and 15 feet in height placed or be removed for disposal within ten days. 20. Pursuant to Rule 15A NCAC 13B .1107(2)(f), a fire safety survey must be conducted annually by local fire protection authorities. Adequate fire protection measures must be in place and fire prevention procedures must be practiced at all times in accordance with the most current fire safety survey. A copy of this inspection must be kept on file at the facility and be available upon request. 21. An emergency preparedness manual containing the elements listed in Rule 15A NCAC 13B .1107(2)(i) must be kept at the site. The manual must be updated at least once a year, upon changes in operations at the site or as required by the Section. The operator must employ a record keeping system that accounts for the scrap tires received and scrap tires removed from the site on a daily and cumulative basis to ensure that the storage limit of 60,000 scrap tire in accordance with Rule 15A NCAC 13B .1107 (2)(l) is not exceeded and accounts for use in annual reporting. When converting the number of scrap tires to tons or cubic years, it should be assumed there are 100 tires per ton and ten tires per cubic yard consistent with Rule 15A NCAC 13B .1106 (d)(6). OPERATIONAL CONDITIONS - WHITE GOODS 23. The facility is permitted to receive and temporarily store white goods and scrap metal in a storage unit at the designated area. The permittee must manage the white goods in accordance with the Operations Plan (DIN 27870) and all applicable statutes and rules of the State of North Carolina. 24. Pursuant to N.C.G.S 130A 309.81(a), the permittee must assure that white goods containing chlorofluorocarbon refrigerants (Freon) are properly removed by well-trained personnel. 25. Prior to properly removing Freon from the white goods, the permittee must separately store the white goods containing Freon from the non-Freon white goods and scrap metal at this area. OPERATIONAL CONDITIONS - COMMINGLE RECYCLABLE 26. The facility is approved to accept recovered material or commingle recyclable material as defined in N.C.G.S. 130A-294(a) (24) & (26), respectively and shall be transferred to the facilities described in the approved Operational Plan (DIN 27870). 27. The permittee shall conduct waste screen to assure the acceptable recyclable according to the approved Operations Plan (DIN 27870) is placed and temporarily stored in the containers. No waste sorting processes is permitted at this facility. 28. Recovered or recyclable material must be managed as a valuable commodity in a manner consistent with the desired use or end use. The permittee must operate and manage received recyclables or recovered material at this facility according to the requirements set forth in N.C.G.S. 130A-309.05(c)(1), (2), (3), & (4) and the approved Operational Plan (DIN 27870). 29. Seventy-five present (75%), by weight, of the recovered material stored at the facility at the beginning of a calendar year commencing January 1, must be removed from the facility through sale, use, or reuse by December 31 of the same year. This facility is permitted to receive and temporarily store the discarded electronics including televisions, computer, or computer equipment as defined in N.C.G.S. 130A- 309.131 and used battery. The collected electronics wastes must be properly sorted, palletized, and stored in a covered and locked trailer according to the approved plan. 31. The trailer, when full, will be transported to a recycling facility.
