Dear Mr. Frost,

As discussed via phone conversation on May 26, 2017, Duke Energy is notifying the Department of the
intent to use the FGD Landfill as a temporary staging area for construction materials. Storage on the
FGD Landfill will be limited to materials only and equipment will only be used to bring materials to and
from the top deck. Material storage is intended to last approximately three months and care will be taken
to ensure there is no damage to the landfill cover. If any damage occurs despite efforts taken, Duke
Energy will take action to repair as soon as is feasible.
