Box 101 Wentworth, NC 27375 SUBJECT: Notice of Violation Compliance Inspection Report Rockingham County Landfill Permit No. 7904-MSWLF-1995 Rockingham County Dear Mr. Metzler: On April 27, 2017, Susan Heim and Larry Frost, representing the State of North Carolina, Division of Waste Management Solid Waste Section (Section), inspected the above referenced facility for compliance with North Carolina solid waste statutes and rules. Martie Neugent, Landfill Supervisor, was present and represented the Rockingham County Landfill during this inspection. The following violation was noted: A. 15A NCAC 13B .1626(8)(d) states, in part: “Leachate shall be contained within a lined disposal cell or leachate collection and storage system. All leachate shall be treated, as required by the receiving facility, prior to discharge.” Rockingham County is in violation of 15A NCAC 13B .1626(8)(d) by failing to contain leachate within a lined disposal cell or leachate collection and storage system or to treat it prior to discharge. Based upon the foregoing, the Rockingham County Landfill shall come into compliance with all requirements of the regulations in 15A NCAC 13B by completing the following within the timeframes specified below in items 1 and 2: Rockingham County Landfill Notice of Violation Page 2 of 3 May 2, 2017 State of North Carolina | Environmental Quality | Waste Management Winston-Salem Regional Office | 450 West Hanes Mill Road | Suite 300 | Winston-Salem, NC 27105-9667 336-796-9800 1. Immediately ensure that all leachate outbreaks have been repaired and any waste uncovered due to the repairs is returned to the working face of the landfill for proper disposal. 2. Within 5 days of receipt of this Notice of Violation, contact Ervin Lane, Solid Waste Section Compliance Hydrogeologist, at 919-707-8288 to present a sampling plan, to be implemented upon his approval, to evaluate the extent of any potential environmental impact resulting from these leachate releases. The results of this evaluation will dictate any additional corrective measures to be required. Please note that the continuing violations addressed in the accompanying inspection report as having corrective measures in progress must also be addressed as specified in that report and in the Notice of Violation issued on December 22, 2016. This Notice of Violation in no way precludes or supersedes these additional requirements for bringing the facility into compliance. The violation listed above was observed by Section staff and require action on behalf of the facility to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct follow-up inspections to verify that the facility has completed the requirements of this Notice of Violation. A meeting has been scheduled by your consultant, Joyce Engineering, for 10 am on Tuesday, May 23, 2017 at the landfill office to discuss facility operations. I will be unavailable until May 22, 2017, however, Mr. Frost and I will be attending this meeting. Your participation at the meeting is both encouraged and welcomed.
