STATUS OF PERMIT: Original Permit to Construct (PTC)/Permit To Operate (PTO) Phase I issued February 19, 2010 Administrative Correction of Permit Number March 15, 2010 PTC Cell 2/PTO Cell 1 and 2 issued June 2, 2015 PTC expires September 17, 2020 PTO expires September 17, 2020 PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NONE FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 OBSERVED VIOLATIONS: Per 15A NCAC 13B .0566(2), The facility shall only accept those solid wastes which it is permitted to receive. Emptying out concrete mixing trucks within the permitted landfill is not approved and must stop immediately. Per condition #4 in Part 1 of Attachment 3 of the Permit, This facility is permitted to receive land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted rock, brick, concrete, and concrete block; and asphalt in accordance with NCGS 130-294(m). Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” Based on observations of the site at the time of this inspection and discussion with the operator, uncovered waste had not been covered as required by rule. Per condition #11 in Part 1 of Attachment 3 of the Permit, Solid waste must be covered with 1 foot of suitable soil cover at least once per month or when the active area reaches 1 acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors or excessive water infiltration. All areas of waste that are not part of the working face must be covered within 30 days. Standing in cell 2 looking north at areas of waste not covered FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 ADDITIONAL COMMENTS On April 26, 2017, Liz Patterson met with Jeff Lees to conduct a comprehensive inspection of the Weeks Sand Pit #2 LCID Landfill located at 20796 N.C. Highway 24-27 in Harnett County. 1. The facility is a land clearing and inert debris (LCID) landfill. 2. The facility has proper signage. 3. The PTO expiration date is September 17, 2020. The permit renewal application due date is March 17, 2019. 4. The facility is properly secured with a locked gate. Personnel are on site during operating hours. 5. The facility is permitted to receive waste generated within Harnett County, Wake County, Johnston County, Cumberland County, Sampson County, Moore County, and Lee County. 6. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and asphalt. 7. Operator has contacted person who dumped load of painted concrete beside cell 1 and will have that removed shortly. 8. The facility site plan, operations plan, and permit are kept on site and were reviewed with the site operator. 9. Stockpiled materials are in areas designated on map in Cell 2 per approved plan and map. 10. Construction of Cell 2 must be completed in accordance to the approved plans submitted to the division. All necessary documentation and certifications related to the construction and preparation of Cell 2 must be submitted to the permitting branch as required before commencing operations. 11. Access roads are of all-weather construction. 12. Digital pictures were taken during the inspection. 13. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days receipt of this report. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
